| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter D, Chapter 36, Water Code, is amended |
|---|
| 13 | 13 | | by adding Section 36.1087 to read as follows: |
|---|
| 14 | 14 | | Sec. 36.1087. PARTICIPATION OF CERTAIN COUNTIES IN JOINT |
|---|
| 15 | 15 | | PLANNING FOR MANAGEMENT AREA. (a) A county that is located wholly |
|---|
| 16 | 16 | | or partly in a management area and that does not have within its |
|---|
| 17 | 17 | | boundaries a district located in the management area may |
|---|
| 18 | 18 | | participate in the joint planning process as provided by Sections |
|---|
| 19 | 19 | | 36.108 and 36.1081 through a representative designated by the |
|---|
| 20 | 20 | | governing body of the county. |
|---|
| 21 | 21 | | (b) A representative appointed under Subsection (a) is |
|---|
| 22 | 22 | | entitled to participate in the joint planning process in the same |
|---|
| 23 | 23 | | manner as a district representative in order to promote the |
|---|
| 24 | 24 | | county's interests in regional groundwater planning. The |
|---|
| 25 | 25 | | representative may present to the joint planning process |
|---|
| 26 | 26 | | information regarding desired future conditions and estimates of |
|---|
| 27 | 27 | | groundwater resources and availability. |
|---|
| 28 | 28 | | (c) The commission and the Texas Water Development Board |
|---|
| 29 | 29 | | shall provide to a county that has designated a representative |
|---|
| 30 | 30 | | under this section technical assistance in the joint planning |
|---|
| 31 | 31 | | process as necessary to further the county's interests in the |
|---|
| 32 | 32 | | outcome of the process. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
