77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a lighting reduction policy for nonessential outdoor
1010 lighting owned or operated by a political subdivision.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 305, Local Government Code, is amended
1313 by adding Subchapter C to read as follows:
1414 SUBCHAPTER C. LIGHTING
1515 Sec. 305.051. LIGHTS OUT POLICY. (a) In this section:
1616 (1) "Migration season" means the periods of time:
1717 (A) beginning April 1 and ending June 1; and
1818 (B) beginning September 1 and ending November 1.
1919 (2) "Nonessential outdoor lighting" means lighting
2020 that is viewable outdoors and is not considered essential for
2121 safety or functionality, as determined by a political subdivision.
2222 (b) The governing body of a political subdivision shall
2323 adopt an ordinance, order, or regulation that requires nonessential
2424 outdoor lighting owned or operated by the political subdivision to
2525 be:
2626 (1) turned off between the hours of 11 p.m. and 6 a.m.
2727 during migration season;
2828 (2) reduced in natural spaces, including in trees and
2929 gardens; and
3030 (3) as applicable, aimed downward and to use light
3131 shields or motion detectors to reduce the amount of light shining
3232 into the sky or trees.
3333 SECTION 2. This Act takes effect September 1, 2025.
