8	8	AN ACT
9	9	relating to availability of claims contact information for personal
10	10	and commercial property and casualty insurers.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 32.101, Insurance Code, is amended to
13	13	read as follows:
14	14	Sec. 32.101. APPLICABILITY OF SUBCHAPTER. Except as
15	15	otherwise provided by this subchapter, this [This] subchapter
16	16	applies to insurers who comprise the top 25 insurance groups in the
17	17	national market and who issue residential property insurance or
18	18	personal automobile insurance policies in this state, including a
19	19	Lloyd's plan, a reciprocal or interinsurance exchange, a county
20	20	mutual insurance company, a farm mutual insurance company, the
21	21	Texas Windstorm Insurance Association, the FAIR Plan Association,
22	22	and the Texas Automobile Insurance Plan Association.
23	23	SECTION 2. Subchapter D, Chapter 32, Insurance Code, is
24	24	amended by adding Section 32.1025 to read as follows:
25	25	Sec. 32.1025. CLAIMS CONTACT INFORMATION. (a)
26	26	Notwithstanding Section 32.101, this section applies to each
27	27	insurer writing personal or commercial property or casualty
28	28	insurance in this state, including a Lloyd's plan, a reciprocal or
29	29	interinsurance exchange, a county mutual insurance company, a farm
30	30	mutual insurance company, the Texas Windstorm Insurance
31	31	Association, the FAIR Plan Association, and the Texas Automobile
32	32	Insurance Plan Association.
33	33	(b) The department shall establish and maintain an Internet
34	34	website that lists each insurer writing personal or commercial
35	35	property or casualty insurance in this state and provides for each
36	36	insurer:
37	37	(1) a telephone number used to file a claim with the
38	38	insurer; or
39	39	(2) a link to the Internet website used to file a claim
40	40	with the insurer.
41	41	SECTION 3. Section 32.103, Insurance Code, is amended to
42	42	read as follows:
43	43	Sec. 32.103. PUBLIC INFORMATION CONCERNING INTERNET
44	44	WEBSITE. The department shall publicize the existence of an [the]
45	45	Internet website required by this subchapter.
46	46	SECTION 4. Section 32.104, Insurance Code, is amended to
47	47	read as follows:
48	48	Sec. 32.104. DUTIES OF INSURER. (a) On the request of the
49	49	department, an insurer, including an insurer to which Section
50	50	32.1025 applies, shall provide to the department any information
51	51	the department and the office of public insurance counsel determine
52	52	is reasonable or necessary to fulfill the department's and the
53	53	office of the public insurance counsel's duties under this
54	54	subchapter.
55	55	(b) An insurer shall provide in a conspicuous manner with
56	56	each residential property insurance or personal automobile
57	57	insurance policy issued in this state notice of the Internet
58	58	website required by Section 32.102 [this subchapter]. The
59	59	commissioner shall determine the form and content of the notice.
60	60	SECTION 5. This Act takes effect September 1, 2025.
