11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter D, Chapter 121, Utilities Code, is |
---|
13 | 13 | | amended by adding Section 121.159 to read as follows: |
---|
14 | 14 | | Sec. 121.159. PRIORITY OF NATURAL GAS DELIVERY DURING |
---|
15 | 15 | | CURTAILMENT EVENT. (a) In this section, "human needs customers" |
---|
16 | 16 | | includes: |
---|
17 | 17 | | (1) residences, hospitals, water and wastewater |
---|
18 | 18 | | facilities, and police, fire, and military and civil defense |
---|
19 | 19 | | facilities; |
---|
20 | 20 | | (2) other locations where people may congregate in an |
---|
21 | 21 | | emergency; |
---|
22 | 22 | | (3) small commercial customers that cannot |
---|
23 | 23 | | practicably be curtailed without curtailing human needs; |
---|
24 | 24 | | (4) natural-gas-fired electric generation facilities; |
---|
25 | 25 | | and |
---|
26 | 26 | | (5) any other customers identified by rule by the |
---|
27 | 27 | | railroad commission. |
---|
28 | 28 | | (b) A gas utility that determines that the utility's ability |
---|
29 | 29 | | to deliver natural gas may become inadequate to support continuous |
---|
30 | 30 | | service to customers on the utility's intrastate system and that |
---|
31 | 31 | | reduces intrastate deliveries to one or more customers shall |
---|
32 | 32 | | prioritize natural gas deliveries to natural-gas-fired electric |
---|
33 | 33 | | generation facilities at the same level as natural gas deliveries |
---|
34 | 34 | | to other human needs customers and local distribution systems that |
---|
35 | 35 | | serve those human needs customers. |
---|
36 | 36 | | SECTION 2. This Act takes effect September 1, 2025. |
