88 AN ACT
99 relating to a process for determining the rating level of certain
1010 child-care facilities operated by providers participating in the
1111 Texas Rising Star Program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 2308.3155, Government Code, is amended
1414 by adding Subsection (b-3) to read as follows:
1515 (b-3) The commission shall develop a process by which the
1616 commission may apply the four-star rating level of an existing
1717 child-care facility operated by a Texas Rising Star Program
1818 provider to a new child-care facility opened by the provider in the
1919 same city, postal code, or county. The new child-care facility may
2020 retain the four-star rating level applied under this subsection for
2121 not longer than six months after the date the provider opens the
2222 facility. During the six months described by this subsection, the
2323 provider must demonstrate the provider's efforts to ensure the new
2424 child-care facility is able to meet eligibility requirements for
2525 initial certification under the Texas Rising Star Program. The
2626 process developed under this subsection must require that for a new
2727 child-care facility to which this subsection applies:
2828 (1) the provider obtains an initial permit from the
2929 Health and Human Services Commission;
3030 (2) the commission completes a full assessment of the
3131 facility not later than six months after the date the provider opens
3232 the facility; and
3333 (3) the commission waives requirements related to
3434 licensing history for the facility.
3535 SECTION 2. This Act takes effect September 1, 2025.
