| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 341.036, Health and Safety Code, is | |
| 13 | 13 | amended by adding Subsection (b-1) to read as follows: | |
| 14 | 14 | (b-1) The commission by order may require a public drinking | |
| 15 | 15 | water supply system that obtains its water supply from an | |
| 16 | 16 | underground source to install a filtration system for the well for | |
| 17 | 17 | that source if: | |
| 18 | 18 | (1) the commission has previously recommended that the | |
| 19 | 19 | public water system install a filtration system for the well for | |
| 20 | 20 | that source; and | |
| 21 | 21 | (2) the public water system: | |
| 22 | 22 | (A) has not maintained the well for that source | |
| 23 | 23 | in accordance with commission rules; or | |
| 24 | 24 | (B) has been the subject of more than one | |
| 25 | 25 | complaint concerning that source submitted to the commission during | |
| 26 | 26 | the previous year. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
