23 | 28 | | Sec. 87.882. COURSES AND DEGREES; ADMINISTRATION. (a) The |

24 | 29 | | university shall offer undergraduate- and graduate-level programs. |
---|
25 | 30 | | (b) The board of regents may prescribe courses leading to |
---|
26 | 31 | | appropriate degrees and adopt other rules necessary for the |
---|
27 | 32 | | operation and management of the university. |
---|
28 | 33 | | (c) The university is subject to the authority of the Texas |
---|
29 | 34 | | Higher Education Coordinating Board. |
---|
30 | 35 | | Sec. 87.883. GIFTS AND GRANTS. The board of regents may |
---|
31 | 36 | | solicit, accept, and administer gifts and grants for the use and |
---|
32 | 37 | | benefit of the university. |
---|
33 | 38 | | SECTION 2. TRANSFER OF GOVERNANCE OF UNIVERSITY. The |
---|
34 | 39 | | governance, control, management, and property of the University of |
---|
35 | 40 | | Houston--Victoria are transferred from the board of regents of the |
---|
36 | 41 | | University of Houston System to the board of regents of The Texas |
---|
37 | 42 | | A&M University System. The transfer is governed by Sections 3 |
---|
38 | 43 | | through 8 of this Act. |
---|
39 | 44 | | SECTION 3. POWERS AND DUTIES; RULES AND POLICIES. (a) When |
---|
40 | 45 | | the transfer takes effect, the board of regents of The Texas A&M |
---|
41 | 46 | | University System shall govern, operate, manage, and control the |
---|
42 | 47 | | University of Houston--Victoria and all land, buildings, |
---|
43 | 48 | | facilities, improvements, equipment, supplies, and property |
---|
44 | 49 | | belonging to and constituting the University of Houston--Victoria |
---|
45 | 50 | | under the powers and duties conferred by law on the board of |
---|
46 | 51 | | regents. |
---|
47 | 52 | | (b) Rules and policies adopted by the board of regents of |
---|
48 | 53 | | the University of Houston System to govern the university that are |
---|
49 | 54 | | in effect when the transfer takes effect are continued in effect |
---|
50 | 55 | | until adopted, repealed, or superseded by the board of regents of |
---|
51 | 56 | | The Texas A&M University System. The board of regents of The Texas |
---|
52 | 57 | | A&M University System may adopt rules and policies applicable to |
---|
53 | 58 | | the university in anticipation of the transfer authorized by this |
---|
54 | 59 | | Act. |
---|
55 | 60 | | SECTION 4. CONTRACTS AND WRITTEN OBLIGATIONS, INCLUDING |
---|
56 | 61 | | BONDS. Contracts and written obligations of every kind and |
---|
57 | 62 | | character entered into by the board of regents of the University of |
---|
58 | 63 | | Houston System for and on behalf of the University of |
---|
59 | 64 | | Houston--Victoria, including bonds, are considered ratified, |
---|
60 | 65 | | confirmed, and validated by the board of regents of The Texas A&M |
---|
61 | 66 | | University System on the effective date of the transfer. In those |
---|
62 | 67 | | contracts and written obligations, the board of regents of The |
---|
63 | 68 | | Texas A&M University System is substituted for and stands and acts |
---|
64 | 69 | | in the place of the board of regents of the University of Houston |
---|
65 | 70 | | System to the extent permitted by law. |
---|
66 | 71 | | SECTION 5. TUITION AND FEES. The tuition and fees |
---|
67 | 72 | | authorized by the board of regents of the University of Houston |
---|
68 | 73 | | System before the transfer of governance under this Act remain in |
---|
69 | 74 | | effect until the board of regents of The Texas A&M University System |
---|
70 | 75 | | authorizes a different amount of tuition and fees for the |
---|
71 | 76 | | university as provided by law. |
---|
72 | 77 | | SECTION 6. EFFECT OF TRANSFER ON STUDENTS AND EMPLOYEES. |
---|
73 | 78 | | (a) All students of the University of Houston--Victoria shall be |
---|
74 | 79 | | considered students of Texas A&M University--Victoria on the |
---|
75 | 80 | | effective date of this Act. The transfer of the governance of the |
---|
76 | 81 | | University of Houston--Victoria under this Act does not otherwise |
---|
77 | 82 | | affect the status of any student of the university. |
---|
78 | 83 | | (b) All employees of the University of Houston--Victoria |
---|
79 | 84 | | shall be considered employees of Texas A&M University--Victoria on |
---|
80 | 85 | | the effective date of this Act. The transfer of the governance of |
---|
81 | 86 | | the University of Houston--Victoria under this Act does not |
---|
82 | 87 | | otherwise affect the employment status or accrued benefits of a |
---|
83 | 88 | | person employed by the university when the transfer takes effect. |
---|
84 | 89 | | SECTION 7. GROUP BENEFITS. (a) A person who is a |
---|
85 | 90 | | participant or is eligible to participate in a group benefits |
---|
86 | 91 | | insurance program of the University of Houston--Victoria under |
---|
87 | 92 | | Chapter 1551, Insurance Code, or who would be eligible to |
---|
88 | 93 | | participate at a future date as a retiree, on the date the transfer |
---|
89 | 94 | | takes effect, as authorized by this Act, is eligible to participate |
---|
90 | 95 | | in the uniform insurance benefits under Chapter 1601, Insurance |
---|
91 | 96 | | Code, as an employee, current retiree, or vested former employee of |
---|
92 | 97 | | Texas A&M University--Victoria, or as a dependent or surviving |
---|
93 | 98 | | dependent, as if all benefits-eligible service credit had been |
---|
94 | 99 | | earned in a benefits-eligible position at Texas A&M |
---|
95 | 100 | | University--Victoria. A person who is eligible under this |
---|
96 | 101 | | subsection for the uniform insurance benefits under Chapter 1601, |
---|
97 | 102 | | Insurance Code, is not eligible to participate in a group benefits |
---|
98 | 103 | | insurance program under Chapter 1551, Insurance Code. |
---|
99 | 104 | | (b) The Employees Retirement System of Texas, Texas A&M |
---|
100 | 105 | | University--Victoria, and The Texas A&M University System shall |
---|
101 | 106 | | take all actions necessary to implement Subsection (a) of this |
---|
102 | 107 | | section. For that purpose: |

103 | 108 | | (1) the Employees Retirement System of Texas shall |

---|
140 | | - | described by Subdivision (1) within two miles of two or more |
---|
141 | | - | stadiums with a capacity of at least 40,000 people. |
---|
142 | | - | SECTION 10. AMENDMENT. The heading to Section 54.5405, |

341 | 334 | | student tuition charges. The amount of a pledge made under this |
---|
342 | 335 | | subsection may not be reduced or abrogated while the bonds for which |
---|
343 | 336 | | the pledge is made, or bonds issued to refund those bonds, are |
---|

345 | 338 | | (c) If sufficient funds are not available to the board to |
---|
346 | 339 | | meet its obligations under this section, the board may transfer |
---|
347 | 340 | | funds among institutions, branches, and entities of The Texas A&M |
---|
348 | 341 | | University System to ensure the most equitable and efficient |
---|
349 | 342 | | allocation of available resources for each institution, branch, or |
---|
350 | 343 | | entity to carry out its duties and purposes. |
---|
351 | 344 | | (d) Any portion of the proceeds of bonds authorized by this |
---|
352 | 345 | | section for one or more specified projects that is not required for |
---|
353 | 346 | | the specified projects may be used to renovate existing structures |
---|
354 | 347 | | and facilities at the university. |
---|

357 | 350 | | (a) In each state fiscal year beginning with the state |

358 | 351 | | fiscal year ending August 31, 2021, an eligible institution is |
