77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the compensation, reimbursement of expenses, and
1010 retirement benefits of a member of the State Board of Education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 7.105, Education Code, is amended to
1313 read as follows:
1414 Sec. 7.105. COMPENSATION AND REIMBURSEMENT. [(a)] A
1515 member of the board is [not] entitled to receive compensation and
1616 reimbursement of the member's expenses in the same amount and
1717 manner as a member of the legislature as provided by Section 24,
1818 Article III, Texas Constitution.
1919 [(b) A member of the board is entitled to reimbursement of
2020 the member's expenses as provided by law.]
2121 SECTION 2. Section 810.003(b), Government Code, is amended
2222 to read as follows:
2323 (b) This section applies only to a person who is:
2424 (1) a member of the elected class of the Employees
2525 Retirement System of Texas as described by Section 812.002(a)(1),
2626 [or] (2), or (4); or
2727 (2) otherwise eligible for membership in a public
2828 retirement system wholly or partly because the person was elected
2929 or appointed to an elected office.
3030 SECTION 3. Section 812.002(a), Government Code, is amended
3131 to read as follows:
3232 (a) Membership in the elected class of the retirement system
3333 is limited to:
3434 (1) persons who hold state offices that are normally
3535 filled by statewide election and that are not included in the
3636 coverage of the Judicial Retirement System of Texas Plan One or the
3737 Judicial Retirement System of Texas Plan Two;
3838 (2) members of the legislature; [and]
3939 (3) district and criminal district attorneys, to the
4040 extent that they receive salaries from the state general revenue
4141 fund; and
4242 (4) members of the State Board of Education.
4343 SECTION 4. Section 820.053(c), Government Code, is amended
4444 to read as follows:
4545 (c) For purposes of this section, a member of the elected
4646 class of membership under Section 812.002(a)(2) or (4) shall have
4747 the member's accumulated account balance computed as if the
4848 contributions to the account were based on the state base salary,
4949 excluding longevity pay payable under Section 659.0445, being paid
5050 a district judge as set by the General Appropriations Act in
5151 accordance with Section 659.012(a).
5252 SECTION 5. (a) In this section, "retirement system" means
5353 the Employees Retirement System of Texas.
5454 (b) For purposes of Subtitle B, Title 8, Government Code, as
5555 amended by this Act, including Section 820.002, Government Code:
5656 (1) the date a person described by Section
5757 812.002(a)(4), Government Code, as added by this Act, took office
5858 is considered to be September 1, 2025; and
5959 (2) only service performed by that person on or after
6060 that date is creditable in the retirement system.
6161 (c) For purposes of administering the changes in law made by
6262 this Act to Subtitle B, Title 8, Government Code, the retirement
6363 system, the State Board of Education, and, if necessary as
6464 determined by the retirement system, the Texas Education Agency,
6565 shall enter into a memorandum of understanding on the collection of
6666 member contributions and other matters the retirement system
6767 considers advisable.
6868 (d) The retirement system may adopt rules to implement
6969 Subtitle B, Title 8, Government Code, as amended by this Act.
7070 SECTION 6. This Act takes effect September 1, 2025.
