11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 545.307(a)(2), Transportation Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (2) "Residential subdivision" means a subdivision: | |
15 | 15 | (A) located in a county with a population: | |
16 | 16 | (i) greater than 220,000; or | |
17 | 17 | (ii) less than 75,000 that is adjacent to | |
18 | 18 | three counties with populations of more than 450,000; | |
19 | 19 | (B) [: (A)] for which a plat is recorded in the | |
20 | 20 | county real property records; and | |
21 | 21 | (C) [(B)] in which the majority of lots are | |
22 | 22 | subject to deed restrictions limiting the lots to residential use. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2025. |
