77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the inspection or removal by the Texas Department of
1010 Licensing and Regulation of elevators, escalators, and related
1111 equipment after a delay for or waiver of compliance.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 754.014, Health and Safety Code, is
1414 amended by adding Subsections (f) and (i) to read as follows:
1515 (f) On expiration of a granted delay for compliance or
1616 denial of a requested delay for compliance under Subsection (e),
1717 the equipment must be inspected or removed in accordance with this
1818 chapter and commission rules.
1919 (i) On denial of a requested waiver of compliance under
2020 Subsection (g), (h), or (h-1), the equipment must be inspected or
2121 removed in accordance with this chapter and commission rules.
2222 SECTION 2. Section 754.015, Health and Safety Code, is
2323 amended by amending Subsection (c) and adding Subsection (c-1) to
2424 read as follows:
2525 (c) The commission by rule may require a reinspection or
2626 recertification of equipment if:
2727 (1) the equipment has been altered; or
2828 (2) the equipment poses a significant threat to
2929 passenger or worker safety[; or
3030 [(3) an annual inspection report indicates an existing
3131 violation has continued longer than permitted in a delay granted by
3232 the executive director].
3333 (c-1) The commission by rule shall require a reinspection or
3434 recertification of equipment not later than the expiration date of
3535 a granted delay for compliance for a violation indicated in an
3636 annual inspection report.
3737 SECTION 3. The Texas Commission of Licensing and Regulation
3838 shall adopt the rules necessary to implement, administer, and
3939 enforce Sections 754.014(f) and (i) and 754.015(c-1), Health and
4040 Safety Code, as added by this Act.
4141 SECTION 4. This Act takes effect September 1, 2025.
