| 11 | 11 | | equipment after a delay for or waiver of compliance. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 754.014, Health and Safety Code, is |
|---|
| 14 | 14 | | amended by adding Subsections (f) and (i) to read as follows: |
|---|
| 15 | 15 | | (f) On expiration of a granted delay for compliance or |
|---|
| 16 | 16 | | denial of a requested delay for compliance under Subsection (e), |
|---|
| 17 | 17 | | the equipment must be inspected or removed in accordance with this |
|---|
| 18 | 18 | | chapter and commission rules. |
|---|
| 19 | 19 | | (i) On denial of a requested waiver of compliance under |
|---|
| 20 | 20 | | Subsection (g), (h), or (h-1), the equipment must be inspected or |
|---|
| 21 | 21 | | removed in accordance with this chapter and commission rules. |
|---|
| 22 | 22 | | SECTION 2. Section 754.015, Health and Safety Code, is |
|---|
| 23 | 23 | | amended by amending Subsection (c) and adding Subsection (c-1) to |
|---|
| 24 | 24 | | read as follows: |
|---|
| 25 | 25 | | (c) The commission by rule may require a reinspection or |
|---|
| 26 | 26 | | recertification of equipment if: |
|---|
| 27 | 27 | | (1) the equipment has been altered; or |
|---|
| 28 | 28 | | (2) the equipment poses a significant threat to |
|---|
| 29 | 29 | | passenger or worker safety[; or |
|---|
| 30 | 30 | | [(3) an annual inspection report indicates an existing |
|---|
| 31 | 31 | | violation has continued longer than permitted in a delay granted by |
|---|
| 32 | 32 | | the executive director]. |
|---|
| 33 | 33 | | (c-1) The commission by rule shall require a reinspection or |
|---|
| 34 | 34 | | recertification of equipment not later than the expiration date of |
|---|
| 35 | 35 | | a granted delay for compliance for a violation indicated in an |
|---|
| 36 | 36 | | annual inspection report. |
|---|
| 37 | 37 | | SECTION 3. The Texas Commission of Licensing and Regulation |
|---|
| 38 | 38 | | shall adopt the rules necessary to implement, administer, and |
|---|
| 39 | 39 | | enforce Sections 754.014(f) and (i) and 754.015(c-1), Health and |
|---|
| 40 | 40 | | Safety Code, as added by this Act. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2025. |
|---|
