77 AN ACT
88 relating to a seller's notice regarding the connection of water
99 utilities to certain tracts of land.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 5, Property Code, is
1212 amended by adding Section 5.0131 to read as follows:
1313 Sec. 5.0131. SELLER'S DISCLOSURE OF WATER SERVICE: CERTAIN
1414 COUNTIES. (a) This section applies only to an executory contract
1515 for the purchase of a lot that is five acres or less in a county
1616 that:
1717 (1) contains a municipality with a population of more
1818 than 500,000; and
1919 (2) is adjacent to an international border.
2020 (b) Before an executory contract to which this section
2121 applies is signed by the purchaser, the seller shall provide to the
2222 purchaser a written statement that specifies whether the property
2323 currently has water service.
2424 (c) A statement under Subsection (b) must be printed in both
2525 English and Spanish in 14-point bold-face type or in 14-point
2626 capital letters.
2727 (d) If an executory contract is entered into without the
2828 seller providing the statement required by this section, the
2929 purchaser may terminate the contract for any reason within the
3030 earlier of:
3131 (1) seven days after the date the purchaser receives
3232 the notice; or
3333 (2) the date the transfer occurs as provided by the
3434 executory contract.
3535 SECTION 2. This Act takes effect September 1, 2025.
