148 AN ACT
15- relating to providing notice to a state representative and senator
16- of certain administrative actions of the Texas Commission on
17- Environmental Quality.
9+ relating to the provision by the Texas Commission on Environmental
10+ Quality to the pertinent state representative and state senator of
11+ notice of certain administrative actions of the commission.
1812 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1913 SECTION 1. Section 7.060, Water Code, is amended to read as
2014 follows:
21- Sec. 7.060. NOTICE OF PENALTY. (a) If the commission is

2216 required to give notice of a penalty under Section 7.057 or 7.059,
2317 the commission shall:
2418 (1) publish notice of its decision in the Texas
2519 Register not later than the 10th day after the date on which the
2620 decision is adopted; and
27- (2) if required by Subsection (b), notify the state
28- representative and state senator who represent the area where the
29- violation for which the penalty is being assessed occurred.
30- (b) The commission shall:
31- (1) affirmatively offer each state representative and
32- state senator the opportunity to receive notice under Subsection
33- (a)(2); and
34- (2) provide appropriate notice to each representative
35- or senator who elects to receive notice under this section.
36- SECTION 2. Section 7.075, Water Code, is amended by
37- amending Subsection (a) and adding Subsection (a-1) to read as
38- follows:
21+ (2) notify the state representative and state senator
22+ who represent the area where the violation for which the penalty is
23+ being assessed occurred.
24+ SECTION 2. Section 7.075(a), Water Code, is amended to read
25+ as follows:
3926 (a) Before the commission approves an administrative order
4027 or proposed agreement to settle an administrative enforcement
4128 action initiated under this subchapter to which the commission is a
4229 party, the commission shall:
4330 (1) allow the public to comment in writing on the
4431 proposed order or agreement;
4532 (2) publish notice [. Notice] of the opportunity to
4633 comment on the proposed order or agreement [shall be published] in
4734 the Texas Register not later than the 30th day before the date on
4835 which the public comment period closes; and
49- (3) if required by Subsection (a-1), notify the state
50- representative and state senator who represent the area in which
51- the violation that is the subject of the proposed order or agreement
52- occurred.
53- (a-1) The commission shall:
54- (1) affirmatively offer each state representative and
55- state senator the opportunity to receive notice under Subsection
56- (a)(3); and
57- (2) provide appropriate notice to each representative
58- or senator who elects to receive notice under this section.
36+ (3) notify the state representative and state senator
37+ who represent the area in which the violation that is the subject of
38+ the proposed order or agreement occurred.
5939 SECTION 3. This Act takes effect September 1, 2025.
