| 11 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 16 | | SECTION 1. Section 225.021(c), Transportation Code, is |
|---|
| 13 | 17 | | amended to read as follows: |
|---|
| 14 | 18 | | (c) Except as provided by Section 225.0215, the [The] |

| 15 | 19 | | department may not design, construct, or erect a marker under this |
|---|
| 16 | 20 | | subchapter unless a grant or donation of funds is made to the |
|---|
| 17 | 21 | | department to cover the cost of the design, construction, and |
|---|
| 18 | 22 | | erection of the marker. |

| 19 | 23 | | SECTION 2. Subchapter B, Chapter 225, Transportation Code, |
|---|
| 20 | 24 | | is amended by adding Section 225.0215 to read as follows: |
|---|
| 21 | 25 | | Sec. 225.0215. MEMORIAL MARKERS FOR CERTAIN OFFICERS KILLED |
|---|
| 22 | 26 | | IN LINE OF DUTY. (a) This section applies only to a marker required |
|---|
| 23 | 27 | | under this subchapter designating a part of the highway system, |
|---|
| 24 | 28 | | including a bridge or street, for an individual killed in the line |
|---|
| 25 | 29 | | of duty who was: |
|---|
| 26 | 30 | | (1) a law enforcement officer or peace officer for |
|---|
| 27 | 31 | | this state or a political subdivision of this state under Article |
|---|
| 28 | 32 | | 2A.001, Code of Criminal Procedure; or |
|---|
| 29 | 33 | | (2) a federal law enforcement officer or special agent |
|---|
| 30 | 34 | | performing duties in this state, including those officers under |
|---|
| 31 | 35 | | Article 2A.002, Code of Criminal Procedure. |
|---|
| 32 | 36 | | (b) Notwithstanding Section 225.021(c), the department may |
|---|
| 33 | 37 | | design, construct, or erect a marker to which this section applies |
|---|
| 34 | 38 | | using: |
|---|
| 35 | 39 | | (1) money appropriated from the general revenue fund |
|---|
| 36 | 40 | | to the department for those purposes; and |
|---|
| 37 | 41 | | (2) gifts, grants, and donations accepted by the |
|---|
| 38 | 42 | | department for those purposes. |
|---|
| 39 | 43 | | SECTION 3. This Act takes effect September 1, 2025. |
