77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the disposal of exhibits used in criminal proceedings.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 2A.155, Code of Criminal Procedure, is
1212 amended by amending Subsections (a) and (b) and adding Subsection
1313 (b-1) to read as follows:
1414 (a) In this article, "eligible exhibit" means an exhibit
1515 filed with the clerk of a court that:
1616 (1) is not a firearm or contraband;
1717 (2) has not been ordered by the court to be returned to
1818 its owner; and
1919 (3) is not an exhibit in any other [another pending]
2020 criminal action that is pending final disposition.
2121 (b) An eligible exhibit may be disposed of as provided by
2222 this article:
2323 (1) on or after the first anniversary of the date on
2424 which a conviction becomes final in the case, if the case is a
2525 misdemeanor [or a felony for which the sentence imposed by the court
2626 is five years or less];
2727 (2) on or after the second anniversary of the date on
2828 which a conviction becomes final in the case, if the case is a
2929 [noncapital] felony for which the sentence imposed by the court is
3030 [greater than] five years or less;
3131 (3) on or after the 10th anniversary of the date on
3232 which a conviction becomes final in the case, if the case is a
3333 noncapital felony for which the sentence imposed by the court is
3434 greater than five years;
3535 (4) on or after the first anniversary of the date of
3636 the acquittal of the defendant; or
3737 (5) [(4)] on or after the first anniversary of the date
3838 of the death of the defendant.
3939 (b-1) Notwithstanding Subsection (b), if the exhibit is
4040 filed in the trial of more than one criminal case, an eligible
4141 exhibit may be disposed of beginning on the expiration of the
4242 longest period that remains applicable, calculated for each trial
4343 according to the dates specified under Subsections (b)(1), (2),
4444 (3), (4), and (5), on the date the exhibit becomes an eligible
4545 exhibit under Subsection (a).
4646 SECTION 2. This Act takes effect September 1, 2025.
