77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to employer contributions for retirees of the Teacher
1010 Retirement System of Texas who resume certain employment with a
1111 public school.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 825.4092, Government Code, is amended by
1414 amending Subsection (b) and adding Subsection (b-1) to read as
1515 follows:
1616 (b) Except as provided by Subsection (e) and subject to
1717 Subsection (b-1), during each payroll period for which a retiree is
1818 reported, the employer shall contribute to the retirement system
1919 for each retiree reported an amount based on the retiree's salary
2020 equal to the difference between [sum of]:
2121 (1) the sum of:
2222 (A) the current contribution amount that would be
2323 contributed by the retiree if the retiree were an active,
2424 contributing member; and
2525 (B) [(2)] the current contribution amount
2626 authorized by the General Appropriations Act that the state would
2727 contribute for that retiree if the retiree were an active,
2828 contributing member; and
2929 (2) as determined by the actuary of the retirement
3030 system, an amount equal to a percentage of the retiree's
3131 compensation attributable to the payroll period where the
3232 percentage is the estimated normal cost of the retirement system
3333 for the current year expressed as a percentage of aggregate annual
3434 compensation of all members of the retirement system.
3535 (b-1) Subsection (b) applies only if the amount under
3636 Subsection (b)(1) exceeds the amount under Subsection (b)(2). If
3737 during a payroll period the amount under Subsection (b)(2) exceeds
3838 the amount under Subsection (b)(1), the employer is not required to
3939 make a contribution under Subsection (b).
4040 SECTION 2. The changes in law made by this Act apply
4141 beginning with the 2025-2026 school year.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
