77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the process of establishing speed limits on a highway or
1010 road near a prekindergarten.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 545.355(b), Transportation Code, is
1313 amended to read as follows:
1414 (b) The commissioners court of a county may declare a lower
1515 speed limit of not less than:
1616 (1) 30 miles per hour on a county road or highway to
1717 which this section applies, if the commissioners court determines
1818 that the prima facie speed limit on the road or highway is
1919 unreasonable or unsafe; or
2020 (2) 20 miles per hour:
2121 (A) in a residence district, unless the roadway
2222 has been designated as a major thoroughfare by a city planning
2323 commission; or
2424 (B) on a county road or highway to which this
2525 section applies that is located within 500 feet of a
2626 prekindergarten, an elementary, secondary, or open-enrollment
2727 charter school, or an institution of higher education, if approved
2828 under Section 545.357.
2929 SECTION 2. Sections 545.357(a), (b), (c), (d), and (e),
3030 Transportation Code, are amended to read as follows:
3131 (a) The governing body of a municipality in which a
3232 prekindergarten, a public or private elementary or secondary
3333 school, an open-enrollment charter school, or an institution of
3434 higher education is located shall, on request of the operator of a
3535 prekindergarten or the governing body of a school or institution of
3636 higher education, hold a public hearing at least once each calendar
3737 year to consider prima facie speed limits on a highway in the
3838 municipality, including a highway of the state highway system, near
3939 the prekindergarten, school, or institution of higher education.
4040 (b) If a county road outside the state highway system is
4141 located within 500 feet of a prekindergarten, a public or private
4242 elementary or secondary school, an open-enrollment charter school,
4343 or an institution of higher education that is not in a municipality,
4444 the commissioners court of the county, on request of the operator of
4545 a prekindergarten or the governing body of a school or institution
4646 of higher education, shall hold a public hearing at least once each
4747 calendar year to consider the prima facie speed limit on the road
4848 near the prekindergarten, school, or institution of higher
4949 education.
5050 (c) A municipal governing body or commissioners court, on
5151 request of the operator of a prekindergarten or the governing body
5252 of a school or institution of higher education, may hold one public
5353 hearing for all prekindergartens, public and private elementary and
5454 secondary schools, open-enrollment charter schools, and
5555 institutions of higher education in its jurisdiction.
5656 (d) The Texas Transportation Commission, on request of the
5757 operator of a prekindergarten or the governing body of a school or
5858 institution of higher education, shall hold a public hearing at
5959 least once each calendar year to consider prima facie speed limits
6060 on highways in the state highway system that are near
6161 prekindergartens, public or private elementary or secondary
6262 schools, open-enrollment charter schools, or institutions of
6363 higher education.
6464 (e) On request of the operator of a prekindergarten or the
6565 governing body of a school or institution of higher education
6666 following a public hearing held under this section, the
6767 commissioners court, municipal governing body, or Texas
6868 Transportation Commission, as applicable, shall conduct an
6969 engineering and traffic investigation for the highway or road that
7070 is the subject of the request. On review of the results of the
7171 investigation, the commissioners court, municipal governing body,
7272 or Texas Transportation Commission has the same authority and
7373 discretion to alter prima facie speed limits as provided by Section
7474 545.353, 545.355, or 545.356, as applicable. Following each public
7575 hearing held under this section, the operator of a prekindergarten
7676 or the governing body of a school or institution of higher education
7777 may make only one request under this subsection for an engineering
7878 and traffic investigation.
7979 SECTION 3. Section 545.357(f), Transportation Code, is
8080 amended by adding Subdivision (4) to read as follows:
8181 (4) "Prekindergarten" means a facility that primarily
8282 provides prekindergarten services.
8383 SECTION 4. This Act takes effect September 1, 2025.
