8	8	AN ACT
9	9	relating to the compensation, reimbursement of expenses, and
10	10	retirement benefits of a member of the State Board of Education.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 7.105, Education Code, is amended to
13	13	read as follows:
14	14	Sec. 7.105. COMPENSATION AND REIMBURSEMENT. [(a)] A
15	15	member of the board is [not] entitled to receive compensation and
16	16	reimbursement of the member's expenses in the same amount and
17	17	manner as a member of the legislature as provided by Section 24,
18	18	Article III, Texas Constitution.
19	19	[(b) A member of the board is entitled to reimbursement of
20	20	the member's expenses as provided by law.]
21	21	SECTION 2. Section 810.003(b), Government Code, is amended
22	22	to read as follows:
23	23	(b) This section applies only to a person who is:
24	24	(1) a member of the elected class of the Employees
25	25	Retirement System of Texas as described by Section 812.002(a)(1),
26	26	[or] (2), or (4); or
27	27	(2) otherwise eligible for membership in a public
28	28	retirement system wholly or partly because the person was elected
29	29	or appointed to an elected office.
30	30	SECTION 3. Section 812.002(a), Government Code, is amended
31	31	to read as follows:
32	32	(a) Membership in the elected class of the retirement system
33	33	is limited to:
34	34	(1) persons who hold state offices that are normally
35	35	filled by statewide election and that are not included in the
36	36	coverage of the Judicial Retirement System of Texas Plan One or the
37	37	Judicial Retirement System of Texas Plan Two;
38	38	(2) members of the legislature; [and]
39	39	(3) district and criminal district attorneys, to the
40	40	extent that they receive salaries from the state general revenue
41	41	fund; and
42	42	(4) members of the State Board of Education.
43	43	SECTION 4. Section 820.053(c), Government Code, is amended
44	44	to read as follows:
45	45	(c) For purposes of this section, a member of the elected
46	46	class of membership under Section 812.002(a)(2) or (4) shall have
47	47	the member's accumulated account balance computed as if the
48	48	contributions to the account were based on the state base salary,
49	49	excluding longevity pay payable under Section 659.0445, being paid
50	50	a district judge as set by the General Appropriations Act in
51	51	accordance with Section 659.012(a).
52	52	SECTION 5. (a) In this section, "retirement system" means
53	53	the Employees Retirement System of Texas.
54	54	(b) For purposes of Subtitle B, Title 8, Government Code, as
55	55	amended by this Act, including Section 820.002, Government Code:
56	56	(1) the date a person described by Section
57	57	812.002(a)(4), Government Code, as added by this Act, took office
58	58	is considered to be September 1, 2025; and
59	59	(2) only service performed by that person on or after
60	60	that date is creditable in the retirement system.
61	61	(c) For purposes of administering the changes in law made by
62	62	this Act to Subtitle B, Title 8, Government Code, the retirement
63	63	system, the State Board of Education, and, if necessary as
64	64	determined by the retirement system, the Texas Education Agency,
65	65	shall enter into a memorandum of understanding on the collection of
66	66	member contributions and other matters the retirement system
67	67	considers advisable.
68	68	(d) The retirement system may adopt rules to implement
69	69	Subtitle B, Title 8, Government Code, as amended by this Act.
70	70	SECTION 6. This Act takes effect September 1, 2025.
