88 AN ACT
99 relating to the participation of certain counties in joint planning
1010 in groundwater management areas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 36, Water Code, is amended
1313 by adding Section 36.1087 to read as follows:
1414 Sec. 36.1087. PARTICIPATION OF CERTAIN COUNTIES IN JOINT
1515 PLANNING FOR MANAGEMENT AREA. (a) A county that is located wholly
1616 or partly in a management area and that does not have within its
1717 boundaries a district located in the management area may
1818 participate in the joint planning process as provided by Sections
1919 36.108 and 36.1081 through a representative designated by the
2020 governing body of the county.
2121 (b) A representative appointed under Subsection (a) is
2222 entitled to participate in the joint planning process in the same
2323 manner as a district representative in order to promote the
2424 county's interests in regional groundwater planning. The
2525 representative may present to the joint planning process
2626 information regarding desired future conditions and estimates of
2727 groundwater resources and availability.
2828 (c) The commission and the Texas Water Development Board
2929 shall provide to a county that has designated a representative
3030 under this section technical assistance in the joint planning
3131 process as necessary to further the county's interests in the
3232 outcome of the process.
3333 SECTION 2. This Act takes effect September 1, 2025.
