77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain requirements and penalties regarding
1010 diversity, equity, and inclusion initiatives at a medical and
1111 dental unit.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 51.3525, Education Code, is amended by
1414 amending Subsection (d) and adding Subsection (h-1) to read as
1515 follows:
1616 (d) Subsection (b)(1) may not be construed to apply to:
1717 (1) academic course instruction, except for academic
1818 course instruction offered by a medical and dental unit;
1919 (2) scholarly research or a creative work by an
2020 institution of higher education's students, faculty, or other
2121 research personnel or the dissemination of that research or work;
2222 (3) an activity of a student organization registered
2323 with or recognized by an institution of higher education;
2424 (4) guest speakers or performers on short-term
2525 engagements;
2626 (5) a policy, practice, procedure, program, or
2727 activity to enhance student academic achievement or postgraduate
2828 outcomes that is designed and implemented without regard to race,
2929 sex, color, or ethnicity;
3030 (6) data collection; or
3131 (7) student recruitment or admissions.
3232 (h-1) Notwithstanding Subsection (h), if the state auditor
3333 determines pursuant to a compliance audit conducted under
3434 Subsection (g) that a medical or dental unit has spent state money
3535 to offer academic course instruction in violation of this section,
3636 the medical or dental unit must cure the violation not later than
3737 the 90th day after the date on which the determination is made to
3838 avoid incurring the penalty described by Subsection (h)(2).
3939 SECTION 2. Section 51.3525(d), Education Code, as amended
4040 by this Act, and Section 51.3525(h-1), Education Code, as added by
4141 this Act, apply beginning with the 2025-2026 academic year.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
