| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 42.10(e), Penal Code, is amended to read |
|---|
| 14 | 14 | | as follows: |
|---|
| 15 | 15 | | (e) Except as otherwise provided by this subsection, an |
|---|
| 16 | 16 | | offense under this section is a state jail felony. An offense under |
|---|
| 17 | 17 | | Subsection (a)(6) [(a)(4), (5), or (6)] is a Class A misdemeanor. |
|---|
| 18 | 18 | | [An offense under Subsection (a)(1), (2), or (3) is a state jail |
|---|
| 19 | 19 | | felony.] |

| 20 | 20 | | SECTION 2. Section 42.105(g), Penal Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | (g) Except as otherwise provided by this subsection, an [An] |
|---|
| 23 | 23 | | offense under this section [Subsection (b)(1) or (2)] is a state |
|---|
| 24 | 24 | | jail felony. An offense under Subsection (b)(5) [(b)(3), (4), or |
|---|
| 25 | 25 | | (5)] is a Class A misdemeanor. An offense under Subsection (b)(6) |
|---|
| 26 | 26 | | is a Class C misdemeanor, except that the offense is a Class A |
|---|
| 27 | 27 | | misdemeanor if it is shown on the trial of the offense that the |
|---|
| 28 | 28 | | person has been previously convicted of an offense under that |
|---|
| 29 | 29 | | subdivision. |

| 30 | 30 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to an offense committed on or after the effective date of this Act. |
|---|
| 32 | 32 | | An offense committed before the effective date of this Act is |
|---|
| 33 | 33 | | governed by the law in effect on the date the offense was committed, |
|---|
| 34 | 34 | | and the former law is continued in effect for that purpose. For |
|---|
| 35 | 35 | | purposes of this section, an offense was committed before the |
|---|
| 36 | 36 | | effective date of this Act if any element of the offense occurred |
|---|
| 37 | 37 | | before that date. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2025. |
