77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting transporting or funding the transportation
1010 of an unemancipated minor for an abortion; providing a civil
1111 penalty; creating a criminal offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1414 amended by adding Chapter 170B to read as follows:
1515 CHAPTER 170B. TRANSPORTING A MINOR FOR AN ABORTION
1616 Sec. 170B.001. DEFINITIONS. In this chapter:
1717 (1) "Abortion" has the meaning assigned by Section
1818 245.002(1).
1919 (2) "Unborn child" has the meaning assigned by Section
2020 170A.001(5).
2121 (3) "Unemancipated minor" includes a minor who:
2222 (A) is unmarried; and
2323 (B) has not had the disabilities of minority
2424 removed under Chapter 31, Family Code.
2525 Sec. 170B.002. PROHIBITED TRANSPORTATION; EXCEPTIONS. (a)
2626 No person shall knowingly transport or fund the transportation of
2727 an unemancipated minor from Texas and into another state or country
2828 for the purpose of the minor obtaining an abortion without the
2929 written consent of a parent of the unemancipated minor or a person
3030 lawfully standing in the position of a parent of the unemancipated
3131 minor.
3232 (b) The prohibition under Subsection (a) does not apply to
3333 an abortion performed or induced under the exceptions described in
3434 Section 170A.002(b), (c), and (d), Health and Safety Code.
3535 Sec. 170B.003. CONSTRUCTION OF CHAPTER. This chapter may
3636 not be construed to authorize the imposition of criminal, civil, or
3737 administrative liability or penalties on an unemancipated minor.
3838 Sec. 170B.004. CRIMINAL OFFENSE. (a) A person who violates
3939 Section 170B.002 commits an offense.
4040 (b) An offense under this section is a felony of the second
4141 degree, except that the offense is a felony of the first degree if
4242 the unborn child dies as a result of an abortion that occurred in a
4343 state or country that the unemancipated was transported to in
4444 violation of Section 170B.002.
4545 Sec. 170B.005. CIVIL PENALTY. A person who violates
4646 Section 170B.002 is subject to a civil penalty of not less than
4747 $100,000 for each violation. The attorney general shall file an
4848 action to recover a civil penalty assessed under this section and
4949 may recover attorney's fees and costs incurred in bringing the
5050 action.
5151 Sec. 170B.006. CIVIL REMEDIES UNAFFECTED. The fact that
5252 conduct is subject to a civil or criminal penalty under this chapter
5353 does not abolish or impair any remedy for the conduct that is
5454 available in a civil suit.
5555 Sec. 170B.007. DISCIPLINARY ACTION. In addition to any
5656 other penalty that may be imposed under this chapter, the
5757 appropriate licensing authority shall revoke the license, permit,
5858 registration, certificate, or other authority of a physician or
5959 other health care professional who transports or funds the
6060 transportation of an unemancipated minor in violation of Section
6161 170B.002.
6262 SECTION 2. The provisions of this Act are hereby declared
6363 severable, and if any provision of this Act or the application of
6464 such provision to any person or circumstance is declared invalid
6565 for any reason, such declaration shall not affect the validity of
6666 the remaining portions of this Act.
6767 SECTION 3. The change in law made by this Act applies only
6868 to an abortion performed or induced on or after the effective date
6969 of this Act.
7070 SECTION 4. This Act takes effect September 1, 2025.
