77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of code enforcement officers and code
1010 enforcement officers in training.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1952.001, Occupations Code, is amended
1313 by amending Subdivisions (2) and (2-a) and adding Subdivision (2-b)
1414 to read as follows:
1515 (2) "Code enforcement officer" means an individual
1616 who:
1717 (A) works for [agent of] this state or a
1818 political subdivision of this state; and
1919 (B) [who] engages in code enforcement.
2020 (2-a) "Code enforcement officer in training" means an
2121 individual who:
2222 (A) works for this state or a political
2323 subdivision of this state; and
2424 (B) engages in code enforcement under the
2525 supervision of a code enforcement officer registered under this
2626 chapter.
2727 (2-b) "Commission" means the Texas Commission of
2828 Licensing and Regulation.
2929 SECTION 2. Section 1952.002, Occupations Code, is amended
3030 to read as follows:
3131 Sec. 1952.002. EXEMPTION FROM REGISTRATION. An individual
3232 [A person] is not required to be registered under this chapter if
3333 the individual [person]:
3434 (1) is required to be licensed or registered under
3535 another law of this state; and
3636 (2) engages in code enforcement under that license or
3737 registration.
3838 SECTION 3. Section 1952.003, Occupations Code, is amended
3939 to read as follows:
4040 Sec. 1952.003. EMPLOYMENT OF REGISTERED INDIVIDUAL
4141 [PERSON] NOT REQUIRED. This state or a political subdivision of
4242 this state may engage in code enforcement without employing an
4343 individual [a person] registered under this chapter, if the
4444 individual who is engaging in code enforcement for the state or
4545 political subdivision is exempt from registration under Section
4646 1952.002.
4747 SECTION 4. Section 1952.101, Occupations Code, is amended
4848 to read as follows:
4949 Sec. 1952.101. REGISTRATION REQUIRED. Except as permitted
5050 by Section 1952.002, an individual [a person] may not claim to be a
5151 code enforcement officer or use the title "code enforcement
5252 officer" unless the individual [person] holds a valid certificate
5353 of registration under this chapter.
5454 SECTION 5. Section 1952.102, Occupations Code, is amended
5555 to read as follows:
5656 Sec. 1952.102. ELIGIBILITY TO REGISTER AS CODE ENFORCEMENT
5757 OFFICER. To be eligible to receive a certificate of registration as
5858 a code enforcement officer, an individual [a person] must:
5959 (1) submit an application in the manner and on the form
6060 prescribed by the executive director;
6161 (2) have at least one year of full-time experience in
6262 the field of code enforcement;
6363 (3) pass the examination required by the department;
6464 (4) pay the application fee[, examination, and
6565 registration fees]; and
6666 (5) meet any other requirements prescribed by this
6767 chapter or by commission rule.
6868 SECTION 6. Section 1952.103(c), Occupations Code, is
6969 amended to read as follows:
7070 (c) A code enforcement officer in training may engage in
7171 code enforcement under the supervision of a [registered] code
7272 enforcement officer registered under this chapter.
7373 SECTION 7. Section 1952.104, Occupations Code, is amended
7474 to read as follows:
7575 Sec. 1952.104. RECIPROCAL REGISTRATION. On proper
7676 application, the department shall issue a certificate of
7777 registration to a license holder or registrant of another state
7878 that has requirements for the licensing or registration of a code
7979 enforcement officer that are at least substantially equivalent to
8080 those of this state.
8181 SECTION 8. Section 1952.105(a), Occupations Code, is
8282 amended to read as follows:
8383 (a) A certificate of registration issued under this chapter
8484 expires on the second anniversary of the date of issuance and may be
8585 renewed biennially on proper application, payment of the required
8686 renewal fee, and [on] completion of the continuing education
8787 requirements prescribed by commission rule.
8888 SECTION 9. Section 1952.151(a), Occupations Code, is
8989 amended to read as follows:
9090 (a) The commission or executive director may deny an
9191 individual's [a person's] application for a certificate of
9292 registration if the individual's [person's] certificate or license
9393 to engage in code enforcement or a related profession has been
9494 revoked by another licensing entity in this state or another state
9595 for:
9696 (1) unprofessional conduct;
9797 (2) fraud, deceit, or negligence; or
9898 (3) misconduct in the practice of code enforcement or
9999 a related profession.
100100 SECTION 10. This Act takes effect September 1, 2025.
