8 | 8 | | relating to access by a member of the legislature or the lieutenant |

9 | 9 | | governor to certain governmental meetings or enforcement actions. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subtitle A, Title 3, Government Code, is amended |
---|
12 | 12 | | by adding Chapter 307 to read as follows: |
---|
13 | 13 | | CHAPTER 307. LEGISLATIVE ACCESS TO ENFORCEMENT ACTION |
---|
14 | 14 | | Sec. 307.001. ACCESS REQUIRED. Notwithstanding any other |
---|
15 | 15 | | law, on request by a member of the legislature or the lieutenant |
---|
16 | 16 | | governor, a state agency shall allow the member or lieutenant |
---|
17 | 17 | | governor to accompany an employee of the agency performing an |
---|
18 | 18 | | enforcement action. |
---|
19 | 19 | | SECTION 2. Subchapter E, Chapter 551, Government Code, is |
---|
20 | 20 | | amended by adding Section 551.105 to read as follows: |
---|
21 | 21 | | Sec. 551.105. ATTENDANCE FOR LEGISLATIVE PURPOSE. (a) A |
---|
22 | 22 | | governmental body shall on request of a member of the legislature or |
---|
23 | 23 | | the lieutenant governor allow the requestor to attend a closed |
---|
24 | 24 | | meeting of the governmental body if the requestor states that the |
---|
25 | 25 | | request is made for a legislative purpose. |
---|
26 | 26 | | (b) A member of the legislature or the lieutenant governor |
---|
27 | 27 | | who has requested to attend a closed meeting must be given |
---|
28 | 28 | | reasonable notice before the meeting. |
---|
29 | 29 | | (c) A member of the legislature or the lieutenant governor |
---|
30 | 30 | | who attends a closed meeting may observe the meeting only and may |
---|
31 | 31 | | not actively participate in the meeting. |
---|
32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2025. |
---|
