| 9 | 9 | | relating to certain requirements and penalties regarding |

| 10 | 10 | | diversity, equity, and inclusion initiatives at a medical and |
|---|
| 11 | 11 | | dental unit. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Section 51.3525, Education Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (d) and adding Subsection (h-1) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (d) Subsection (b)(1) may not be construed to apply to: |
|---|
| 17 | 17 | | (1) academic course instruction, except for academic |
|---|
| 18 | 18 | | course instruction offered by a medical and dental unit; |
|---|
| 19 | 19 | | (2) scholarly research or a creative work by an |
|---|
| 20 | 20 | | institution of higher education's students, faculty, or other |
|---|
| 21 | 21 | | research personnel or the dissemination of that research or work; |
|---|
| 22 | 22 | | (3) an activity of a student organization registered |
|---|
| 23 | 23 | | with or recognized by an institution of higher education; |
|---|
| 24 | 24 | | (4) guest speakers or performers on short-term |
|---|
| 25 | 25 | | engagements; |
|---|
| 26 | 26 | | (5) a policy, practice, procedure, program, or |
|---|
| 27 | 27 | | activity to enhance student academic achievement or postgraduate |
|---|
| 28 | 28 | | outcomes that is designed and implemented without regard to race, |
|---|
| 29 | 29 | | sex, color, or ethnicity; |
|---|
| 30 | 30 | | (6) data collection; or |
|---|
| 31 | 31 | | (7) student recruitment or admissions. |
|---|
| 32 | 32 | | (h-1) Notwithstanding Subsection (h), if the state auditor |
|---|
| 33 | 33 | | determines pursuant to a compliance audit conducted under |
|---|
| 34 | 34 | | Subsection (g) that a medical or dental unit has spent state money |
|---|
| 35 | 35 | | to offer academic course instruction in violation of this section, |
|---|
| 36 | 36 | | the medical or dental unit must cure the violation not later than |
|---|
| 37 | 37 | | the 90th day after the date on which the determination is made to |
|---|
| 38 | 38 | | avoid incurring the penalty described by Subsection (h)(2). |
|---|
| 39 | 39 | | SECTION 2. Section 51.3525(d), Education Code, as amended |
|---|
| 40 | 40 | | by this Act, and Section 51.3525(h-1), Education Code, as added by |
|---|
| 41 | 41 | | this Act, apply beginning with the 2025-2026 academic year. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2025. |
