7	12		AN ACT
8	13		relating to the transfer of the University of Houston--Victoria to
9	14		The Texas A&M University System.
10	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	16		SECTION 1. AMENDMENT. Chapter 87, Education Code, is
12	17		amended by adding Subchapter M to read as follows:
13	18		SUBCHAPTER M. TEXAS A&M UNIVERSITY--VICTORIA
14	19		Sec. 87.881. ESTABLISHMENT; SCOPE. (a) Texas A&M
15	20		University--Victoria is a general academic teaching institution
16	21		located in the city of Victoria.
17	22		(b) The university is a component institution of The Texas
18	23		A&M University System and is under the management and control of the
19	24		board of regents of The Texas A&M University System. The board of
20	25		regents has the same powers and duties concerning Texas A&M
21	26		University--Victoria as are conferred on the board by statute
22	27		concerning Texas A&M University.
23	28		Sec. 87.882. COURSES AND DEGREES; ADMINISTRATION. (a) The
24	29		university shall offer undergraduate- and graduate-level programs.
25	30		(b) The board of regents may prescribe courses leading to
26	31		appropriate degrees and adopt other rules necessary for the
27	32		operation and management of the university.
28	33		(c) The university is subject to the authority of the Texas
29	34		Higher Education Coordinating Board.
30	35		Sec. 87.883. GIFTS AND GRANTS. The board of regents may
31	36		solicit, accept, and administer gifts and grants for the use and
32	37		benefit of the university.
33	38		SECTION 2. TRANSFER OF GOVERNANCE OF UNIVERSITY. The
34	39		governance, control, management, and property of the University of
35	40		Houston--Victoria are transferred from the board of regents of the
36	41		University of Houston System to the board of regents of The Texas
37	42		A&M University System. The transfer is governed by Sections 3
38	43		through 8 of this Act.
39	44		SECTION 3. POWERS AND DUTIES; RULES AND POLICIES. (a) When
40	45		the transfer takes effect, the board of regents of The Texas A&M
41	46		University System shall govern, operate, manage, and control the
42	47		University of Houston--Victoria and all land, buildings,
43	48		facilities, improvements, equipment, supplies, and property
44	49		belonging to and constituting the University of Houston--Victoria
45	50		under the powers and duties conferred by law on the board of
46	51		regents.
47	52		(b) Rules and policies adopted by the board of regents of
48	53		the University of Houston System to govern the university that are
49	54		in effect when the transfer takes effect are continued in effect
50	55		until adopted, repealed, or superseded by the board of regents of
51	56		The Texas A&M University System. The board of regents of The Texas
52	57		A&M University System may adopt rules and policies applicable to
53	58		the university in anticipation of the transfer authorized by this
54	59		Act.
55	60		SECTION 4. CONTRACTS AND WRITTEN OBLIGATIONS, INCLUDING
56	61		BONDS. Contracts and written obligations of every kind and
57	62		character entered into by the board of regents of the University of
58	63		Houston System for and on behalf of the University of
59	64		Houston--Victoria, including bonds, are considered ratified,
60	65		confirmed, and validated by the board of regents of The Texas A&M
61	66		University System on the effective date of the transfer. In those
62	67		contracts and written obligations, the board of regents of The
63	68		Texas A&M University System is substituted for and stands and acts
64	69		in the place of the board of regents of the University of Houston
65	70		System to the extent permitted by law.
66	71		SECTION 5. TUITION AND FEES. The tuition and fees
67	72		authorized by the board of regents of the University of Houston
68	73		System before the transfer of governance under this Act remain in
69	74		effect until the board of regents of The Texas A&M University System
70	75		authorizes a different amount of tuition and fees for the
71	76		university as provided by law.
72	77		SECTION 6. EFFECT OF TRANSFER ON STUDENTS AND EMPLOYEES.
73	78		(a) All students of the University of Houston--Victoria shall be
74	79		considered students of Texas A&M University--Victoria on the
75	80		effective date of this Act. The transfer of the governance of the
76	81		University of Houston--Victoria under this Act does not otherwise
77	82		affect the status of any student of the university.
78	83		(b) All employees of the University of Houston--Victoria
79	84		shall be considered employees of Texas A&M University--Victoria on
80	85		the effective date of this Act. The transfer of the governance of
81	86		the University of Houston--Victoria under this Act does not
82	87		otherwise affect the employment status or accrued benefits of a
83	88		person employed by the university when the transfer takes effect.
84	89		SECTION 7. GROUP BENEFITS. (a) A person who is a
85	90		participant or is eligible to participate in a group benefits
86	91		insurance program of the University of Houston--Victoria under
87	92		Chapter 1551, Insurance Code, or who would be eligible to
88	93		participate at a future date as a retiree, on the date the transfer
89	94		takes effect, as authorized by this Act, is eligible to participate
90	95		in the uniform insurance benefits under Chapter 1601, Insurance
91	96		Code, as an employee, current retiree, or vested former employee of
92	97		Texas A&M University--Victoria, or as a dependent or surviving
93	98		dependent, as if all benefits-eligible service credit had been
94	99		earned in a benefits-eligible position at Texas A&M
95	100		University--Victoria. A person who is eligible under this
96	101		subsection for the uniform insurance benefits under Chapter 1601,
97	102		Insurance Code, is not eligible to participate in a group benefits
98	103		insurance program under Chapter 1551, Insurance Code.
99	104		(b) The Employees Retirement System of Texas, Texas A&M
100	105		University--Victoria, and The Texas A&M University System shall
101	106		take all actions necessary to implement Subsection (a) of this
102	107		section. For that purpose:
103	108		(1) the Employees Retirement System of Texas shall
104		-	provide to The Texas A&M University System and the University of
105		-	Houston System, as applicable, the information, including
106		-	protected health information to the extent authorized by law,
107		-	necessary for payment activities and plan operations, including
108		-	health plan operations, of the uniform insurance benefits under
109		-	Chapter 1601, Insurance Code; and
	109	+	provide to The Texas A&M University System the information,
	110	+	including protected health information to the extent authorized by
	111	+	law, necessary for payment activities and plan operations,
	112	+	including health plan operations, of the uniform insurance benefits
	113	+	under Chapter 1601, Insurance Code;
110	114		(2) Texas A&M University--Victoria and The Texas A&M
111	115		University System shall ensure that the Employees Retirement System
112	116		of Texas receives full contributions for each month in which
113	117		employees, retirees, and dependents of Texas A&M
114	118		University--Victoria are covered by the group benefits insurance
115		-	program under Chapter 1551, Insurance Code.

	120	+	(3) the Employees Retirement System of Texas shall
	121	+	transfer any funds designated for higher education employees,
	122	+	retirees, and dependents under Chapter 1551, Insurance Code, for
	123	+	the purpose of providing group benefits coverage for the employees,
	124	+	retirees, and dependents of the University of Houston--Victoria who
	125	+	will become employees, retirees, and dependents of Texas A&M
	126	+	University--Victoria to The Texas A&M University System upon the
	127	+	effective date of this Act.
116	128		SECTION 8. CURRENT FUNDING. All funds that, on the
117	129		effective date of the transfer, have been appropriated or dedicated
118	130		to or are held for the use and benefit of the University of
119	131		Houston--Victoria under the governance of the board of regents of
120	132		the University of Houston System are transferred to the board of
121	133		regents of The Texas A&M University System for the use and benefit
122	134		of Texas A&M University--Victoria.
123		-	SECTION 9. AMENDMENT. Section 11.179(a), Education Code,
124		-	is amended to read as follows:
125		-	(a) The board of trustees of a school district may adopt a
126		-	policy allowing the consumption, possession, and sale of an
127		-	alcoholic beverage at an event held at a performing arts facility
128		-	owned by the district if:
129		-	(1) the facility is leased to a nonprofit organization
130		-	for an event not sponsored or sanctioned by the district; and
131		-	(2) either the board of trustees of the district had
132		-	authority to adopt a policy under this section on or before January
133		-	1, 2025, or the district is located in:
134		-	(A) a county:
135		-	(i) that has a population of not more than
136		-	300,000; and
137		-	(ii) in which a component university of the
138		-	University of Houston System is located; or
139		-	(B) a county in which is located a facility
140		-	described by Subdivision (1) within two miles of two or more
141		-	stadiums with a capacity of at least 40,000 people.
142		-	SECTION 10. AMENDMENT. The heading to Section 54.5405,

144	137		Sec. 54.5405. STUDENT CENTER FEE; TEXAS A&M

148	141		(a) The board of regents of The Texas A&M [the] University
149	142		[of Houston] System may impose on each student enrolled at Texas A&M
150	143		University--Victoria [the University of Houston-Victoria] a
151	144		student center fee to be used only for the purpose of financing,
152	145		constructing, operating, maintaining, improving, and equipping a
153	146		student center at the university. A fee imposed under this section
154	147		is in addition to any use or service fee authorized to be imposed
155	148		under other law.
156	149		(d) Revenue from a fee imposed under this section shall be
157	150		deposited to the credit of an account known as the "Texas A&M
158	151		University--Victoria [University of Houston-Victoria] Student
159	152		Center Fee Account" under the control of the university's student
160	153		fee advisory committee. Annually, the committee shall submit to
161	154		the president of the university its recommendation for any change
162	155		to the amount of the fee and a complete and itemized budget for the
163	156		student center together with a complete report of all student
164	157		center activities conducted during the past year and all
165	158		expenditures made in connection with those activities. The
166	159		president shall submit the budget to the board of regents as part of
167	160		the university's institutional budget. The board of regents may
168	161		make changes in the budget that the board determines are necessary.
169		-	SECTION 12. AMENDMENT. The heading to Section 54.5406,

171	164		Sec. 54.5406. HEALTH AND WELLNESS CENTER FEE; TEXAS A&M

173		-	SECTION 13. AMENDMENT. Sections 54.5406(a) and (d),

174	167		Education Code, are amended to read as follows:
175	168		(a) The board of regents of The Texas A&M [the] University
176	169		[of Houston] System may charge each student enrolled at Texas A&M
177	170		University--Victoria [the University of Houston-Victoria] a health
178	171		and wellness center fee. The fee may be used only for the purpose of
179	172		financing, constructing, operating, maintaining, improving, and
180	173		equipping a health and wellness center at Texas A&M
181	174		University--Victoria [the University of Houston-Victoria]. A fee
182	175		charged under this section is in addition to any use or service fee
183	176		authorized to be charged under other law.

198		-	SECTION 14. AMENDMENT. Section 55.1723(a), Education Code,

200	193		(a) In addition to the other authority granted by this
201	194		subchapter, the board of regents of the University of Houston
202	195		System may acquire, purchase, construct, improve, renovate,
203	196		enlarge, or equip property, buildings, structures, facilities,
204	197		roads, or related infrastructure for the following institutions to
205	198		be financed by the issuance of bonds in accordance with this
206	199		subchapter and in accordance with a systemwide revenue financing
207	200		program adopted by the board in an aggregate principal amount not to
208	201		exceed the following amounts:
209	202		(1) the University of Houston, $12 million; and
210	203		(2) the University of Houston--Downtown, $7.5
211	204		million[; and
212	205		[(3) the University of Houston--Victoria, $10
213	206		million].
214		-	SECTION 15. AMENDMENT. Section 55.1733(a), Education Code,

215	208		is amended to read as follows:
216	209		(a) In addition to the other authority granted by this
217	210		subchapter, the board of regents of the University of Houston
218	211		System may issue in accordance with this subchapter and in
219	212		accordance with a systemwide revenue financing program adopted by
220	213		the board bonds for the following institutions not to exceed the
221	214		following aggregate principal amounts to finance projects
222	215		specified as follows:
223	216		(1) the University of Houston, $51 million to
224	217		construct science and engineering research and classroom
225	218		facilities;
226	219		(2) the University of Houston--Downtown, $18,232,500
227	220		to construct a classroom building; and
228	221		(3) the University of Houston--Clear Lake,
229	222		$30,918,750 to construct a student services and classroom
230	223		building[; and
231	224		[(4) the University of Houston--Victoria, $2,805,000
232	225		to remodel the University West facility, acquire and renovate a
233	226		facility services building, and renovate and expand a facility for
234	227		the center for community initiatives].
235		-	SECTION 16. AMENDMENT. Section 55.1753(a), Education Code,

241	234		infrastructure, for the following institutions, to be financed
242	235		through the issuance of bonds in accordance with this subchapter
243	236		and in accordance with a systemwide revenue financing program
244	237		adopted by the board, in aggregate principal amounts not to exceed
245	238		the following:
246	239		(1) the University of Houston, $57,600,000 for
247	240		renovation of science laboratories;
248	241		(2) the University of Houston--Clear Lake,
249	242		$10,604,808 for Arbor Building renovations and additions; and
250	243		(3) the University of Houston--Downtown, $31,626,000
251	244		for a classroom building at Shea Street[; and
252	245		[(4) the University of Houston--Victoria:
253	246		[(A) $22,900,000 for an academic building at the
254	247		University of Houston System Center at Sugar Land;
255	248		[(B) $6,719,400 for regional economic
256	249		development; and
257	250		[(C) $1,800,000 for allied health facilities].
258		-	SECTION 17. AMENDMENT. Section 55.1783(a), Education Code,

264	257		related infrastructure, for projects to be financed through the
265	258		issuance of bonds in accordance with this subchapter and in
266	259		accordance with a systemwide revenue financing program adopted by
267	260		the board for the following institutions or entities, not to exceed
268	261		the following aggregate principal amounts for the projects
269	262		specified, as follows:
270	263		(1) the University of Houston:
271	264		(A) $63 million for construction of a health and
272	265		biomedical sciences center; and
273	266		(B) $54 million for construction of a new
274	267		academic building located in Sugar Land, Texas;
275	268		(2) the University of Houston--Clear Lake:
276	269		(A) $24,624,000 for construction of a health
277	270		sciences and classroom building located in Pearland, Texas; and
278	271		(B) $54 million for construction of a STEM and
279	272		classroom building;
280	273		(3) the University of Houston--Downtown, $60 million
281	274		for construction of a science and technology building;
282	275		[(4) the University of Houston--Victoria, $60 million
283	276		for academic expansion and land acquisition;] and
284	277		(4) [(5)] the University of Houston System,
285	278		$46,832,000 for land acquisition for construction of a building in
286	279		the area near Katy, Texas.

289	282		(a) In addition to the other authority granted by this
290	283		subchapter, the board of regents of the University of Houston
291	284		System may acquire, purchase, construct, improve, renovate,

293	286		related infrastructure, for projects to be financed through the
294	287		issuance of bonds in accordance with this subchapter and in
295	288		accordance with a systemwide revenue financing program adopted by
296	289		the board for the following institutions, not to exceed the
297	290		following aggregate principal amounts for the projects specified,
298	291		as follows:
299	292		(1) the University of Houston System, $59,897,111 for
300	293		construction of a medical research facility;

302	295		(A) $40 million for construction of the Hobby
303	296		School of Public Affairs Building;
304	297		(B) $52,409,972 for construction of the IDEA Lab;

306	299		(C) $52,409,972 for construction of the Sugar
307	300		Land Academic Building 2;
308	301		(3) the University of Houston--Clear Lake,
309	302		$44,922,833 for renovation of the Bayou Building, the Delta
310	303		Building, and the Student Services and Classroom Building; and
311	304		(4) the University of Houston--Downtown, $44,922,833
312	305		for renovation of existing buildings and other campus
313	306		infrastructure upgrades and for the construction of the Police
314	307		Department and Criminal Justice Academy Building[; and
315	308		[(5) the University of Houston--Victoria, $44,922,833
316	309		for renovation of existing buildings and other campus
317	310		infrastructure upgrades].
318		-	SECTION 19. AMENDMENT. Subchapter B, Chapter 55, Education

319	312		Code, is amended by adding Section 55.17812 to read as follows:
320	313		Sec. 55.17812. TEXAS A&M UNIVERSITY--VICTORIA. (a) In
321	314		addition to the other authority granted by this subchapter, the
322	315		board of regents of The Texas A&M University System may issue bonds
323	316		in accordance with this subchapter and in accordance with a
324	317		systemwide revenue financing program adopted by the board in the
325	318		aggregate principal amounts not to exceed the amounts previously
326	319		authorized for the University of Houston--Victoria by Sections
327	320		55.1723, 55.173, 55.1733, 55.1753, 55.1783, and 55.1793, as those
328	321		sections existed immediately before this section took effect, less
329	322		any portion of those amounts for which bonds were issued under those
330	323		sections for the university before the date this section took
331	324		effect. Subject to Subsection (d), bonds issued under this section
332	325		for an amount previously authorized by Section 55.1723, 55.173,
333	326		55.1733, 55.1753, 55.1783, or 55.1793 may be used only at Texas A&M
334	327		University--Victoria for the purposes for which the bonds for the
335	328		University of Houston--Victoria were authorized to be issued under
336	329		Section 55.1723, 55.173, 55.1733, 55.1753, 55.1783, or 55.1793, as
337	330		applicable.
338	331		(b) The board may pledge irrevocably to the payment of those
339	332		bonds all or any part of the revenue funds of an institution,
340	333		branch, or entity of The Texas A&M University System, including
341	334		student tuition charges. The amount of a pledge made under this
342	335		subsection may not be reduced or abrogated while the bonds for which
343	336		the pledge is made, or bonds issued to refund those bonds, are
344	337		outstanding.
345	338		(c) If sufficient funds are not available to the board to
346	339		meet its obligations under this section, the board may transfer
347	340		funds among institutions, branches, and entities of The Texas A&M
348	341		University System to ensure the most equitable and efficient
349	342		allocation of available resources for each institution, branch, or
350	343		entity to carry out its duties and purposes.
351	344		(d) Any portion of the proceeds of bonds authorized by this
352	345		section for one or more specified projects that is not required for
353	346		the specified projects may be used to renovate existing structures
354	347		and facilities at the university.
355		-	SECTION 20. AMENDMENT. Section 62.021(a), Education Code,

356	349		is amended to read as follows:
357	350		(a) In each state fiscal year beginning with the state
358	351		fiscal year ending August 31, 2021, an eligible institution is
359	352		entitled to receive an amount allocated in accordance with this
360	353		section from the funds appropriated for that year by Section 17(a),
361	354		Article VII, Texas Constitution. The comptroller shall distribute
362	355		funds allocated under this subsection only on presentation of a
363	356		claim and issuance of a warrant in accordance with Section 403.071,
364	357		Government Code. An eligible institution may not present a claim to
365	358		be paid from any funds allocated under this subsection before the
366	359		delivery of goods or services described in Section 17, Article VII,
367	360		Texas Constitution, except for the payment of principal or interest
368	361		on bonds or notes or for a payment for a book or other published
369	362		library material as authorized by Section 2155.386, Government
370	363		Code. The allocation of funds under this subsection is made in
371	364		accordance with an equitable formula consisting of the following
372	365		elements: space deficit, facilities condition, institutional
373	366		complexity, and a separate allocation for the Texas State Technical
374	367		College System. The annual amounts allocated by the formula are as
375	368		follows:
376	369		(1) to the following component institutions of the
377	370		University of North Texas System:
378	371		(A) $38,473,304 to the University of North Texas;
379	372		(B) $15,581,837 to the University of North Texas
380	373		Health Science Center at Fort Worth; and
381	374		(C) $3,455,644 to the University of North Texas
382	375		at Dallas;
383	376		(2) to the following component institutions of the
384	377		Texas State University System:
385	378		(A) $13,537,649 to Lamar University;
386	379		(B) $2,630,158 to the Lamar Institute of
387	380		Technology;
388	381		(C) $1,533,301 to Lamar State College--Orange;
389	382		(D) $2,283,992 to Lamar State College--Port
390	383		Arthur;
391	384		(E) $18,787,013 to Sam Houston State University;
392	385		(F) $38,741,061 to Texas State University;
393	386		(G) $2,216,640 to Sul Ross State University; and
394	387		(H) $487,157 to Sul Ross State University-Rio

457	450		unobligated appropriations and other funds of the University of
458	451		Houston--Victoria to The Texas A&M University System.
459		-	SECTION 23. EFFECTIVE DATE. (a) Except as provided by
460		-	Subsection (b) of this section, this Act takes effect September 1,
461		-	2025.
462		-	(b) Section 7(b)(1) of this Act takes effect immediately if
463		-	this Act receives a vote of two-thirds of all the members elected to
464		-	each house, as provided by Section 39, Article III, Texas
465		-	Constitution. If this Act does not receive the vote necessary for
466		-	immediate effect, the entirety of this Act takes effect September
