| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter D, Chapter 33, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 33.0813 to read as follows: |
|---|
| 15 | 15 | | Sec. 33.0813. UNIVERSITY INTERSCHOLASTIC LEAGUE POSTSEASON |
|---|
| 16 | 16 | | BROADCAST AGREEMENTS. (a) In this section: |
|---|
| 17 | 17 | | (1) "Local broadcaster" means a radio or television |
|---|
| 18 | 18 | | station that broadcasts over radio, television, or a live streaming |
|---|
| 19 | 19 | | platform live or recorded audio or video coverage of student |
|---|
| 20 | 20 | | activity for a school in a local broadcast area, including a |
|---|
| 21 | 21 | | student-organized broadcast offered as an educational course or |
|---|
| 22 | 22 | | program by the school. |
|---|
| 23 | 23 | | (2) "Postseason activity" means a University |
|---|
| 24 | 24 | | Interscholastic League sponsored activity that occurs after the |
|---|
| 25 | 25 | | conclusion of a regular sport season, including a single game or |
|---|
| 26 | 26 | | tournament. |
|---|
| 27 | 27 | | (b) Notwithstanding any agreement executed by the |
|---|
| 28 | 28 | | University Interscholastic League authorizing a private entity to |
|---|
| 29 | 29 | | provide exclusive broadcast coverage for a postseason activity of |
|---|
| 30 | 30 | | students representing a member school, a local broadcaster may |
|---|
| 31 | 31 | | provide broadcast coverage of the postseason activity if the local |
|---|
| 32 | 32 | | broadcaster: |
|---|
| 33 | 33 | | (1) broadcasts a majority of the students' activities |
|---|
| 34 | 34 | | in a regular season under a valid agreement with the school; and |
|---|
| 35 | 35 | | (2) complies with any agreement executed under |
|---|
| 36 | 36 | | Subsection (c). |
|---|
| 37 | 37 | | (c) The University Interscholastic League may require a |
|---|
| 38 | 38 | | local broadcaster to execute an agreement to provide postseason |
|---|
| 39 | 39 | | broadcasting coverage authorized under Subsection (b) that |
|---|
| 40 | 40 | | includes provisions: |
|---|
| 41 | 41 | | (1) requiring the local broadcaster to pay reasonable |
|---|
| 42 | 42 | | compensation to the University Interscholastic League for a video |
|---|
| 43 | 43 | | broadcast; |
|---|
| 44 | 44 | | (2) requiring approval by the site hosting the |
|---|
| 45 | 45 | | postseason activity of the local broadcaster's coverage; |
|---|
| 46 | 46 | | (3) establishing limitations on the type of |
|---|
| 47 | 47 | | organizations the local broadcaster may arrange as sponsors for the |
|---|
| 48 | 48 | | broadcast; and |
|---|
| 49 | 49 | | (4) requiring the local broadcaster to provide |
|---|
| 50 | 50 | | competent and professional announcers for the broadcast. |
|---|
| 51 | 51 | | (d) The University Interscholastic League may not execute |
|---|
| 52 | 52 | | an agreement authorizing a private entity to provide exclusive |
|---|
| 53 | 53 | | postseason broadcast coverage that conflicts with this section. |
|---|
| 54 | 54 | | SECTION 2. Section 33.0813, Education Code, as added by |
|---|
| 55 | 55 | | this Act, applies only to an agreement between the University |
|---|
| 56 | 56 | | Interscholastic League and a local broadcaster to provide broadcast |
|---|
| 57 | 57 | | coverage of a postseason activity of students representing member |
|---|
| 58 | 58 | | schools that is entered into on or after the effective date of this |
|---|
| 59 | 59 | | Act. |
|---|
| 60 | 60 | | SECTION 3. This Act takes effect September 1, 2025. |
