10 | 10 | | public institution of higher education or career school or college; |

11 | 11 | | authorizing fees. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
---|
14 | 14 | | amended by adding Section 51.9716 to read as follows: |
---|
15 | 15 | | Sec. 51.9716. STUDENT TRANSCRIPTS AND DIPLOMAS. (a) In |
---|
16 | 16 | | this section: |
---|
17 | 17 | | (1) "Institution of higher education" has the meaning |
---|
18 | 18 | | assigned by Section 61.003. |
---|
19 | 19 | | (2) "Student" includes a former student. |
---|
20 | 20 | | (b) Notwithstanding any other provision of this code, an |
---|
21 | 21 | | institution of higher education may not withhold a student's |
---|
22 | 22 | | transcript or diploma on the basis that the student has not |
---|
23 | 23 | | fulfilled the student's financial obligation to the institution if |
---|
24 | 24 | | the student's outstanding financial obligation to the institution: |
---|
25 | 25 | | (1) is less than $500; or |
---|
26 | 26 | | (2) has been outstanding for more than five years. |
---|
27 | 27 | | (c) An institution of higher education may require a student |
---|
28 | 28 | | with an outstanding financial obligation to the institution of $500 |
---|
29 | 29 | | or more to enter into a repayment plan with the institution before |
---|
30 | 30 | | releasing the student's transcript or diploma to the student. The |
---|
31 | 31 | | institution must release the transcript or diploma to the student |
---|
32 | 32 | | on the student's initiation of payment under the repayment plan. |
---|
33 | 33 | | (d) An institution of higher education may charge a student |
---|
34 | 34 | | a fee in connection with the release of a transcript or diploma. |
---|
35 | 35 | | The amount of the fee may not exceed the cost of materials used to |
---|
36 | 36 | | print, mail, or electronically send the transcript or diploma. |
---|
37 | 37 | | SECTION 2. Section 132.062, Education Code, is amended to |
---|
38 | 38 | | read as follows: |
---|
39 | 39 | | Sec. 132.062. STUDENT [WITHHOLDING] RECORDS. (a) A career |
---|
40 | 40 | | school or college may not withhold a student's transcript or |
---|
41 | 41 | | certificate of completion of training on the basis that [until] the |
---|
42 | 42 | | student has not fulfilled the student's financial obligation to the |
---|
43 | 43 | | school or college if the student's outstanding financial obligation |
---|
44 | 44 | | to the school or college: |
---|
45 | 45 | | (1) is less than $500; or |
---|
46 | 46 | | (2) has been outstanding for more than five years. |
---|
47 | 47 | | (b) A career school or college may require a student with an |
---|
48 | 48 | | outstanding financial obligation to the school or college of $500 |
---|
49 | 49 | | or more to enter into a repayment plan with the school or college |
---|
50 | 50 | | before releasing the student's transcript or certificate of |
---|
51 | 51 | | completion of training to the student. The career school or college |
---|
52 | 52 | | must release the transcript or certificate to the student on the |
---|
53 | 53 | | student's initiation of payment under the repayment plan. |
---|
54 | 54 | | (c) A career school or college may charge a student a fee in |
---|
55 | 55 | | connection with the release of a transcript or certificate of |
---|
56 | 56 | | completion of training. The amount of the fee may not exceed the |
---|
57 | 57 | | cost of materials used to print, mail, or electronically send the |
---|
58 | 58 | | transcript or certificate. |
---|
59 | 59 | | (d) For purposes of this section, "student" includes a |
---|
60 | 60 | | former student. |
---|
61 | 61 | | SECTION 3. This Act takes effect September 1, 2025. |
