77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to liability protections for commercial space flight and
1010 exploration.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 100A.001(5), Civil Practice and Remedies
1313 Code, is amended to read as follows:
1414 (5) "Space flight participant" means an individual[,
1515 who is not crew,] carried aboard a spacecraft, launch vehicle, or
1616 reentry vehicle.
1717 SECTION 2. Section 100A.003(b), Civil Practice and Remedies
1818 Code, is amended to read as follows:
1919 (b) An agreement under Subsection (a) is considered
2020 effective and enforceable if it is:
2121 (1) in writing;
2222 (2) in a document separate from any other agreement
2323 between the space flight participant and the space flight entity
2424 other than a different warning, consent, or assumption of risk
2525 statement;
2626 (3) printed in not less than 10-point bold type; and
2727 (4) signed by the space flight participant on behalf
2828 of the space flight participant and any heirs, executors,
2929 administrators, representatives, attorneys, successors, and
3030 assignees of the space flight participant[; and
3131 [(5) signed by a competent witness].
3232 SECTION 3. Chapter 100A, Civil Practice and Remedies Code,
3333 is amended by adding Section 100A.005 to read as follows:
3434 Sec. 100A.005. RECOGNITION OF RECIPROCAL WAIVER OF CLAIMS.
3535 A reciprocal waiver of claims between parties engaged in space
3636 flight activities under the Federal Aviation Regulations in 14
3737 C.F.R. Section 440.17 is effective and enforceable in this state,
3838 including a waiver by a contractor, subcontractor, or customer of
3939 any party participating in a space flight activity.
4040 SECTION 4. The change in law made by this Act applies only
4141 to a cause of action that accrues on or after the effective date of
4242 this Act. A cause of action that accrues before the effective date
4343 of this Act is governed by the law applicable to the cause of action
4444 immediately before the effective date of this Act, and that law is
4545 continued in effect for that purpose.
4646 SECTION 5. This Act takes effect September 1, 2025.
