88 AN ACT
99 relating to the provision of information regarding certain public
1010 assistance programs by public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1313 amended by adding Section 38.045 to read as follows:
1414 Sec. 38.045. INFORMATION REGARDING CERTAIN PUBLIC
1515 ASSISTANCE PROGRAMS. (a) Each year and on a student's enrollment
1616 in a school district or open-enrollment charter school, the
1717 district or school shall provide to the student and the student's
1818 parent in any format the district or school determines appropriate
1919 information regarding the eligibility requirements for public
2020 assistance programs, including:
2121 (1) the medical assistance program under Chapter 32,
2222 Human Resources Code;
2323 (2) the child health plan program under Chapter 62,
2424 Health and Safety Code; and
2525 (3) the supplemental nutrition assistance program
2626 under Chapter 33, Human Resources Code.
2727 (b) The Health and Human Services Commission, in
2828 coordination with the agency, shall prepare and make available to
2929 school districts and open-enrollment charter schools in both
3030 physical and electronic formats a model form for the information
3131 required to be provided under Subsection (a).
3232 SECTION 2. This Act applies beginning with the 2025-2026
3333 school year.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
