77 AN ACT
88 relating to the authority of certain municipalities to receive
99 certain tax revenue derived from a hotel and convention center
1010 project and to pledge certain tax revenue for the payment of
1111 obligations related to the project.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 351.152, Tax Code, is amended to read as
1414 follows:
1515 Sec. 351.152. APPLICABILITY. This subchapter applies only
1616 to:
1717 (1) a municipality described by Section
1818 351.001(7)(B);
1919 (2) a municipality described by Section
2020 351.001(7)(D);
2121 (3) a municipality described by Section
2222 351.001(7)(E);
2323 (4) a municipality described by Section
2424 351.102(e)(3);
2525 (5) a municipality that contains more than 70 percent
2626 of the population of a county with a population of 1.5 million or
2727 more;
2828 (6) a municipality with a population of 175,000 or
2929 more but less than 200,000 that is partially located in at least one
3030 county with a population of 125,000 or more;
3131 (7) a municipality with a population of 250,000 or
3232 more but less than one million that is located in one county with a
3333 population of 2.5 million or more;
3434 (8) a municipality with a population of 180,000 or
3535 more that:
3636 (A) is located in two counties, each with a
3737 population of 100,000 or more; and
3838 (B) contains an American Quarter Horse Hall of
3939 Fame and Museum;
4040 (9) a municipality with a population of 96,000 or more
4141 that is located in a county that borders Lake Palestine;
4242 (10) a municipality with a population of 96,000 or
4343 more that is located in a county that contains the headwaters of the
4444 San Gabriel River;
4545 (11) a municipality with a population of at least
4646 95,000 that is located in a county that is bisected by United States
4747 Highway 385 and has a population of not more than 170,000;
4848 (12) a municipality with a population of 110,000 or
4949 more but less than 135,000 at least part of which is located in a
5050 county with a population of less than 135,000;
5151 (13) a municipality with a population of 28,000 or
5252 more but less than 31,000 that is located in two counties, each of
5353 which has a population of 900,000 or more and a southern border with
5454 a county with a population of 2.5 million or more;
5555 (14) a municipality with a population of 200,000 or
5656 more but less than 300,000 that contains a component institution of
5757 the Texas Tech University System;
5858 (15) a municipality with a population of 95,000 or
5959 more that:
6060 (A) is located in more than one county; and
6161 (B) borders Lake Lewisville;
6262 (16) a municipality with a population of 45,000 or
6363 more that:
6464 (A) contains a portion of Cedar Hill State Park;
6565 (B) is located in two counties, one of which has a
6666 population of 2.5 million or more and one of which has a population
6767 of 190,000 or more; and
6868 (C) has adopted a capital improvement plan for
6969 the construction or expansion of a convention center facility;
7070 (17) a municipality with a population of less than
7171 10,000 that:
7272 (A) is almost wholly located in a county with a
7373 population of 900,000 or more that is adjacent to a county with a
7474 population of 2.5 million or more;
7575 (B) is partially located in a county with a
7676 population of 2.1 million or more that is adjacent to a county with
7777 a population of 2.5 million or more;
7878 (C) has a visitor center and museum located in a
7979 19th-century rock building in the municipality's downtown; and
8080 (D) has a waterpark open to the public;
8181 (18) a municipality with a population of 60,000 or
8282 more that:
8383 (A) borders Lake Ray Hubbard; and
8484 (B) is located in two counties, one of which has a
8585 population of less than 110,000;
8686 (19) a municipality with a population of 110,000 or
8787 more that:
8888 (A) borders Clear Lake; and
8989 (B) is primarily located in a county with a
9090 population of less than 355,000;
9191 (20) a municipality with a population of less than
9292 2,000 that:
9393 (A) is located adjacent to a bay connected to the
9494 Gulf of Mexico;
9595 (B) is located in a county with a population of
9696 290,000 or more that is adjacent to a county with a population of
9797 four million or more; and
9898 (C) has a boardwalk on the bay;
9999 (21) a municipality with a population of 75,000 or
100100 more that:
101101 (A) is located wholly in one county with a
102102 population of 800,000 or more that is adjacent to a county with a
103103 population of four million or more; and
104104 (B) has adopted a capital improvement plan for
105105 the construction or expansion of a convention center facility;
106106 (22) a municipality with a population of less than
107107 70,000 that is located in three counties, at least one of which has
108108 a population of four million or more;
109109 (23) an eligible coastal municipality with a
110110 population of 2,900 or more but less than 5,000;
111111 (24) a municipality with a population of 90,000 or
112112 more but less than 150,000 that:
113113 (A) is located in three counties; and
114114 (B) contains a branch campus of a component
115115 institution of the University of Houston System;
116116 (25) a municipality that is:
117117 (A) primarily located in a county with a
118118 population of four million or more; and
119119 (B) connected by a bridge to a municipality
120120 described by Subdivision (20);
121121 (26) a municipality with a population of 25,000 or
122122 more but less than 30,000 that:
123123 (A) contains a portion of Mustang Bayou; and
124124 (B) is wholly located in a county with a
125125 population of less than 500,000;
126126 (27) a municipality with a population of 70,000 or
127127 more but less than 90,000 that is located in two counties, one of
128128 which has a population of four million or more and the other of
129129 which has a population of less than 50,000;
130130 (28) a municipality with a population of 10,000 or
131131 more that:
132132 (A) is wholly located in a county with a
133133 population of four million or more; and
134134 (B) has a city hall located less than three miles
135135 from a space center operated by an agency of the federal government;
136136 (29) a municipality that is the county seat of a
137137 county:
138138 (A) through which the Pedernales River flows; and
139139 (B) in which the birthplace of a president of the
140140 United States is located;
141141 (30) a municipality that contains a portion of U.S.
142142 Highway 79 and State Highway 130;
143143 (31) a municipality with a population of 70,000 or
144144 more but less than 115,000 that is located in two counties, one of
145145 which has a population of 1.1 million or more but less than 1.9
146146 million;
147147 (32) a municipality with a population of less than
148148 25,000 that contains a museum of Western American art;
149149 (33) a municipality with a population of 50,000 or
150150 more that is the county seat of a county that contains a portion of
151151 the Sam Houston National Forest;
152152 (34) a municipality with a population of less than
153153 25,000 that:
154154 (A) contains a cultural heritage museum; and
155155 (B) is located in a county that borders the
156156 United Mexican States and the Gulf of Mexico;
157157 (35) a municipality that is the county seat of a county
158158 that:
159159 (A) has a population of 115,000 or more;
160160 (B) is adjacent to a county with a population of
161161 2.1 million or more; and
162162 (C) hosts an annual peach festival;
163163 (36) a municipality that is the county seat of a county
164164 that:
165165 (A) has a population of 800,000 or more; and
166166 (B) is adjacent to a county with a population of
167167 four million or more;
168168 (37) a municipality with a population of less than
169169 10,000 that:
170170 (A) contains a component university of The Texas
171171 A&M University System; and
172172 (B) is located in a county adjacent to a county
173173 that borders Oklahoma;
174174 (38) a municipality with a population of less than
175175 17,000 that:
176176 (A) is located in two counties, each of which has
177177 a population of 900,000 or more but less than two million; and
178178 (B) hosts an annual Cajun Festival;
179179 (39) a municipality with a population of 13,000 or
180180 more that:
181181 (A) is located on an international border; and
182182 (B) is located in a county:
183183 (i) with a population of less than 400,000;
184184 and
185185 (ii) in which at least one World Birding
186186 Center site is located;
187187 (40) a municipality with a population of 3,200 or more
188188 that:
189189 (A) is located on an international border; and
190190 (B) is located not more than five miles from a
191191 state historic site that serves as a visitor center for a state park
192192 that contains 300,000 or more acres of land;
193193 (41) a municipality with a population of 36,000 or
194194 more that is adjacent to at least two municipalities described by
195195 Subdivision (15);
196196 (42) a municipality with a population of 28,000 or
197197 more that is located in a county with a population of 240,000 or
198198 more that contains a portion of the Blanco River and in which is
199199 located a historic railroad depot and heritage center;
200200 (43) a municipality located in a county that has a
201201 population of not more than 300,000 and in which a component
202202 university of the University of Houston System is located;
203203 (44) a municipality with a population of less than
204204 500,000 that is:
205205 (A) located in two counties; and
206206 (B) adjacent to a municipality described by
207207 Subdivision (31);
208208 (45) a municipality that:
209209 (A) has a population of more than 67,000; and
210210 (B) is located in two counties with 90 percent of
211211 the municipality's territory located in a county with a population
212212 of at least 800,000, and the remaining territory located in a county
213213 with a population of at least four million;
214214 (46) a municipality that:
215215 (A) has a population of 100,000 or more; and
216216 (B) is wholly located in, but is not the county
217217 seat of, a county with a population of one million or more:
218218 (i) in which all or part of a municipality
219219 with a population of one million or more is located; and
220220 (ii) that is adjacent to a county with a
221221 population of 2.5 million or more;
222222 (47) a municipality that is the county seat of a county
223223 bordering the Gulf of Mexico and the United Mexican States;
224224 (48) a municipality that is bisected by the Guadalupe
225225 River and is the county seat of a county with a population of
226226 170,000 or more;
227227 (49) a municipality with a population of 70,000 or
228228 more but less than 150,000 that borders Joe Pool Lake;
229229 (50) a municipality with a population of 115,000 or
230230 more that borders the Neches River;
231231 (51) a municipality described by Section 351.101(k);
232232 (52) a municipality that is the county seat of a

234234 (A) through which the Brazos River flows; and
235235 (B) in which a national monument is located;
236236 (53) a municipality with a population of 45,000 or

238238 (A) is not the county seat of a county;
239239 (B) is located in a single county; and
240240 (C) contains a portion of Lake Lewisville;
241241 (54) a municipality that is the county seat of a county
242242 with a population of more than 900,000 that is adjacent to two
243243 counties, each of which has a population of more than 1.8 million;
244244 (55) a municipality that hosts an annual wine festival
245245 and is located in three counties, each of which has a population of
246246 more than 900,000;
247247 (56) a municipality that has a population of at least
248248 150,000 but less than 1,300,000 and is partially located in a county
249249 that contains a portion of Cedar Creek Reservoir;
250250 (57) a municipality that is located in a county that
251251 contains a portion of Cedar Creek Reservoir and in which a private
252252 college is located;
253253 (58) a municipality that is the county seat of a
254254 county:
255255 (A) with a population of one million or more;
256256 (B) in which all or part of a municipality with a
257257 population of one million or more is located; and
258258 (C) that is located adjacent to a county with a
259259 population of 2.5 million or more;
260260 (59) a municipality that is the county seat of a county
261261 that contains a portion of Cedar Creek Reservoir and borders a
262262 county with a population of more than 240,000;
263263 (60) a municipality with a population of more than
264264 80,000 but less than 150,000 that is located in a county with a
265265 population of more than 369,000 but less than 864,000 that contains
266266 part of an active duty United States Army installation;
267267 (61) a municipality with a population of 750,000 or
268268 more that is located in a county with a population of 1.5 million or
269269 less;
270270 (62) a municipality with a population of less than
271271 7,000 that contains a country music hall of fame;
272272 (63) a municipality with a population of 35,000 or
273273 more that contains a railroad museum and is located in a county
274274 that:
275275 (A) has a population of 800,000 or more; and
276276 (B) is adjacent to a county with a population of
277277 four million or more; [and]
278278 (64) a municipality:
279279 (A) that is the county seat of a county:
280280 (i) with a population of 60,000 or less; and
281281 (ii) that borders the Rio Grande; and
282282 (B) in which is located a United States military
283283 fort listed in the National Register of Historic Places; and
284284 (65) a municipality with a population of 47,000 or
285285 more that:
286286 (A) is located in two counties, one of which has a
287287 population of 2.1 million or more and one of which has a population
288288 of 179,000 or more; and
289289 (B) contains a portion of State Highway 174 and
290290 Interstate 35 West.
291291 SECTION 2. Section 351.157(b), Tax Code, is amended to read
292292 as follows:
293293 (b) This section applies only to:
294294 (1) a municipality described by Section 351.152(3);
295295 (1-a) a municipality described by Section 351.152(5);
296296 (2) a municipality described by Section 351.152(6);
297297 (3) a municipality described by Section 351.152(7);
298298 (4) a municipality described by Section 351.152(10);
299299 (4-a) a municipality described by Section
300300 351.152(14);
301301 (5) a municipality described by Section 351.152(16);
302302 (6) a municipality described by Section 351.152(22);
303303 (7) a municipality described by Section 351.152(25);
304304 (8) a municipality described by Section 351.152(34);

321321 SECTION 3. This Act takes effect immediately if it receives
322322 a vote of two-thirds of all the members elected to each house, as
323323 provided by Section 39, Article III, Texas Constitution. If this
324324 Act does not receive the vote necessary for immediate effect, this
325325 Act takes effect September 1, 2025.
