66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to clarity and certainty in the administration and
99 operation of Medicaid.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 32.0231, Human Resources Code, is
1212 amended by adding Subsection (a-1) to read as follows:
1313 (a-1) The commission through the rulemaking process
1414 established by Chapter 2001, Government Code, shall on a
1515 prospective basis determine whether to exclude or limit a benefit
1616 under the medical assistance program, unless the exclusion or
1717 limitation is required by state or federal law.
1818 SECTION 2. Subchapter K, Chapter 544, Government Code, as
1919 effective April 1, 2025, is amended by adding Subsection (j) to
2020 Section 544.0502 to read as follows:
2121 (j) Notwithstanding other law, the office of the inspector
2222 general may not recover under subsection (f) a payment made to a
2323 Medicaid provider as a result of waste or abuse discovered after the
2424 fourth anniversary of the date the payment was made to the provider.
2525 SECTION 3. Section 544.05021, Government Code, as added by
2626 this Act, applies to a payment for which recovery is sought on or
2727 after the effective date of this Act, regardless of the date on
2828 which the payment was made.
2929 SECTION 4. If before implementing any provision of this Act
3030 a state agency determines a waiver or authorization from a federal
3131 agency is necessary for implementation of that provision, the
3232 agency affected by the provision shall request the waiver or
3333 authorization and may delay implementing that provision until the
3434 waiver or authorization is granted.
3535 SECTION 5. This Act takes effect September 1, 2025.
