77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to residential treatment facilities for certain
1010 juveniles.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 554.001(a), Health and Safety Code, is
1313 amended to read as follows:
1414 (a) The department shall designate facilities for use [the
1515 Waco Center for Youth] as [a] residential treatment facilities
1616 [facility] for emotionally disturbed juveniles who:
1717 (1) have been admitted under Subtitle C to a facility
1818 of the department; or
1919 (2) are under the managing conservatorship of the
2020 Department of Family and Protective Services and have been admitted
2121 under Subtitle C to the designated facilities [Waco Center for
2222 Youth].
2323 SECTION 2. Sections 554.002(a), (b), and (c), Health and
2424 Safety Code, are amended to read as follows:
2525 (a) The department shall provide without charge appropriate
2626 education services for all clients residing at the designated
2727 facilities [Waco Center for Youth].
2828 (b) The department shall pay for those services from funds
2929 appropriated to the designated facilities [center] for those
3030 purposes [that purpose].
3131 (c) A client of the center who is not a resident of the local
3232 school district [Waco Independent School District] may receive
3333 education services from the local school district [Waco Independent
3434 School District] only with the prior approval of the superintendent
3535 of the district.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2025.
