77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring county use of the statewide computerized
1010 voter registration list.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 18.012, Election Code, is
1313 amended to read as follows:
1414 Sec. 18.012. REQUIREMENTS FOR [SECRETARY OF STATE TO
1515 APPROVE] COMPUTER SERVICES CONTRACTS.
1616 SECTION 2. Section 18.012, Election Code, is amended by
1717 amending Subsection (a) and adding Subsection (d) to read as
1818 follows:
1919 (a) A county may not contract with a computer service
2020 company or other private business entity for services related to
2121 the lists required under this subchapter [unless the programs,
2222 equipment, or other materials to be covered by the contract are
2323 approved by the secretary of state. The secretary may rescind
2424 approval of the programs, equipment, or other materials at any
2525 time, and on that action the contract is nullified to the extent
2626 that it depends on the disapproved items].
2727 (d) A county shall contract with the secretary of state to
2828 use the statewide computerized voter registration list developed
2929 under Subchapter C for services related to the lists required under
3030 this subchapter.
3131 SECTION 3. Sections 18.012(b) and (c), Election Code, are
3232 repealed.
3333 SECTION 4. The change in law made by this Act applies only
3434 to a contract entered into on or after the effective date of this
3535 Act. A contract entered into before the effective date of this Act
3636 is governed by the law in effect on the date the contract was
3737 entered into, and the former law is continued in effect for that
3838 purpose.
3939 SECTION 5. This Act takes effect September 1, 2025.
