9 | 9 | | relating to the establishment of a grant program for the provision |
---|
10 | 10 | | of menstrual products at public schools. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
---|
13 | 13 | | amended by adding Section 38.038 to read as follows: |
---|
14 | 14 | | Sec. 38.038. AVAILABILITY OF MENSTRUAL PRODUCTS: GRANT |
---|
15 | 15 | | PROGRAM. (a) In this section: |
---|
16 | 16 | | (1) "Eligible school district" means a school district |
---|
17 | 17 | | in which a qualifying campus is located. |
---|
18 | 18 | | (2) "Menstrual products" means tampons and sanitary |
---|
19 | 19 | | napkins for use in connection with the menstrual cycle. |
---|
20 | 20 | | (3) "Qualifying campus" means a school district campus |
---|
21 | 21 | | that: |
---|
22 | 22 | | (A) offers a course of instruction for students |
---|
23 | 23 | | in one or more grades from grade 5 through grade 12; and |
---|
24 | 24 | | (B) receives federal funding under Title I of the |
---|
25 | 25 | | Elementary and Secondary Education Act of 1965 (20 U.S.C. Section |
---|
26 | 26 | | 6301 et seq.). |
---|
27 | 27 | | (b) The commissioner shall establish and administer a |
---|
28 | 28 | | program to award grants to eligible school districts to provide |
---|
29 | 29 | | menstrual products to female students enrolled at a qualifying |
---|
30 | 30 | | campus. |
---|
31 | 31 | | (c) Only an eligible school district may apply for and |
---|
32 | 32 | | receive a grant under this section. |
---|
33 | 33 | | (d) Not later than September 1 of each year, the |
---|
34 | 34 | | commissioner shall: |
---|
35 | 35 | | (1) certify the total amount of funding available to |
---|
36 | 36 | | be awarded under the program for that school year; and |
---|
37 | 37 | | (2) from funds appropriated for that purpose, award |
---|
38 | 38 | | grants to eligible school districts proportionately based on the |
---|
39 | 39 | | total number of female students enrolled in grade 5 through grade 12 |
---|
40 | 40 | | at each qualifying campus located in the eligible district. |
---|
41 | 41 | | (e) An eligible school district that receives a grant under |
---|
42 | 42 | | this section shall make menstrual products available free of charge |
---|
43 | 43 | | at each qualifying campus in the district through a female school |
---|
44 | 44 | | counselor, female nurse, or female classroom teacher selected by |
---|
45 | 45 | | the principal of the qualifying campus. |
---|
46 | 46 | | (f) The legislature may appropriate money, and the |
---|
47 | 47 | | commissioner may solicit and accept gifts, grants, and donations |
---|
48 | 48 | | from any public or private source, for the purpose of providing |
---|
49 | 49 | | grants under the program. |
---|
50 | 50 | | (g) The commissioner shall adopt rules and procedures to |
---|
51 | 51 | | administer the program established under this section. |
---|
52 | 52 | | SECTION 2. This Act applies beginning with the 2025-2026 |
---|
53 | 53 | | school year. |
---|
54 | 54 | | SECTION 3. This Act takes effect immediately if it receives |
---|
55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
---|
56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
---|
58 | 58 | | Act takes effect September 1, 2025. |
---|
