88 AN ACT
99 relating to a first responder peer support network for certain
1010 firefighters and law enforcement personnel.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle E, Title 2, Health and Safety Code, is
1313 amended by adding Chapter 115 to read as follows:
1414 CHAPTER 115. FIRST RESPONDER PEER SUPPORT NETWORK
1515 Sec. 115.001. DEFINITIONS. In this chapter:
1616 (1) "Law enforcement officer" means a person
1717 identified as a peace officer under Article 2A.001(1), (2), (3), or
1818 (4), Code of Criminal Procedure.
1919 (2) "Peer" means a person who is:
2020 (A) a firefighter or retired firefighter; or
2121 (B) a law enforcement officer or retired law
2222 enforcement officer.
2323 (3) "Peer support network" means the first responder
2424 peer support network for firefighters and law enforcement officers
2525 established under this chapter.
2626 Sec. 115.002. GENERAL POWERS AND DUTIES. (a) The Texas
2727 Commission on Fire Protection and Texas Commission on Law
2828 Enforcement shall jointly develop a first responder peer support
2929 network for firefighters and law enforcement officers. The network
3030 must include:
3131 (1) peer-to-peer support;
3232 (2) training for peer service coordinators and peers
3333 that incorporates suicide prevention training;
3434 (3) technical assistance for program development and
3535 the provision of technical assistance to peer service coordinators,
3636 licensed mental health professionals, and peers; and
3737 (4) identification, retention, and screening of
3838 licensed mental health professionals.
3939 (b) The Texas Commission on Fire Protection and Texas
4040 Commission on Law Enforcement shall ensure firefighters and law
4141 enforcement officers are provided support through the peer support
4242 network in both urban and rural jurisdictions.
4343 (c) The Texas Commission on Fire Protection and Texas
4444 Commission on Law Enforcement shall solicit and ensure the
4545 provision of specialized training to peers who want to provide
4646 peer-to-peer support and other peer-to-peer services under the peer
4747 support network.
4848 (d) The Texas Commission on Fire Protection and Texas
4949 Commission on Law Enforcement may adopt rules necessary to
5050 implement this chapter.
5151 Sec. 115.003. CONTRACT WITH INSTITUTION OF HIGHER
5252 EDUCATION. The Texas Commission on Fire Protection and Texas
5353 Commission on Law Enforcement may contract with an institution of
5454 higher education in this state that has appropriate expertise in
5555 mental health, firefighting, or law enforcement to develop the peer
5656 support network.
5757 Sec. 115.004. CONFIDENTIALITY OF PARTICIPANT INFORMATION.
5858 Information relating to a firefighter's or law enforcement
5959 officer's participation in peer-to-peer support and other
6060 peer-to-peer services under the peer support network is
6161 confidential and may not be disclosed under Chapter 552, Government
6262 Code, by:
6363 (1) the Texas Commission on Fire Protection or Texas
6464 Commission on Law Enforcement;
6565 (2) a fire department that employs a firefighter
6666 participant;
6767 (3) a law enforcement agency that employs a law
6868 enforcement officer participant; or
6969 (4) any other state agency or political subdivision in
7070 this state that employs a firefighter or law enforcement officer
7171 participant.
7272 Sec. 115.005. LICENSURE AND CERTIFICATION PROTECTIONS. A
7373 firefighter's or law enforcement officer's participation in
7474 peer-to-peer support and other peer-to-peer services under the peer
7575 support network may not:
7676 (1) serve as the basis for a revocation, suspension,
7777 or denial of a license or certification; or
7878 (2) be considered in any proceeding related to the
7979 firefighter's certification or the officer's licensure.
8080 Sec. 115.006. ANNUAL REPORT. Not later than December 1 of
8181 each year, the Texas Commission on Fire Protection and Texas
8282 Commission on Law Enforcement shall jointly prepare and submit to
8383 the governor and the legislature a written report that includes:
8484 (1) the number of firefighters and law enforcement
8585 officers who received peer support through the peer support
8686 network;
8787 (2) the number of peers and peer service coordinators
8888 trained;
8989 (3) an evaluation of the services provided under this
9090 chapter; and
9191 (4) recommendations for program improvements.
9292 SECTION 2. Subchapter M-1, Chapter 1701, Occupations Code,
9393 is repealed.
9494 SECTION 3. Not later than January 1, 2026, the Texas
9595 Commission on Fire Protection and Texas Commission on Law
9696 Enforcement shall develop the first responder peer support network
9797 for firefighters and law enforcement officers required by Chapter
9898 115, Health and Safety Code, as added by this Act.
9999 SECTION 4. This Act takes effect September 1, 2025.
