77 AN ACT
88 relating to the provision of an abortion-inducing drug.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 171.063, Health and Safety Code, is
1111 amended by amending Subsections (a) to read as follows:
1212 (a) A person may not knowingly provide an abortion-inducing
1313 drug to a pregnant woman for the purpose of inducing an abortion in
1414 the pregnant woman or enabling another person to induce an abortion
1515 in the pregnant woman unless:
1616 (1) the person who provides the
1717 abortion-inducing drug is a physician; [and]
1818 (2) the person is physically present in this
1919 state and personally examines the pregnant woman in person at the
2020 time the person provides the abortion-inducing medication to the
2121 pregnant woman; and
2222 (3) the provision of the abortion-inducing drug
2323 satisfies the protocol authorized by this subchapter.
2424 (e) A physician who provides the abortion-inducing drug, or
2525 the physician's agent, must schedule an in person follow-up visit
2626 for the woman to occur not later than the 14th day after the
2727 earliest date on which the abortion-inducing drug is administered
2828 or used or the abortion is performed or induced. At the follow-up
2929 visit, the physician must:
3030 (1) confirm that the woman's pregnancy is completely
3131 terminated; and
3232 (2) assess any continued blood loss.
3333 SECTION 2. Section 151.056, Occupations Code, is amended by
3434 amending Subsection (b) and adding Subsection (b-1) to read as
3535 follows:
3636 (b) Except as provided by Subsection (b-1), this [This]
3737 section does not apply to the act of:
3838 (1) a medical specialist located in another
3939 jurisdiction who provides only episodic consultation services on
4040 request to a physician licensed in this state who practices in the
4141 same medical specialty;
4242 (2) a physician located in another jurisdiction who is
4343 providing consultation services to a medical school as defined by
4444 Section.61.501, Education Code;
4545 (3) a physician located in another jurisdiction who is
4646 providing consultation services to an institution subject to:
4747 (A) Subchapter C, Chapter 73, Education Code; or
4848 (B) Subchapter K, Chapter 74, Education Code; or
4949 (4) a physician located in another jurisdiction of a
5050 state having borders contiguous with the borders of this state who
5151 is the treating physician of a patient and orders home health or
5252 hospice services for a resident of this state to be delivered by a
5353 home and community support services agency licensed in this state.
5454 (b-1) This section applies to any consultation service
5555 described in Subsection (b) if the service relates to the provision
5656 of an abortion-inducing drug, as defined by Section 171.061, Health
5757 and Safety Code.
5858 SECTION 3. This Act takes effect September 1, 2025.
