77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of children enrolled in a special
1010 education program for free prekindergarten programs in public
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 29.153(b), Education Code, is amended to
1414 read as follows:
1515 (b) A child is eligible for enrollment in a prekindergarten
1616 class under this section if the child is at least three years of age
1717 and:
1818 (1) is unable to speak and comprehend the English
1919 language;
2020 (2) is educationally disadvantaged;
2121 (3) is homeless, regardless of the residence of the
2222 child, of either parent of the child, or of the child's guardian or
2323 other person having lawful control of the child;
2424 (4) is the child of an active duty member of the armed
2525 forces of the United States, including the state military forces or
2626 a reserve component of the armed forces, who is ordered to active
2727 duty by proper authority;
2828 (5) is the child of a member of the armed forces of the
2929 United States, including the state military forces or a reserve
3030 component of the armed forces, who was injured or killed while
3131 serving on active duty;
3232 (6) is or ever has been in:
3333 (A) the conservatorship of the Department of
3434 Family and Protective Services following an adversary hearing held
3535 as provided by Section 262.201, Family Code; or
3636 (B) foster care in another state or territory, if
3737 the child resides in this state; [or]
3838 (7) is the child of a person eligible for the Star of
3939 Texas Award as:
4040 (A) a peace officer under Section 3106.002,
4141 Government Code;
4242 (B) a firefighter under Section 3106.003,
4343 Government Code; or
4444 (C) an emergency medical first responder under
4545 Section 3106.004, Government Code; or
4646 (8) receives special education services under
4747 Subchapter A.
4848 SECTION 2. This Act applies beginning with the 2025-2026
4949 school year.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
