1313 A BILL TO BE ENTITLED
1414 AN ACT
1515 relating to certain policies and procedures related to concussions
1616 or other brain injuries sustained by public school students.
1717 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1818 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1919 amended by adding Section 38.0051 to read as follows:
2020 Sec. 38.0051. ACADEMIC ACCOMMODATIONS FOR STUDENT WITH
2121 CONCUSSION OR OTHER BRAIN INJURY. (a) The agency shall develop a
2222 list of nonmedical academic accommodations a school district may
2323 offer to a student diagnosed with a concussion or other brain
2424 injury.
2525 (b) The agency shall:
2626 (1) develop a form for use by school districts
2727 describing the accommodations a district may offer under this
2828 section; and
2929 (2) make the form developed under Subdivision (1)
3030 available on the agency's Internet website for use by school
3131 districts, district educators or administrators, students, and
3232 parents or guardians.
3333 (c) A school district that provides accommodations under
3434 this section must make the form developed under Subsection (b)
3535 available to:
3636 (1) a district employee as soon as practicable after
3737 receiving:
3838 (A) notice that a student enrolled in the
3939 district has been diagnosed with a concussion or other brain
4040 injury; or
4141 (B) a request from the employee; and
4242 (2) a student enrolled in the district or the student's
4343 parent or guardian as soon as practicable after receiving:
4444 (A) notice that the student has been diagnosed
4545 with a concussion or other brain injury; or
4646 (B) a request from the student or parent or
4747 guardian.
4848 (d) This section may not be construed to require a school
4949 district to provide any accommodations under this section.
5050 SECTION 2. Chapter 38, Education Code, is amended by adding
5151 Subchapter D-1 to read as follows:
5252 SUBCHAPTER D-1. TREATMENT OF CONCUSSIONS AFFECTING STUDENTS OTHER
5353 THAN STUDENT ATHLETES
5454 Sec. 38.171. DEFINITION. In this subchapter, "concussion"
5555 has the meaning assigned by Section 38.151.
5656 Sec. 38.172. APPLICABILITY. This subchapter does not apply
5757 to a concussion believed to have been sustained by a student while
5858 participating in an interscholastic athletic activity described by
5959 Section 38.152.
6060 Sec. 38.173. CONCUSSION RESPONSE POLICY. (a) A school
6161 district shall adopt and implement a policy regarding how to
6262 respond to a concussion believed to have been sustained by a student
6363 while on school property or participating in a school-sponsored or
6464 school-related activity on or off school property.
6565 (b) The policy adopted under Subsection (a) must provide
6666 for:
6767 (1) the immediate removal of a student from a
6868 school-sponsored or school-related activity if a school district
6969 employee or volunteer believes the student might have sustained a
7070 concussion;
7171 (2) notice to the student's parent or guardian or
7272 another person with legal authority to make medical decisions for
7373 the student of the student's suspected concussion and removal under
7474 Subdivision (1); and
7575 (3) the student's return to a school-sponsored or
7676 school-related activity only after the requirements under Section
7777 38.157(a) have been satisfied.
7878 SECTION 3. This Act applies beginning with the 2025-2026
7979 school year.
8080 SECTION 4. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2025.
