77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of sanitarians and sanitarians in
1010 training.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1953.001, Occupations Code, is amended
1313 by amending Subdivision (3) and adding Subdivision (3-a) to read as
1414 follows:
1515 (3) "Sanitarian" means an individual [a person]
1616 trained in sanitary science to perform duties relating to education
1717 and inspections in environmental sanitation.
1818 (3-a) "Sanitarian in training" means an individual
1919 training in sanitary science while engaged in sanitation.
2020 SECTION 2. Section 1953.003, Occupations Code, is amended
2121 to read as follows:
2222 Sec. 1953.003. EXEMPTIONS. This chapter does not apply to
2323 an individual [a person], including a physician, dentist, engineer,
2424 or veterinarian, who is licensed by an agency of this state other
2525 than the department and who, by nature of the individual's
2626 [person's] employment or duties, might be construed as being
2727 subject to this chapter.
2828 SECTION 3. Section 1953.101, Occupations Code, is amended
2929 to read as follows:
3030 Sec. 1953.101. REGISTRATION REQUIRED. An individual [A
3131 person] who engages or offers to engage in work in sanitation may
3232 not represent that the individual [person] is a sanitarian or use a
3333 title containing the word "sanitarian" unless the individual
3434 [person] holds a certificate of registration under this chapter.
3535 SECTION 4. Section 1953.102, Occupations Code, is amended
3636 to read as follows:
3737 Sec. 1953.102. ELIGIBILITY REQUIREMENTS. (a) To be
3838 eligible to receive a certificate of registration as a
3939 [professional] sanitarian, an individual [a person] must:
4040 (1) hold at least a bachelor's degree from an
4141 accredited college or university that includes at least 30 semester
4242 hours in basic or applied science;
4343 (2) complete any additional training in the basic
4444 sciences or public health the department determines necessary to
4545 effectively serve as a [professional] sanitarian; and
4646 (3) have at least two years of full-time experience in
4747 sanitation.
4848 (b) The commission by rule may establish additional [other]
4949 qualifications for registration.
5050 SECTION 5. The heading to Section 1953.104, Occupations
5151 Code, is amended to read as follows:
5252 Sec. 1953.104. ISSUANCE OF CERTIFICATE: [PROFESSIONAL]
5353 SANITARIAN; TERM.
5454 SECTION 6. Section 1953.104(a), Occupations Code, is
5555 amended to read as follows:
5656 (a) The department shall issue a certificate of
5757 registration as a [professional] sanitarian to an individual [a
5858 person] who:
5959 (1) applies in the manner and on the form prescribed by
6060 the executive director;
6161 (2) pays the registration fee set by the commission by
6262 rule;
6363 (3) meets the eligibility requirements prescribed by
6464 Section 1953.102 and commission rule; and
6565 (4) passes the [an] examination required by Section
6666 1953.151 [under Subchapter D].
6767 SECTION 7. Section 1953.105(a), Occupations Code, is
6868 amended to read as follows:
6969 (a) The department shall issue a certificate of
7070 registration as a sanitarian in training to an individual [a
7171 person] who:
7272 (1) is employed in sanitation;
7373 (2) meets the eligibility requirements prescribed by
7474 Section 1953.102, other than the requirements relating to
7575 experience;
7676 (3) has less than one year of full-time experience in
7777 sanitation;
7878 (4) pays a registration fee prescribed by the
7979 commission by rule for a sanitarian in training; and
8080 (5) [(4)] passes an examination under Subchapter D.
8181 SECTION 8. Section 1953.106, Occupations Code, is amended
8282 to read as follows:
8383 Sec. 1953.106. RENEWAL OF CERTIFICATE. The department
8484 shall [To] renew a certificate of registration under this chapter
8585 if the certificate holder [, a professional sanitarian must]:
8686 (1) pays [pay] to the department a renewal fee
8787 prescribed by the commission by rule; and
8888 (2) provides [provide] proof of completion of any
8989 applicable continuing education requirements prescribed by the
9090 commission by rule.
9191 SECTION 9. Section 1953.201(a), Occupations Code, is
9292 amended to read as follows:
9393 (a) The commission or executive director may deny an
9494 individual's [a person's] application for a certificate of
9595 registration if:
9696 (1) the individual's [person's] certificate or license
9797 to engage in a profession in this state or elsewhere has been
9898 revoked for unprofessional conduct, fraud, deceit, negligence, or
9999 misconduct in the practice of the profession; or
100100 (2) satisfactory proof is presented to the commission
101101 or executive director establishing that the individual [person] has
102102 been found guilty of unprofessional conduct, fraud, deceit,
103103 negligence, or misconduct in the practice of a profession.
104104 SECTION 10. Sections 1953.151(b) and (c), Occupations Code,
105105 are repealed.
106106 SECTION 11. This Act takes effect September 1, 2025.
