88 AN ACT
99 relating to the prioritization of natural gas deliveries to certain
1010 electric power generation units.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 121, Utilities Code, is
1313 amended by adding Section 121.159 to read as follows:
1414 Sec. 121.159. PRIORITY OF NATURAL GAS DELIVERY DURING
1515 CURTAILMENT EVENT. (a) In this section, "human needs customers"
1616 includes:
1717 (1) residences, hospitals, water and wastewater
1818 facilities, and police, fire, and military and civil defense
1919 facilities;
2020 (2) other locations where people may congregate in an
2121 emergency;
2222 (3) small commercial customers that cannot
2323 practicably be curtailed without curtailing human needs;
2424 (4) natural-gas-fired electric generation facilities;
2525 and
2626 (5) any other customers identified by rule by the
2727 railroad commission.
2828 (b) A gas utility that determines that the utility's ability
2929 to deliver natural gas may become inadequate to support continuous
3030 service to customers on the utility's intrastate system and that
3131 reduces intrastate deliveries to one or more customers shall
3232 prioritize natural gas deliveries to natural-gas-fired electric
3333 generation facilities at the same level as natural gas deliveries
3434 to other human needs customers and local distribution systems that
3535 serve those human needs customers.
3636 SECTION 2. This Act takes effect September 1, 2025.
