| 9 | 9 | | relating to residential treatment facilities for certain |
|---|
| 10 | 10 | | juveniles. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 554.001(a), Health and Safety Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (a) The department shall designate facilities for use [the |
|---|
| 15 | 15 | | Waco Center for Youth] as [a] residential treatment facilities |
|---|
| 16 | 16 | | [facility] for emotionally disturbed juveniles who: |
|---|
| 17 | 17 | | (1) have been admitted under Subtitle C to a facility |
|---|
| 18 | 18 | | of the department; or |
|---|
| 19 | 19 | | (2) are under the managing conservatorship of the |
|---|
| 20 | 20 | | Department of Family and Protective Services and have been admitted |
|---|
| 21 | 21 | | under Subtitle C to the designated facilities [Waco Center for |
|---|
| 22 | 22 | | Youth]. |

| 23 | 23 | | SECTION 2. Sections 554.002(a), (b), and (c), Health and |
|---|
| 24 | 24 | | Safety Code, are amended to read as follows: |
|---|
| 25 | 25 | | (a) The department shall provide without charge appropriate |
|---|
| 26 | 26 | | education services for all clients residing at the designated |
|---|
| 27 | 27 | | facilities [Waco Center for Youth]. |
|---|
| 28 | 28 | | (b) The department shall pay for those services from funds |
|---|
| 29 | 29 | | appropriated to the designated facilities [center] for those |
|---|
| 30 | 30 | | purposes [that purpose]. |
|---|
| 31 | 31 | | (c) A client of the center who is not a resident of the local |
|---|
| 32 | 32 | | school district [Waco Independent School District] may receive |
|---|
| 33 | 33 | | education services from the local school district [Waco Independent |
|---|
| 34 | 34 | | School District] only with the prior approval of the superintendent |
|---|
| 35 | 35 | | of the district. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2025. |
