13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Chapter 222, Health and Safety Code, is amended |
---|
15 | 15 | | by adding Subchapter D to read as follows: |
---|
16 | 16 | | SUBCHAPTER D. MEDICAL CARE PROVIDED AT CERTAIN HEALTH CARE |
---|
17 | 17 | | FACILITIES BY PHYSICIANS WITH CERTAIN GRADUATE MEDICAL EDUCATION |
---|
18 | 18 | | Sec. 222.101. DEFINITIONS. In this subchapter: |
---|
19 | 19 | | (1) "Commission" means the Health and Human Services |
---|
20 | 20 | | Commission. |
---|
21 | 21 | | (2) "Executive commissioner" means the executive |
---|
22 | 22 | | commissioner of the commission. |
---|
23 | 23 | | (3) "Health care facility" means a health care |
---|
24 | 24 | | facility licensed by the commission. |
---|
25 | 25 | | Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH |
---|
26 | 26 | | ALTERNATE GRADUATE MEDICAL EDUCATION OR BOARD CERTIFICATION. A |
---|
27 | 27 | | health care facility may not: |
---|
28 | 28 | | (1) in employing or granting practice or admitting |
---|
29 | 29 | | privileges for a physician to provide medical care to patients at |
---|
30 | 30 | | the facility, refuse to accept: |
---|
31 | 31 | | (A) graduate medical education that is approved |
---|
32 | 32 | | by the Texas Medical Board as provided by Section 155.012, |
---|
33 | 33 | | Occupations Code; or |
---|
34 | 34 | | (B) for board certification purposes, a |
---|
35 | 35 | | physician's specialty board certification that is issued by a |
---|
36 | 36 | | specialty board accredited by an organization the board approves |
---|
37 | 37 | | under Section 155.012, Occupations Code; or |
---|
38 | 38 | | (2) otherwise discriminate against a physician |
---|
39 | 39 | | described by Subdivision (1) in an employment or privilege decision |
---|
40 | 40 | | based on the physician's graduate medical education or board |
---|
41 | 41 | | certification. |
---|
42 | 42 | | Sec. 222.103. LICENSE REVOCATION. The commission shall |
---|
43 | 43 | | revoke the license of a health care facility that violates this |
---|
44 | 44 | | subchapter. |
---|
45 | 45 | | Sec. 222.104. RULES. The executive commissioner shall |
---|
46 | 46 | | adopt rules to implement this subchapter. |
---|
47 | 47 | | SECTION 2. Subchapter A, Chapter 155, Occupations Code, is |
---|
48 | 48 | | amended by adding Section 155.012 to read as follows: |
---|
49 | 49 | | Sec. 155.012. BOARD APPROVAL OF GRADUATE MEDICAL EDUCATION. |
---|
50 | 50 | | (a) The board shall approve graduate medical education accredited |
---|
51 | 51 | | by an organization other than the Accreditation Council for |
---|
52 | 52 | | Graduate Medical Education if the board determines the organization |
---|
53 | 53 | | meets all requirements established by this subtitle and board rule. |
---|
54 | 54 | | (b) A reference in this chapter to the Accreditation Council |
---|
55 | 55 | | for Graduate Medical Education includes an organization the board |
---|
56 | 56 | | approves under Subsection (a). |
---|
57 | 57 | | SECTION 3. As soon as practicable after the effective date |
---|
58 | 58 | | of this Act: |
---|
59 | 59 | | (1) the executive commissioner of the Health and Human |
---|
60 | 60 | | Services Commission shall adopt the rules necessary to implement |
---|
61 | 61 | | Subchapter D, Chapter 222, Health and Safety Code, as added by this |
---|
62 | 62 | | Act; and |
---|
63 | 63 | | (2) the Texas Medical Board shall adopt the rules |
---|
64 | 64 | | necessary to implement Section 155.012, Occupations Code, as added |
---|
65 | 65 | | by this Act. |
---|
66 | 66 | | SECTION 4. This Act takes effect September 1, 2025. |
