11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 461A, Health and Safety |
---|
13 | 13 | | Code, is amended by adding Section 461A.060 to read as follows: |

14 | 14 | | Sec. 461A.060. BIENNIAL REPORT ON OPIOID ANTAGONIST |
---|
15 | 15 | | PROGRAMS FOR OPIOID OVERDOSE REVERSAL AND PREVENTION. (a) In this |
---|
16 | 16 | | section, "opioid antagonist" has the meaning assigned by Section |
---|
17 | 17 | | 483.101. |
---|
18 | 18 | | (b) Not later than October 1 of each even-numbered year, the |
---|
19 | 19 | | commission shall: |
---|
20 | 20 | | (1) prepare a report evaluating the distribution of |
---|
21 | 21 | | opioid antagonists in this state to reverse and prevent opioid |
---|
22 | 22 | | overdoses; and |
---|
23 | 23 | | (2) submit the report to the governor, the lieutenant |
---|
24 | 24 | | governor, and the speaker of the house of representatives. |
---|
25 | 25 | | (c) The report described by Subsection (b) must: |
---|
26 | 26 | | (1) include a needs assessment for the opioid |
---|
27 | 27 | | antagonist programs established by state agencies and institutions |
---|
28 | 28 | | of higher education; |
---|
29 | 29 | | (2) establish a statewide saturation goal for opioid |
---|
30 | 30 | | antagonists and include: |
---|
31 | 31 | | (A) a description of the data sources and |
---|
32 | 32 | | methodology used to estimate insufficiencies in the current supply |
---|
33 | 33 | | of opioid antagonists; and |
---|
34 | 34 | | (B) a communications plan to address opioid |
---|
35 | 35 | | overdoses in areas of this state at higher risk for increased |
---|
36 | 36 | | numbers of overdoses; |
---|
37 | 37 | | (3) include a description of all state and federal |
---|
38 | 38 | | money appropriated to governmental opioid antagonist programs; |
---|
39 | 39 | | (4) establish opioid antagonist distribution |
---|
40 | 40 | | strategies for this state; |
---|
41 | 41 | | (5) list and describe all available state and |
---|
42 | 42 | | federally funded purchase and distribution programs for opioid |
---|
43 | 43 | | antagonists; and |
---|
44 | 44 | | (6) recommend improvements for addressing opioid |
---|
45 | 45 | | overdoses among high-risk populations, including school-aged |
---|
46 | 46 | | children, pregnant and postpartum women, and individuals residing |
---|
47 | 47 | | in rural areas of this state. |
---|
48 | 48 | | (d) In preparing the report under this section, the |
---|
49 | 49 | | commission shall coordinate and consult with each state agency and |
---|
50 | 50 | | institution of higher education that receives funding or other |
---|
51 | 51 | | resources for the distribution of opioid antagonists. |
---|
52 | 52 | | SECTION 2. This Act takes effect September 1, 2025. |
