712 AN ACT
813 relating to the transfer of the University of Houston--Victoria to
914 The Texas A&M University System.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. AMENDMENT. Chapter 87, Education Code, is
1217 amended by adding Subchapter M to read as follows:
1318 SUBCHAPTER M. TEXAS A&M UNIVERSITY--VICTORIA
1419 Sec. 87.881. ESTABLISHMENT; SCOPE. (a) Texas A&M
1520 University--Victoria is a general academic teaching institution
1621 located in the city of Victoria.
1722 (b) The university is a component institution of The Texas
1823 A&M University System and is under the management and control of the
1924 board of regents of The Texas A&M University System. The board of
2025 regents has the same powers and duties concerning Texas A&M
2126 University--Victoria as are conferred on the board by statute
2227 concerning Texas A&M University.
2328 Sec. 87.882. COURSES AND DEGREES; ADMINISTRATION. (a) The
2429 university shall offer undergraduate- and graduate-level programs.
2530 (b) The board of regents may prescribe courses leading to
2631 appropriate degrees and adopt other rules necessary for the
2732 operation and management of the university.
2833 (c) The university is subject to the authority of the Texas
2934 Higher Education Coordinating Board.
3035 Sec. 87.883. GIFTS AND GRANTS. The board of regents may
3136 solicit, accept, and administer gifts and grants for the use and
3237 benefit of the university.
3338 SECTION 2. TRANSFER OF GOVERNANCE OF UNIVERSITY. The
3439 governance, control, management, and property of the University of
3540 Houston--Victoria are transferred from the board of regents of the
3641 University of Houston System to the board of regents of The Texas
3742 A&M University System. The transfer is governed by Sections 3
3843 through 8 of this Act.
3944 SECTION 3. POWERS AND DUTIES; RULES AND POLICIES. (a) When
4045 the transfer takes effect, the board of regents of The Texas A&M
4146 University System shall govern, operate, manage, and control the
4247 University of Houston--Victoria and all land, buildings,
4348 facilities, improvements, equipment, supplies, and property
4449 belonging to and constituting the University of Houston--Victoria
4550 under the powers and duties conferred by law on the board of
4651 regents.
4752 (b) Rules and policies adopted by the board of regents of
4853 the University of Houston System to govern the university that are
4954 in effect when the transfer takes effect are continued in effect
5055 until adopted, repealed, or superseded by the board of regents of
5156 The Texas A&M University System. The board of regents of The Texas
5257 A&M University System may adopt rules and policies applicable to
5358 the university in anticipation of the transfer authorized by this
5459 Act.
5560 SECTION 4. CONTRACTS AND WRITTEN OBLIGATIONS, INCLUDING
5661 BONDS. Contracts and written obligations of every kind and
5762 character entered into by the board of regents of the University of
5863 Houston System for and on behalf of the University of
5964 Houston--Victoria, including bonds, are considered ratified,
6065 confirmed, and validated by the board of regents of The Texas A&M
6166 University System on the effective date of the transfer. In those
6267 contracts and written obligations, the board of regents of The
6368 Texas A&M University System is substituted for and stands and acts
6469 in the place of the board of regents of the University of Houston
6570 System to the extent permitted by law.
6671 SECTION 5. TUITION AND FEES. The tuition and fees
6772 authorized by the board of regents of the University of Houston
6873 System before the transfer of governance under this Act remain in
6974 effect until the board of regents of The Texas A&M University System
7075 authorizes a different amount of tuition and fees for the
7176 university as provided by law.
7277 SECTION 6. EFFECT OF TRANSFER ON STUDENTS AND EMPLOYEES.
7378 (a) All students of the University of Houston--Victoria shall be
7479 considered students of Texas A&M University--Victoria on the
7580 effective date of this Act. The transfer of the governance of the
7681 University of Houston--Victoria under this Act does not otherwise
7782 affect the status of any student of the university.
7883 (b) All employees of the University of Houston--Victoria
7984 shall be considered employees of Texas A&M University--Victoria on
8085 the effective date of this Act. The transfer of the governance of
8186 the University of Houston--Victoria under this Act does not
8287 otherwise affect the employment status or accrued benefits of a
8388 person employed by the university when the transfer takes effect.
8489 SECTION 7. GROUP BENEFITS. (a) A person who is a
8590 participant or is eligible to participate in a group benefits
8691 insurance program of the University of Houston--Victoria under
8792 Chapter 1551, Insurance Code, or who would be eligible to
8893 participate at a future date as a retiree, on the date the transfer
8994 takes effect, as authorized by this Act, is eligible to participate
9095 in the uniform insurance benefits under Chapter 1601, Insurance
9196 Code, as an employee, current retiree, or vested former employee of
9297 Texas A&M University--Victoria, or as a dependent or surviving
9398 dependent, as if all benefits-eligible service credit had been
9499 earned in a benefits-eligible position at Texas A&M
95100 University--Victoria. A person who is eligible under this
96101 subsection for the uniform insurance benefits under Chapter 1601,
97102 Insurance Code, is not eligible to participate in a group benefits
98103 insurance program under Chapter 1551, Insurance Code.
99104 (b) The Employees Retirement System of Texas, Texas A&M
100105 University--Victoria, and The Texas A&M University System shall
101106 take all actions necessary to implement Subsection (a) of this
102107 section. For that purpose:
103108 (1) the Employees Retirement System of Texas shall
104- provide to The Texas A&M University System and the University of
105- Houston System, as applicable, the information, including
106- protected health information to the extent authorized by law,
107- necessary for payment activities and plan operations, including
108- health plan operations, of the uniform insurance benefits under
109- Chapter 1601, Insurance Code; and
109+ provide to The Texas A&M University System the information,
110+ including protected health information to the extent authorized by
111+ law, necessary for payment activities and plan operations,
112+ including health plan operations, of the uniform insurance benefits
113+ under Chapter 1601, Insurance Code;
110114 (2) Texas A&M University--Victoria and The Texas A&M
111115 University System shall ensure that the Employees Retirement System
112116 of Texas receives full contributions for each month in which
113117 employees, retirees, and dependents of Texas A&M
114118 University--Victoria are covered by the group benefits insurance
115- program under Chapter 1551, Insurance Code.
119+ program under Chapter 1551, Insurance Code; and
120+ (3) the Employees Retirement System of Texas shall
121+ transfer any funds designated for higher education employees,
122+ retirees, and dependents under Chapter 1551, Insurance Code, for
123+ the purpose of providing group benefits coverage for the employees,
124+ retirees, and dependents of the University of Houston--Victoria who
125+ will become employees, retirees, and dependents of Texas A&M
126+ University--Victoria to The Texas A&M University System upon the
127+ effective date of this Act.
116128 SECTION 8. CURRENT FUNDING. All funds that, on the
117129 effective date of the transfer, have been appropriated or dedicated
118130 to or are held for the use and benefit of the University of
119131 Houston--Victoria under the governance of the board of regents of
120132 the University of Houston System are transferred to the board of
121133 regents of The Texas A&M University System for the use and benefit
122134 of Texas A&M University--Victoria.
123- SECTION 9. AMENDMENT. Section 11.179(a), Education Code,
124- is amended to read as follows:
125- (a) The board of trustees of a school district may adopt a
126- policy allowing the consumption, possession, and sale of an
127- alcoholic beverage at an event held at a performing arts facility
128- owned by the district if:
129- (1) the facility is leased to a nonprofit organization
130- for an event not sponsored or sanctioned by the district; and
131- (2) either the board of trustees of the district had
132- authority to adopt a policy under this section on or before January
133- 1, 2025, or the district is located in:
134- (A) a county:
135- (i) that has a population of not more than
136- 300,000; and
137- (ii) in which a component university of the
138- University of Houston System is located; or
139- (B) a county in which is located a facility
140- described by Subdivision (1) within two miles of two or more
141- stadiums with a capacity of at least 40,000 people.
142- SECTION 10. AMENDMENT. The heading to Section 54.5405,

148141 (a) The board of regents of The Texas A&M [the] University
149142 [of Houston] System may impose on each student enrolled at Texas A&M
150143 University--Victoria [the University of Houston-Victoria] a
151144 student center fee to be used only for the purpose of financing,
152145 constructing, operating, maintaining, improving, and equipping a
153146 student center at the university. A fee imposed under this section
154147 is in addition to any use or service fee authorized to be imposed
155148 under other law.
156149 (d) Revenue from a fee imposed under this section shall be
157150 deposited to the credit of an account known as the "Texas A&M
158151 University--Victoria [University of Houston-Victoria] Student
159152 Center Fee Account" under the control of the university's student
160153 fee advisory committee. Annually, the committee shall submit to
161154 the president of the university its recommendation for any change
162155 to the amount of the fee and a complete and itemized budget for the
163156 student center together with a complete report of all student
164157 center activities conducted during the past year and all
165158 expenditures made in connection with those activities. The
166159 president shall submit the budget to the board of regents as part of
167160 the university's institutional budget. The board of regents may
168161 make changes in the budget that the board determines are necessary.
169- SECTION 12. AMENDMENT. The heading to Section 54.5406,

179172 financing, constructing, operating, maintaining, improving, and
180173 equipping a health and wellness center at Texas A&M
181174 University--Victoria [the University of Houston-Victoria]. A fee
182175 charged under this section is in addition to any use or service fee
183176 authorized to be charged under other law.
184177 (d) Revenue from a fee charged under this section shall be
185178 deposited to the credit of an account known as the Texas A&M
186179 University--Victoria [University of Houston-Victoria] Health and
187180 Wellness Center Fee Account under the control of the university's
188181 student fee advisory committee. Annually, the committee shall
189182 submit to the president of the university its recommendation for
190183 any change to the amount of the fee and a complete and itemized
191184 budget for the health and wellness center together with a complete
192185 report of all health and wellness center activities conducted
193186 during the past year and all expenditures made in connection with
194187 those activities. The president shall submit the budget to the
195188 board of regents as part of the university's institutional
196189 budget. The board of regents may make changes in the budget that
197190 the board determines are necessary.
198- SECTION 14. AMENDMENT. Section 55.1723(a), Education Code,

205198 be financed by the issuance of bonds in accordance with this
206199 subchapter and in accordance with a systemwide revenue financing
207200 program adopted by the board in an aggregate principal amount not to
208201 exceed the following amounts:
209202 (1) the University of Houston, $12 million; and
210203 (2) the University of Houston--Downtown, $7.5
211204 million[; and
212205 [(3) the University of Houston--Victoria, $10
213206 million].
214- SECTION 15. AMENDMENT. Section 55.1733(a), Education Code,

216209 (a) In addition to the other authority granted by this
217210 subchapter, the board of regents of the University of Houston
218211 System may issue in accordance with this subchapter and in

220213 the board bonds for the following institutions not to exceed the
221214 following aggregate principal amounts to finance projects
222215 specified as follows:
223216 (1) the University of Houston, $51 million to
224217 construct science and engineering research and classroom
225218 facilities;
226219 (2) the University of Houston--Downtown, $18,232,500
227220 to construct a classroom building; and
228221 (3) the University of Houston--Clear Lake,
229222 $30,918,750 to construct a student services and classroom
230223 building[; and
231224 [(4) the University of Houston--Victoria, $2,805,000
232225 to remodel the University West facility, acquire and renovate a
233226 facility services building, and renovate and expand a facility for
234227 the center for community initiatives].
235- SECTION 16. AMENDMENT. Section 55.1753(a), Education Code,

242235 through the issuance of bonds in accordance with this subchapter

246239 (1) the University of Houston, $57,600,000 for
247240 renovation of science laboratories;
248241 (2) the University of Houston--Clear Lake,
249242 $10,604,808 for Arbor Building renovations and additions; and
250243 (3) the University of Houston--Downtown, $31,626,000
251244 for a classroom building at Shea Street[; and
252245 [(4) the University of Houston--Victoria:
253246 [(A) $22,900,000 for an academic building at the
254247 University of Houston System Center at Sugar Land;
255248 [(B) $6,719,400 for regional economic
256249 development; and
257250 [(C) $1,800,000 for allied health facilities].
258- SECTION 17. AMENDMENT. Section 55.1783(a), Education Code,

271264 (A) $63 million for construction of a health and

274267 academic building located in Sugar Land, Texas;

276269 (A) $24,624,000 for construction of a health
277270 sciences and classroom building located in Pearland, Texas; and
278271 (B) $54 million for construction of a STEM and
279272 classroom building;
280273 (3) the University of Houston--Downtown, $60 million
281274 for construction of a science and technology building;
282275 [(4) the University of Houston--Victoria, $60 million
283276 for academic expansion and land acquisition;] and
284277 (4) [(5)] the University of Houston System,
285278 $46,832,000 for land acquisition for construction of a building in
286279 the area near Katy, Texas.

318- SECTION 19. AMENDMENT. Subchapter B, Chapter 55, Education
311+ SECTION 18. AMENDMENT. Subchapter B, Chapter 55, Education
319312 Code, is amended by adding Section 55.17812 to read as follows:
320313 Sec. 55.17812. TEXAS A&M UNIVERSITY--VICTORIA. (a) In
321314 addition to the other authority granted by this subchapter, the
322315 board of regents of The Texas A&M University System may issue bonds
323316 in accordance with this subchapter and in accordance with a
324317 systemwide revenue financing program adopted by the board in the
325318 aggregate principal amounts not to exceed the amounts previously
326319 authorized for the University of Houston--Victoria by Sections
327320 55.1723, 55.173, 55.1733, 55.1753, 55.1783, and 55.1793, as those
328321 sections existed immediately before this section took effect, less
329322 any portion of those amounts for which bonds were issued under those
330323 sections for the university before the date this section took
331324 effect. Subject to Subsection (d), bonds issued under this section
332325 for an amount previously authorized by Section 55.1723, 55.173,
333326 55.1733, 55.1753, 55.1783, or 55.1793 may be used only at Texas A&M
334327 University--Victoria for the purposes for which the bonds for the
335328 University of Houston--Victoria were authorized to be issued under
336329 Section 55.1723, 55.173, 55.1733, 55.1753, 55.1783, or 55.1793, as
337330 applicable.
338331 (b) The board may pledge irrevocably to the payment of those
339332 bonds all or any part of the revenue funds of an institution,
340333 branch, or entity of The Texas A&M University System, including
341334 student tuition charges. The amount of a pledge made under this
342335 subsection may not be reduced or abrogated while the bonds for which
343336 the pledge is made, or bonds issued to refund those bonds, are
344337 outstanding.
345338 (c) If sufficient funds are not available to the board to
346339 meet its obligations under this section, the board may transfer
347340 funds among institutions, branches, and entities of The Texas A&M
348341 University System to ensure the most equitable and efficient
349342 allocation of available resources for each institution, branch, or
350343 entity to carry out its duties and purposes.
351344 (d) Any portion of the proceeds of bonds authorized by this
352345 section for one or more specified projects that is not required for
353346 the specified projects may be used to renovate existing structures
354347 and facilities at the university.
355- SECTION 20. AMENDMENT. Section 62.021(a), Education Code,

357350 (a) In each state fiscal year beginning with the state
358351 fiscal year ending August 31, 2021, an eligible institution is
359352 entitled to receive an amount allocated in accordance with this
360353 section from the funds appropriated for that year by Section 17(a),
361354 Article VII, Texas Constitution. The comptroller shall distribute
362355 funds allocated under this subsection only on presentation of a
363356 claim and issuance of a warrant in accordance with Section 403.071,
364357 Government Code. An eligible institution may not present a claim to
365358 be paid from any funds allocated under this subsection before the
366359 delivery of goods or services described in Section 17, Article VII,
367360 Texas Constitution, except for the payment of principal or interest
368361 on bonds or notes or for a payment for a book or other published
369362 library material as authorized by Section 2155.386, Government
370363 Code. The allocation of funds under this subsection is made in
371364 accordance with an equitable formula consisting of the following
372365 elements: space deficit, facilities condition, institutional
373366 complexity, and a separate allocation for the Texas State Technical
374367 College System. The annual amounts allocated by the formula are as
375368 follows:
376369 (1) to the following component institutions of the
377370 University of North Texas System:
378371 (A) $38,473,304 to the University of North Texas;
379372 (B) $15,581,837 to the University of North Texas
380373 Health Science Center at Fort Worth; and
381374 (C) $3,455,644 to the University of North Texas
382375 at Dallas;
383376 (2) to the following component institutions of the
384377 Texas State University System:
385378 (A) $13,537,649 to Lamar University;
386379 (B) $2,630,158 to the Lamar Institute of
387380 Technology;
388381 (C) $1,533,301 to Lamar State College--Orange;
389382 (D) $2,283,992 to Lamar State College--Port
390383 Arthur;
391384 (E) $18,787,013 to Sam Houston State University;
392385 (F) $38,741,061 to Texas State University;
393386 (G) $2,216,640 to Sul Ross State University; and
394387 (H) $487,157 to Sul Ross State University-Rio

449442 of regents of The Texas A&M University System shall enter into a
450443 memorandum of understanding relating to the transfer of the
451444 administration of the University of Houston--Victoria to The Texas
452445 A&M University System as provided by this Act. The memorandum of
453446 understanding must include a transition plan with a timetable and
454447 specific steps, including the methods for the transfer on September
455448 1, 2025, of all powers, duties, obligations, rights, contracts,
456449 leases, records, real or personal property, and unspent and
457450 unobligated appropriations and other funds of the University of
458451 Houston--Victoria to The Texas A&M University System.
459- SECTION 23. EFFECTIVE DATE. (a) Except as provided by
460- Subsection (b) of this section, this Act takes effect September 1,
461- 2025.
462- (b) Section 7(b)(1) of this Act takes effect immediately if
463- this Act receives a vote of two-thirds of all the members elected to
464- each house, as provided by Section 39, Article III, Texas
465- Constitution. If this Act does not receive the vote necessary for
466- immediate effect, the entirety of this Act takes effect September
467- 1, 2025.
