88 AN ACT
99 relating to restrictions on the sale of obscene devices; providing
1010 a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 6, Business & Commerce Code, is amended by
1313 adding Chapter 205 to read as follows:
1414 CHAPTER 205. RESTRICTION ON THE SALE OF OBSCENE DEVICES
1515 Sec. 205.001. DEFINITIONS. In this chapter:
1616 (1) "Obscene device" has the meaning assigned by
1717 Section 43.21, Penal Code.
1818 (2) "Sexually oriented business" has the meaning
1919 assigned by Section 243.002, Local Government Code.
2020 Sec. 205.002. SALE OF OBSCENE DEVICES RESTRICTED. A
2121 business in this state may not sell, offer for sale, or hold for
2222 sale an obscene device, unless the business is a sexually oriented
2323 business operating in accordance with Chapter 102.
2424 Sec. 205.003. ENFORCEMENT; INJUNCTION AND CIVIL PENALTY.
2525 (a) A county or district attorney who believes that a business
2626 located in that county or district attorney's jurisdiction has
2727 violated or is violating Section 205.002 may bring an action in a
2828 district court of the county to enjoin the business from violating
2929 that section.
3030 (b) In addition to seeking an injunction under Subsection
3131 (a), the county or district attorney may request and the court may
3232 order any other relief that may be in the public interest,
3333 including:
3434 (1) the imposition of a civil penalty in an amount not
3535 to exceed $5,000 for each violation of Section 205.002; and
3636 (2) an order requiring reimbursement to the county or
3737 district for the reasonable value of investigating and prosecuting
3838 a violation of Section 205.002.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2025.
