8 | 8 | | relating to clarity and certainty in the administration and |
---|
9 | 9 | | operation of Medicaid. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 32.0231, Human Resources Code, is |
---|
12 | 12 | | amended by adding Subsection (a-1) to read as follows: |
---|
13 | 13 | | (a-1) The commission through the rulemaking process |
---|
14 | 14 | | established by Chapter 2001, Government Code, shall on a |
---|
15 | 15 | | prospective basis determine whether to exclude or limit a benefit |
---|
16 | 16 | | under the medical assistance program, unless the exclusion or |
---|
17 | 17 | | limitation is required by state or federal law. |
---|
18 | 18 | | SECTION 2. Subchapter K, Chapter 544, Government Code, as |
---|
19 | 19 | | effective April 1, 2025, is amended by adding Subsection (j) to |
---|
20 | 20 | | Section 544.0502 to read as follows: |
---|
21 | 21 | | (j) Notwithstanding other law, the office of the inspector |
---|
22 | 22 | | general may not recover under subsection (f) a payment made to a |
---|
23 | 23 | | Medicaid provider as a result of waste or abuse discovered after the |
---|
24 | 24 | | fourth anniversary of the date the payment was made to the provider. |
---|
25 | 25 | | SECTION 3. Section 544.05021, Government Code, as added by |
---|
26 | 26 | | this Act, applies to a payment for which recovery is sought on or |
---|
27 | 27 | | after the effective date of this Act, regardless of the date on |
---|
28 | 28 | | which the payment was made. |
---|
29 | 29 | | SECTION 4. If before implementing any provision of this Act |
---|
30 | 30 | | a state agency determines a waiver or authorization from a federal |
---|
31 | 31 | | agency is necessary for implementation of that provision, the |
---|
32 | 32 | | agency affected by the provision shall request the waiver or |
---|
33 | 33 | | authorization and may delay implementing that provision until the |
---|
34 | 34 | | waiver or authorization is granted. |
---|
35 | 35 | | SECTION 5. This Act takes effect September 1, 2025. |
