611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to transfer of the ownership rights of the Woodlawn Water
914 Supply Corporation to the Angelina and Neches River Authority.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. DEFINITIONS. In this Act:
1217 (1) "Authority" means the Angelina and Neches River
1318 Authority.
1419 (2) "Corporation" means the Woodlawn Water Supply
1520 Corporation.
1621 SECTION 2. TRANSFER OF WATER SUPPLY CORPORATION; ASSETS;
1722 DISSOLUTION. (a) The authority may enter into a contract with the
1823 corporation to transfer the assets, debts, and contractual rights
1924 and obligations of the corporation to the authority.
2025 (b) On the date a contract is executed as provided by
2126 Subsection (a) of this section:
2227 (1) all real property, easements, appurtenances,
2328 conveyance systems, transmission and treatment systems, designated
2429 rights-of-way, and other property interests of the corporation are
2530 transferred to the authority;
2631 (2) Certificate of Convenience and Necessity
2732 No. 10354 is considered to be held by the authority; and
2833 (3) the board of directors of the corporation shall
2934 notify:
3035 (A) the Texas Commission on Environmental
3136 Quality of the transfer of the corporation to the authority; and
3237 (B) the Public Utility Commission of Texas of the
3338 transfer of Certificate of Convenience and Necessity No. 10354 to
3439 the authority.
3540 (c) On receipt of notice under Subsection (b)(3)(B) of this
3641 section, the Public Utility Commission of Texas shall note in its
3742 records that Certificate of Convenience and Necessity No. 10354 is
3843 held by the authority and shall reissue the certificate in the name
3944 of the authority without further application, notice, or hearing.
4045 A person, party, or entity does not have any right of protest,
4146 objection, or administrative review of the transfer prescribed by
4247 this section.
4348 (d) Not later than 30 days after the date of the transfer
4449 under Subsection (b) of this section, the board of directors of the
4550 corporation shall commence dissolution proceedings of the
4651 corporation.
4752 SECTION 3. EFFECTIVE DATE. This Act takes effect
4853 immediately if it receives a vote of two-thirds of all the members
4954 elected to each house, as provided by Section 39, Article III, Texas
5055 Constitution. If this Act does not receive the vote necessary for
5156 immediate effect, this Act takes effect September 1, 2025.
