77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to student access to certain academic records held by a
1010 public institution of higher education or career school or college;
1111 authorizing fees.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.9716 to read as follows:
1515 Sec. 51.9716. STUDENT TRANSCRIPTS AND DIPLOMAS. (a) In
1616 this section:
1717 (1) "Institution of higher education" has the meaning
1818 assigned by Section 61.003.
1919 (2) "Student" includes a former student.
2020 (b) Notwithstanding any other provision of this code, an
2121 institution of higher education may not withhold a student's
2222 transcript or diploma on the basis that the student has not
2323 fulfilled the student's financial obligation to the institution if
2424 the student's outstanding financial obligation to the institution:
2525 (1) is less than $500; or
2626 (2) has been outstanding for more than five years.
2727 (c) An institution of higher education may require a student
2828 with an outstanding financial obligation to the institution of $500
2929 or more to enter into a repayment plan with the institution before
3030 releasing the student's transcript or diploma to the student. The
3131 institution must release the transcript or diploma to the student
3232 on the student's initiation of payment under the repayment plan.
3333 (d) An institution of higher education may charge a student
3434 a fee in connection with the release of a transcript or diploma.
3535 The amount of the fee may not exceed the cost of materials used to
3636 print, mail, or electronically send the transcript or diploma.
3737 SECTION 2. Section 132.062, Education Code, is amended to
3838 read as follows:
3939 Sec. 132.062. STUDENT [WITHHOLDING] RECORDS. (a) A career
4040 school or college may not withhold a student's transcript or
4141 certificate of completion of training on the basis that [until] the
4242 student has not fulfilled the student's financial obligation to the
4343 school or college if the student's outstanding financial obligation
4444 to the school or college:
4545 (1) is less than $500; or
4646 (2) has been outstanding for more than five years.
4747 (b) A career school or college may require a student with an
4848 outstanding financial obligation to the school or college of $500
4949 or more to enter into a repayment plan with the school or college
5050 before releasing the student's transcript or certificate of
5151 completion of training to the student. The career school or college
5252 must release the transcript or certificate to the student on the
5353 student's initiation of payment under the repayment plan.
5454 (c) A career school or college may charge a student a fee in
5555 connection with the release of a transcript or certificate of
5656 completion of training. The amount of the fee may not exceed the
5757 cost of materials used to print, mail, or electronically send the
5858 transcript or certificate.
5959 (d) For purposes of this section, "student" includes a
6060 former student.
6161 SECTION 3. This Act takes effect September 1, 2025.
