10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter A, Chapter 5, Property Code, is | |
12 | 12 | amended by adding Section 5.0131 to read as follows: | |
13 | 13 | Sec. 5.0131. SELLER'S DISCLOSURE OF WATER SERVICE: CERTAIN | |
14 | 14 | COUNTIES. (a) This section applies only to an executory contract | |
15 | 15 | for the purchase of a lot that is five acres or less in a county | |
16 | 16 | that: | |
17 | 17 | (1) contains a municipality with a population of more | |
18 | 18 | than 500,000; and | |
19 | 19 | (2) is adjacent to an international border. | |
20 | 20 | (b) Before an executory contract to which this section | |
21 | 21 | applies is signed by the purchaser, the seller shall provide to the | |
22 | 22 | purchaser a written statement that specifies whether the property | |
23 | 23 | currently has water service. | |
24 | 24 | (c) A statement under Subsection (b) must be printed in both | |
25 | 25 | English and Spanish in 14-point bold-face type or in 14-point | |
26 | 26 | capital letters. | |
27 | 27 | (d) If an executory contract is entered into without the | |
28 | 28 | seller providing the statement required by this section, the | |
29 | 29 | purchaser may terminate the contract for any reason within the | |
30 | 30 | earlier of: | |
31 | 31 | (1) seven days after the date the purchaser receives | |
32 | 32 | the notice; or | |
33 | 33 | (2) the date the transfer occurs as provided by the | |
34 | 34 | executory contract. | |
35 | 35 | SECTION 2. This Act takes effect September 1, 2025. |
