77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prosecution of the criminal offense of unlawfully
1010 publishing a vote.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.006, Election Code, is amended to
1313 read as follows:
1414 Sec. 61.006. UNLAWFULLY PUBLISHING [DIVULGING] VOTE. (a)
1515 In this section:
1616 (1) "Effective consent" means consent by a person
1717 legally authorized to act for the voter. Consent is not effective
1818 if:
1919 (A) induced by force, threat, or fraud;
2020 (B) given by a person the actor knows is not
2121 legally authorized to act for the voter;
2222 (C) given by a person who by reason of youth,
2323 mental disease or defect, or intoxication is known by the actor to
2424 be unable to make reasonable decisions; or
2525 (D) given solely to detect the commission of an
2626 offense.
2727 (2) "Publish" means to communicate information or make
2828 information available to another person orally, in writing, or by
2929 means of telecommunication or electronic communication.
3030 (a-1) A person commits an offense if the person [was in a
3131 polling place for any purpose other than voting and] knowingly
3232 publishes [communicates to another person information that the
3333 person obtained at the polling place about] how a voter has voted
3434 without the effective consent of the voter.
3535 (b) An offense under this section is a felony of the third
3636 degree.
3737 (c) It is an exception to prosecution under this section
3838 that the person published the voter's voting [This section does not
3939 apply to] information during:
4040 (1) [presented in] an official investigation to which
4141 the information was relevant; or
4242 (2) an administrative, executive, legislative, or
4343 judicial proceeding conducted before a public servant and to [other
4444 official proceeding in] which the information was [is] relevant,
4545 including during the administration of an election.
4646 SECTION 2. The change in law made by this Act applies only
4747 to an offense committed on or after the effective date of this Act.
4848 An offense committed before the effective date of this Act is
4949 governed by the law in effect on the date the offense was committed,
5050 and the former law is continued in effect for that purpose. For
5151 purposes of this section, an offense was committed before the
5252 effective date of this Act if any element of the offense occurred
5353 before that date.
5454 SECTION 3. This Act takes effect September 1, 2025.
