77 AN ACT
88 relating to the citizenship status of certain employees of this
99 state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 651, Government Code, is amended by
1212 adding Section 651.011 to read as follows:
1313 Sec. 651.011. CITIZENSHIP REQUIREMENT FOR LEADERSHIP OF
1414 ENTITIES ON HOMELAND SECURITY COUNCIL. (a) An employee of an entity
1515 described by Section 421.021(a) must be a citizen of the United
1616 States if the employee:
1717 (1) is the executive director of the entity;
1818 (2) is a deputy executive director of the entity;
1919 (3) is an assistant director of the entity; or
2020 (4) has a title that is functionally equivalent to a
2121 title described by Subdivisions (1) through (3).
2222 (b) The executive director of an entity described by Section
2323 421.021(a) may extend the citizenship requirement under this
2424 section to any other position not listed under Subsection (a) if the
2525 position is allowed to interface with:
2626 (1) proprietary data or information deemed critical to
2727 the operation of the agency; or
2828 (2) systems that can influence the functionality of
2929 critical infrastructure.
3030 SECTION 2. Section 651.011, Government Code, as added by
3131 this Act, applies only to a person hired on or after the effective
3232 date of this Act. An employee hired before the effective date of
3333 this Act is governed by the law in effect immediately before the
3434 effective date of this Act, and the former law is continued in
3535 effect for that purpose.
3636 SECTION 3. This Act takes effect September 1, 2025.
