88 AN ACT
99 relating to the applicability of certain laws to tiny homes and tiny
1010 home communities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 94.002, Property Code, is amended by
1313 adding Subsection (c) to read as follows:
1414 (c) This chapter does not apply to a tiny home community or
1515 tiny home. For purposes of this subsection:
1616 (1) "Tiny home" means a moveable trailer:
1717 (A) with a home affixed to a single chassis:
1818 (i) which is a transportable unit that has a
1919 body not wider than 14 feet and is designed to provide living
2020 quarters for not more than one household when connected to
2121 utilities necessary for operation of installed fixtures and
2222 appliances; and
2323 (ii) the total area of which in a setup
2424 mode, when measured from the maximum dimensions of the exterior
2525 surface of the exterior stud walls, not including any bay windows or
2626 protrusions, does not exceed 500 square feet;
2727 (B) that is not:
2828 (i) a recreational vehicle as defined by
2929 Section 522.004(b), Transportation Code;
3030 (ii) a park model trailer that is designed
3131 to be used for human habitation, with or without a permanent
3232 foundation, when connected to the required utilities, and that:
3333 (a) is less than eight feet six inches
3434 in width and 45 feet in length in the traveling mode;
3535 (b) includes the plumbing, heating,
3636 air conditioning, and electrical systems; and
3737 (c) is not required to be affixed with
3838 a label or decal issued by the United States Department of Housing
3939 and Urban Development and by the Texas Department of Housing and
4040 Community Affairs; or
4141 (iii) a manufactured home as defined by
4242 Section 94.001, Property Code; and
4343 (C) that may not be titled as a vehicle with the
4444 Texas Department of Motor Vehicles.
4545 (2) "Tiny home community" means real property that:
4646 (A) is rented or held out for rent to others for
4747 the placement of two or more tiny homes;
4848 (B) is not:
4949 (i) a recreational vehicle park as defined
5050 by Section 13.087, Water Code, and not under ownership of a
5151 recreational vehicle park; or
5252 (ii) a manufactured home community as
5353 defined by Section 94.001 and not under ownership of a manufactured
5454 home community;
5555 (C) is subject to property tax; and
5656 (D) is metered by a utility company to the owners
5757 of the tiny homes on the property.
5858 SECTION 2. Section 522.004(b), Transportation Code, is
5959 amended to read as follows:
6060 (b) In this section, "recreational vehicle" means a motor
6161 vehicle primarily designed as temporary living quarters for
6262 recreational camping or travel use. The term includes a travel
6363 trailer, camping trailer, truck camper, and motor home. The term
6464 does not include a tiny home as defined by Section 94.002(c),
6565 Property Code.
6666 SECTION 3. This Act takes effect September 1, 2025.
