77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to approval of graduate medical education by the Texas
1010 Medical Board and medical care provided at certain health care
1111 facilities by physicians with that education or certain board
1212 certification.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Chapter 222, Health and Safety Code, is amended
1515 by adding Subchapter D to read as follows:
1616 SUBCHAPTER D. MEDICAL CARE PROVIDED AT CERTAIN HEALTH CARE
1717 FACILITIES BY PHYSICIANS WITH CERTAIN GRADUATE MEDICAL EDUCATION
1818 Sec. 222.101. DEFINITIONS. In this subchapter:
1919 (1) "Commission" means the Health and Human Services
2020 Commission.
2121 (2) "Executive commissioner" means the executive
2222 commissioner of the commission.
2323 (3) "Health care facility" means a health care
2424 facility licensed by the commission.
2525 Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH
2626 ALTERNATE GRADUATE MEDICAL EDUCATION OR BOARD CERTIFICATION. A
2727 health care facility may not:
2828 (1) in employing or granting practice or admitting
2929 privileges for a physician to provide medical care to patients at
3030 the facility, refuse to accept:
3131 (A) graduate medical education that is approved
3232 by the Texas Medical Board as provided by Section 155.012,
3333 Occupations Code; or
3434 (B) for board certification purposes, a
3535 physician's specialty board certification that is issued by a
3636 specialty board accredited by an organization the board approves
3737 under Section 155.012, Occupations Code; or
3838 (2) otherwise discriminate against a physician
3939 described by Subdivision (1) in an employment or privilege decision
4040 based on the physician's graduate medical education or board
4141 certification.
4242 Sec. 222.103. LICENSE REVOCATION. The commission shall
4343 revoke the license of a health care facility that violates this
4444 subchapter.
4545 Sec. 222.104. RULES. The executive commissioner shall
4646 adopt rules to implement this subchapter.
4747 SECTION 2. Subchapter A, Chapter 155, Occupations Code, is
4848 amended by adding Section 155.012 to read as follows:
4949 Sec. 155.012. BOARD APPROVAL OF GRADUATE MEDICAL EDUCATION.
5050 (a) The board shall approve graduate medical education accredited
5151 by an organization other than the Accreditation Council for
5252 Graduate Medical Education if the board determines the organization
5353 meets all requirements established by this subtitle and board rule.
5454 (b) A reference in this chapter to the Accreditation Council
5555 for Graduate Medical Education includes an organization the board
5656 approves under Subsection (a).
5757 SECTION 3. As soon as practicable after the effective date
5858 of this Act:
5959 (1) the executive commissioner of the Health and Human
6060 Services Commission shall adopt the rules necessary to implement
6161 Subchapter D, Chapter 222, Health and Safety Code, as added by this
6262 Act; and
6363 (2) the Texas Medical Board shall adopt the rules
6464 necessary to implement Section 155.012, Occupations Code, as added
6565 by this Act.
6666 SECTION 4. This Act takes effect September 1, 2025.
