77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to establishing an advisory group to study potential means
1010 to finance costs of development and maintenance of electric
1111 transmission infrastructure.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. DEFINITION. In this Act, "work group" means the
1414 work group established under Section 2 of this Act.
1515 SECTION 2. WORK GROUP. The Transmission Cost Funding Work
1616 Group is composed of the following members:
1717 (1) one representative of the Public Utility
1818 Commission of Texas, appointed by the chair of the commission;
1919 (2) one representative of the independent
2020 organization certified under Section 39.151, Utilities Code, for
2121 the ERCOT power region, appointed by the chief executive officer of
2222 the independent organization;
2323 (3) two members of the Texas Senate, appointed by the
2424 lieutenant governor;
2525 (4) two members of the Texas House of Representatives,
2626 appointed by the speaker of the house of representatives;
2727 (5) one representative of the comptroller's office,
2828 appointed by the comptroller; and
2929 (6) the following members, appointed by the governor:
3030 (A) one representative of the office of the
3131 governor;
3232 (B) one representative of a consumer advocacy
3333 group;
3434 (C) one representative of a renewable energy
3535 organization; and
3636 (D) one representative each of:
3737 (i) the oil and gas industry;
3838 (ii) an investor-owned electric utility;
3939 (iii) a municipally owned electric utility;
4040 and
4141 (iv) an electric cooperative.
4242 SECTION 3. STUDY. The work group shall conduct a study of
4343 available means to finance the costs of development and maintenance
4444 of electric transmission infrastructure that may help to ensure the
4545 reliability, affordability, and long-term sustainability of the
4646 Texas power grid. The study must be designed to:
4747 (1) identify potential revenue sources, funding
4848 mechanisms, and incentives that may be dedicated to those costs,
4949 including:
5050 (A) legislative appropriations;
5151 (B) public-private partnerships;
5252 (C) utility surcharges or fees;
5353 (D) tax incentives;
5454 (E) infrastructure investment programs; and
5555 (F) reallocation of existing funds;
5656 (2) assess the financial feasibility and long-term
5757 sustainability of the revenue sources, funding mechanisms, and
5858 incentives described by Subdivision (1) of this section;
5959 (3) evaluate the potential effects of each of the
6060 revenue sources, funding mechanisms, and incentives described by
6161 Subdivision (1) of this section on consumers, utilities, and the
6262 economy of this state; and
6363 (4) compare and evaluate the revenue sources, funding
6464 mechanisms, and incentives applied to those costs by other states.
6565 SECTION 4. REPORT. Not later than December 1, 2026, the
6666 work group shall submit to the governor, the lieutenant governor,
6767 and the speaker of the house of representatives a written report
6868 that includes:
6969 (1) the findings of the study conducted under Section
7070 3 of this Act; and
7171 (2) any recommendations for legislative or other
7272 action related to the funding of electric transmission projects.
7373 SECTION 5. EXPIRATION. This Act expires September 1, 2027.
7474 SECTION 6. EFFECTIVE DATE. This Act takes effect
7575 immediately if it receives a vote of two-thirds of all the members
7676 elected to each house, as provided by Section 39, Article III, Texas
7777 Constitution. If this Act does not receive the vote necessary for
7878 immediate effect, this Act takes effect September 1, 2025.
