711 A BILL TO BE ENTITLED
812 AN ACT
913 relating to memorial markers for certain officers killed in the
1014 line of duty.
1115 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1216 SECTION 1. Section 225.021(c), Transportation Code, is
1317 amended to read as follows:
1418 (c) Except as provided by Section 225.0215, the [The]
1519 department may not design, construct, or erect a marker under this
1620 subchapter unless a grant or donation of funds is made to the
1721 department to cover the cost of the design, construction, and
1822 erection of the marker.
1923 SECTION 2. Subchapter B, Chapter 225, Transportation Code,
2024 is amended by adding Section 225.0215 to read as follows:
2125 Sec. 225.0215. MEMORIAL MARKERS FOR CERTAIN OFFICERS KILLED
2226 IN LINE OF DUTY. (a) This section applies only to a marker required
2327 under this subchapter designating a part of the highway system,
2428 including a bridge or street, for an individual killed in the line
2529 of duty who was:
2630 (1) a law enforcement officer or peace officer for
2731 this state or a political subdivision of this state under Article
2832 2A.001, Code of Criminal Procedure; or
2933 (2) a federal law enforcement officer or special agent
3034 performing duties in this state, including those officers under
3135 Article 2A.002, Code of Criminal Procedure.
3236 (b) Notwithstanding Section 225.021(c), the department may
3337 design, construct, or erect a marker to which this section applies
3438 using:
3539 (1) money appropriated from the general revenue fund
3640 to the department for those purposes; and
3741 (2) gifts, grants, and donations accepted by the
3842 department for those purposes.
3943 SECTION 3. This Act takes effect September 1, 2025.
