88 AN ACT
99 relating to Medicare provider certification and enrollment
1010 prerequisites to Medicaid and child health plan program provider
1111 enrollment.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 532, Government Code, as
1414 effective April 1, 2025, is amended by adding Section 532.0159 to
1515 read as follows:
1616 Sec. 532.0159. MEDICARE PROVIDER CERTIFICATION OR
1717 ENROLLMENT AS PREREQUISITE TO MEDICAID PROVIDER ENROLLMENT. (a)
1818 This section applies only to a provider that has not been terminated
1919 or excluded from participating as a provider under Medicare,
2020 another state's Medicaid program, or the child health plan program.
2121 (b) To participate as a provider in Medicaid, a provider
2222 must be certified for enrollment or enrolled as a provider in
2323 Medicare unless the provider is exempted as provided by Subsection
2424 (c).
2525 (c) A provider is exempt from the Medicare certification or
2626 enrollment requirement under Subsection (b) if:
2727 (1) the provider's type of practice or health care
2828 services offered are not covered by Medicare;
2929 (2) the provider's exclusion from Medicaid
3030 participation on the basis of the lack of Medicare certification or
3131 enrollment will restrict a recipient's access to necessary
3232 services; or
3333 (3) a commission or other state agency rule expressly
3434 exempts the provider from the Medicare certification or enrollment
3535 requirement.
3636 SECTION 2. Subchapter D, Chapter 62, Health and Safety
3737 Code, is amended by adding Section 62.1562 to read as follows:
3838 Sec. 62.1562. MEDICARE PROVIDER CERTIFICATION OR
3939 ENROLLMENT AS PREREQUISITE TO CHILD HEALTH PLAN PROGRAM HEALTH CARE
4040 PROVIDER ENROLLMENT. (a) This section applies only to a health
4141 care provider that has not been terminated or excluded from
4242 participating as a provider under Medicare or this state's or
4343 another state's Medicaid program.
4444 (b) To participate as a health care provider in the child
4545 health plan program, a health care provider must be certified for
4646 enrollment or enrolled as a provider in Medicare unless the
4747 provider is exempted as provided by Subsection (c).
4848 (c) A health care provider is exempt from the Medicare
4949 provider certification or enrollment requirement under Subsection
5050 (b) if:
5151 (1) the provider's type of practice or health care
5252 services offered are not covered by Medicare;
5353 (2) the provider's exclusion from child health plan
5454 program participation on the basis of the lack of Medicare
5555 certification or enrollment will restrict an enrollee's access to
5656 necessary health care services; or
5757 (3) a commission or other state agency rule expressly
5858 exempts the provider from the Medicare certification or enrollment
5959 requirement.
6060 SECTION 3. If before implementing any provision of this Act
6161 a state agency determines that a waiver or authorization from a
6262 federal agency is necessary for implementation of that provision,
6363 the agency affected by the provision shall request the waiver or
6464 authorization and may delay implementing that provision until the
6565 waiver or authorization is granted.
6666 SECTION 4. This Act takes effect September 1, 2025.
