66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the applicability of certain laws regarding
99 peer-to-peer car sharing programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 113.0003, Business & Commerce Code, is
1212 amended to read as follows:
1313 Sec. 113.0003. CONSTRUCTION OF CHAPTER. Nothing in this
1414 chapter may be construed to:
1515 (1) limit the liability of a peer-to-peer car sharing
1616 program for any act or omission of the program itself that results
1717 in injury to a person as a result of the use of a shared vehicle
1818 through the program;
1919 (2) limit the ability of a peer-to-peer car sharing
2020 program to, by contract, seek indemnification from the owner or
2121 driver for economic loss sustained by the program resulting from a
2222 breach of the agreement;
2323 [(3) have implications affecting construction of
2424 statutes outside this chapter, including statutes related to motor
2525 vehicle regulation, airport regulation, or taxation;]
2626 (3) [(4)] invalidate or limit an exclusion contained
2727 in an automobile insurance policy, including an insurance policy in
2828 use or approved for use that excludes coverage for automobiles made
2929 available for rent, sharing, hire, or any business use; or
3030 (4) [(5)] invalidate, limit, or restrict an insurer's
3131 ability under law to:
3232 (A) underwrite any insurance policy; or
3333 (B) cancel or decline to renew an insurance
3434 policy.
3535 SECTION 2. This Act takes effect September 1, 2025.
