| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 651, Government Code, is amended by |
|---|
| 12 | 12 | | adding Section 651.011 to read as follows: |
|---|
| 13 | 13 | | Sec. 651.011. CITIZENSHIP REQUIREMENT FOR LEADERSHIP OF |
|---|
| 14 | 14 | | ENTITIES ON HOMELAND SECURITY COUNCIL. (a) An employee of an entity |
|---|
| 15 | 15 | | described by Section 421.021(a) must be a citizen of the United |
|---|
| 16 | 16 | | States if the employee: |
|---|
| 17 | 17 | | (1) is the executive director of the entity; |
|---|
| 18 | 18 | | (2) is a deputy executive director of the entity; |
|---|
| 19 | 19 | | (3) is an assistant director of the entity; or |
|---|
| 20 | 20 | | (4) has a title that is functionally equivalent to a |
|---|
| 21 | 21 | | title described by Subdivisions (1) through (3). |
|---|
| 22 | 22 | | (b) The executive director of an entity described by Section |
|---|
| 23 | 23 | | 421.021(a) may extend the citizenship requirement under this |
|---|
| 24 | 24 | | section to any other position not listed under Subsection (a) if the |
|---|
| 25 | 25 | | position is allowed to interface with: |
|---|
| 26 | 26 | | (1) proprietary data or information deemed critical to |
|---|
| 27 | 27 | | the operation of the agency; or |
|---|
| 28 | 28 | | (2) systems that can influence the functionality of |
|---|
| 29 | 29 | | critical infrastructure. |
|---|
| 30 | 30 | | SECTION 2. Section 651.011, Government Code, as added by |
|---|
| 31 | 31 | | this Act, applies only to a person hired on or after the effective |
|---|
| 32 | 32 | | date of this Act. An employee hired before the effective date of |
|---|
| 33 | 33 | | this Act is governed by the law in effect immediately before the |
|---|
| 34 | 34 | | effective date of this Act, and the former law is continued in |
|---|
| 35 | 35 | | effect for that purpose. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2025. |
