88 AN ACT
99 relating to the establishment of a grant program for the provision
1010 of menstrual products at public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1313 amended by adding Section 38.038 to read as follows:
1414 Sec. 38.038. AVAILABILITY OF MENSTRUAL PRODUCTS: GRANT
1515 PROGRAM. (a) In this section:
1616 (1) "Eligible school district" means a school district
1717 in which a qualifying campus is located.
1818 (2) "Menstrual products" means tampons and sanitary
1919 napkins for use in connection with the menstrual cycle.
2020 (3) "Qualifying campus" means a school district campus
2121 that:
2222 (A) offers a course of instruction for students
2323 in one or more grades from grade 5 through grade 12; and
2424 (B) receives federal funding under Title I of the
2525 Elementary and Secondary Education Act of 1965 (20 U.S.C. Section
2626 6301 et seq.).
2727 (b) The commissioner shall establish and administer a
2828 program to award grants to eligible school districts to provide
2929 menstrual products to female students enrolled at a qualifying
3030 campus.
3131 (c) Only an eligible school district may apply for and
3232 receive a grant under this section.
3333 (d) Not later than September 1 of each year, the
3434 commissioner shall:
3535 (1) certify the total amount of funding available to
3636 be awarded under the program for that school year; and
3737 (2) from funds appropriated for that purpose, award
3838 grants to eligible school districts proportionately based on the
3939 total number of female students enrolled in grade 5 through grade 12
4040 at each qualifying campus located in the eligible district.
4141 (e) An eligible school district that receives a grant under
4242 this section shall make menstrual products available free of charge
4343 at each qualifying campus in the district through a female school
4444 counselor, female nurse, or female classroom teacher selected by
4545 the principal of the qualifying campus.
4646 (f) The legislature may appropriate money, and the
4747 commissioner may solicit and accept gifts, grants, and donations
4848 from any public or private source, for the purpose of providing
4949 grants under the program.
5050 (g) The commissioner shall adopt rules and procedures to
5151 administer the program established under this section.
5252 SECTION 2. This Act applies beginning with the 2025-2026
5353 school year.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2025.
