| 9 | 9 | | relating to the applicability of certain laws to tiny homes and tiny |
|---|
| 10 | 10 | | home communities. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 94.002, Property Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (c) to read as follows: |
|---|
| 14 | 14 | | (c) This chapter does not apply to a tiny home community or |
|---|
| 15 | 15 | | tiny home. For purposes of this subsection: |
|---|
| 16 | 16 | | (1) "Tiny home" means a moveable trailer: |
|---|
| 17 | 17 | | (A) with a home affixed to a single chassis: |
|---|
| 18 | 18 | | (i) which is a transportable unit that has a |
|---|
| 19 | 19 | | body not wider than 14 feet and is designed to provide living |
|---|
| 20 | 20 | | quarters for not more than one household when connected to |
|---|
| 21 | 21 | | utilities necessary for operation of installed fixtures and |
|---|
| 22 | 22 | | appliances; and |
|---|
| 23 | 23 | | (ii) the total area of which in a setup |
|---|
| 24 | 24 | | mode, when measured from the maximum dimensions of the exterior |
|---|
| 25 | 25 | | surface of the exterior stud walls, not including any bay windows or |
|---|
| 26 | 26 | | protrusions, does not exceed 500 square feet; |
|---|
| 27 | 27 | | (B) that is not: |
|---|
| 28 | 28 | | (i) a recreational vehicle as defined by |
|---|
| 29 | 29 | | Section 522.004(b), Transportation Code; |
|---|
| 30 | 30 | | (ii) a park model trailer that is designed |
|---|
| 31 | 31 | | to be used for human habitation, with or without a permanent |
|---|
| 32 | 32 | | foundation, when connected to the required utilities, and that: |
|---|
| 33 | 33 | | (a) is less than eight feet six inches |
|---|
| 34 | 34 | | in width and 45 feet in length in the traveling mode; |
|---|
| 35 | 35 | | (b) includes the plumbing, heating, |
|---|
| 36 | 36 | | air conditioning, and electrical systems; and |
|---|
| 37 | 37 | | (c) is not required to be affixed with |
|---|
| 38 | 38 | | a label or decal issued by the United States Department of Housing |
|---|
| 39 | 39 | | and Urban Development and by the Texas Department of Housing and |
|---|
| 40 | 40 | | Community Affairs; or |
|---|
| 41 | 41 | | (iii) a manufactured home as defined by |
|---|
| 42 | 42 | | Section 94.001, Property Code; and |
|---|
| 43 | 43 | | (C) that may not be titled as a vehicle with the |
|---|
| 44 | 44 | | Texas Department of Motor Vehicles. |
|---|
| 45 | 45 | | (2) "Tiny home community" means real property that: |
|---|
| 46 | 46 | | (A) is rented or held out for rent to others for |
|---|
| 47 | 47 | | the placement of two or more tiny homes; |
|---|
| 48 | 48 | | (B) is not: |
|---|
| 49 | 49 | | (i) a recreational vehicle park as defined |
|---|
| 50 | 50 | | by Section 13.087, Water Code, and not under ownership of a |
|---|
| 51 | 51 | | recreational vehicle park; or |
|---|
| 52 | 52 | | (ii) a manufactured home community as |
|---|
| 53 | 53 | | defined by Section 94.001 and not under ownership of a manufactured |
|---|
| 54 | 54 | | home community; |
|---|
| 55 | 55 | | (C) is subject to property tax; and |
|---|
| 56 | 56 | | (D) is metered by a utility company to the owners |
|---|
| 57 | 57 | | of the tiny homes on the property. |
|---|
| 58 | 58 | | SECTION 2. Section 522.004(b), Transportation Code, is |
|---|
| 59 | 59 | | amended to read as follows: |
|---|
| 60 | 60 | | (b) In this section, "recreational vehicle" means a motor |
|---|
| 61 | 61 | | vehicle primarily designed as temporary living quarters for |
|---|
| 62 | 62 | | recreational camping or travel use. The term includes a travel |
|---|
| 63 | 63 | | trailer, camping trailer, truck camper, and motor home. The term |
|---|
| 64 | 64 | | does not include a tiny home as defined by Section 94.002(c), |
|---|
| 65 | 65 | | Property Code. |
|---|
| 66 | 66 | | SECTION 3. This Act takes effect September 1, 2025. |
