77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to protections for certain military dependents enrolled in
1010 a public school.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 25, Education Code, is
1313 amended by adding Section 25.906 to read as follows:
1414 Sec. 25.906. PROTECTIONS FOR CERTAIN MILITARY DEPENDENTS.
1515 (a) In this section:
1616 (1) "Compact" means the Interstate Compact on
1717 Educational Opportunity for Military Children executed under
1818 Section 162.002.
1919 (2) "Uniformed services" means:
2020 (A) the United States Army, Navy, Air Force,
2121 Space Force, Marine Corps, or Coast Guard;
2222 (B) the Commissioned Corps of the National
2323 Oceanic and Atmospheric Administration; or
2424 (C) the Commissioned Corps of the United States
2525 Public Health Service.
2626 (b) The provisions of Articles IV, V, VI, and VII of the
2727 compact apply to the following children as if those children were
2828 children described by Article III of the compact:
2929 (1) a child of a veteran of the uniformed services who
3030 was discharged or released through retirement, for a period of four
3131 years after the date of the veteran's retirement, if the veteran
3232 returns to the veteran's home of record on military orders; and
3333 (2) a child of a member of the uniformed services who
3434 dies on active duty or as a result of injuries sustained on active
3535 duty, for a period of four years after the member's death.
3636 (c) Each school district and open-enrollment charter school
3737 that maintains an Internet website shall post on the district's or
3838 school's Internet website an easily accessible link to information
3939 regarding the compact and the additional protections provided by
4040 this section.
4141 SECTION 2. This Act applies beginning with the 2025-2026
4242 school year.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2025.
