| 9 | 9 | | relating to the disposal of exhibits used in criminal proceedings. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article 2A.155, Code of Criminal Procedure, is |
|---|
| 12 | 12 | | amended by amending Subsections (a) and (b) and adding Subsection |
|---|
| 13 | 13 | | (b-1) to read as follows: |
|---|
| 14 | 14 | | (a) In this article, "eligible exhibit" means an exhibit |
|---|
| 15 | 15 | | filed with the clerk of a court that: |
|---|
| 16 | 16 | | (1) is not a firearm or contraband; |
|---|
| 17 | 17 | | (2) has not been ordered by the court to be returned to |
|---|
| 18 | 18 | | its owner; and |
|---|
| 19 | 19 | | (3) is not an exhibit in any other [another pending] |
|---|
| 20 | 20 | | criminal action that is pending final disposition. |
|---|
| 21 | 21 | | (b) An eligible exhibit may be disposed of as provided by |
|---|
| 22 | 22 | | this article: |
|---|
| 23 | 23 | | (1) on or after the first anniversary of the date on |
|---|
| 24 | 24 | | which a conviction becomes final in the case, if the case is a |
|---|
| 25 | 25 | | misdemeanor [or a felony for which the sentence imposed by the court |
|---|
| 26 | 26 | | is five years or less]; |
|---|
| 27 | 27 | | (2) on or after the second anniversary of the date on |
|---|
| 28 | 28 | | which a conviction becomes final in the case, if the case is a |
|---|
| 29 | 29 | | [noncapital] felony for which the sentence imposed by the court is |
|---|
| 30 | 30 | | [greater than] five years or less; |
|---|
| 31 | 31 | | (3) on or after the 10th anniversary of the date on |
|---|
| 32 | 32 | | which a conviction becomes final in the case, if the case is a |
|---|
| 33 | 33 | | noncapital felony for which the sentence imposed by the court is |
|---|
| 34 | 34 | | greater than five years; |
|---|
| 35 | 35 | | (4) on or after the first anniversary of the date of |
|---|
| 36 | 36 | | the acquittal of the defendant; or |
|---|
| 37 | 37 | | (5) [(4)] on or after the first anniversary of the date |
|---|
| 38 | 38 | | of the death of the defendant. |
|---|
| 39 | 39 | | (b-1) Notwithstanding Subsection (b), if the exhibit is |
|---|
| 40 | 40 | | filed in the trial of more than one criminal case, an eligible |
|---|
| 41 | 41 | | exhibit may be disposed of beginning on the expiration of the |
|---|
| 42 | 42 | | longest period that remains applicable, calculated for each trial |
|---|
| 43 | 43 | | according to the dates specified under Subsections (b)(1), (2), |
|---|
| 44 | 44 | | (3), (4), and (5), on the date the exhibit becomes an eligible |
|---|
| 45 | 45 | | exhibit under Subsection (a). |
|---|
| 46 | 46 | | SECTION 2. This Act takes effect September 1, 2025. |
