11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 305, Local Government Code, is amended | |
13 | 13 | by adding Subchapter C to read as follows: | |
14 | 14 | SUBCHAPTER C. LIGHTING | |
15 | 15 | Sec. 305.051. LIGHTS OUT POLICY. (a) In this section: | |
16 | 16 | (1) "Migration season" means the periods of time: | |
17 | 17 | (A) beginning April 1 and ending June 1; and | |
18 | 18 | (B) beginning September 1 and ending November 1. | |
19 | 19 | (2) "Nonessential outdoor lighting" means lighting | |
20 | 20 | that is viewable outdoors and is not considered essential for | |
21 | 21 | safety or functionality, as determined by a political subdivision. | |
22 | 22 | (b) The governing body of a political subdivision shall | |
23 | 23 | adopt an ordinance, order, or regulation that requires nonessential | |
24 | 24 | outdoor lighting owned or operated by the political subdivision to | |
25 | 25 | be: | |
26 | 26 | (1) turned off between the hours of 11 p.m. and 6 a.m. | |
27 | 27 | during migration season; | |
28 | 28 | (2) reduced in natural spaces, including in trees and | |
29 | 29 | gardens; and | |
30 | 30 | (3) as applicable, aimed downward and to use light | |
31 | 31 | shields or motion detectors to reduce the amount of light shining | |
32 | 32 | into the sky or trees. | |
33 | 33 | SECTION 2. This Act takes effect September 1, 2025. |
