8 | 8 | | relating to the provision of an abortion-inducing drug. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 171.063, Health and Safety Code, is |
---|
11 | 11 | | amended by amending Subsections (a) to read as follows: |
---|
12 | 12 | | (a) A person may not knowingly provide an abortion-inducing |
---|
13 | 13 | | drug to a pregnant woman for the purpose of inducing an abortion in |
---|
14 | 14 | | the pregnant woman or enabling another person to induce an abortion |
---|
15 | 15 | | in the pregnant woman unless: |
---|
16 | 16 | | (1) the person who provides the |
---|
17 | 17 | | abortion-inducing drug is a physician; [and] |
---|
18 | 18 | | (2) the person is physically present in this |
---|
19 | 19 | | state and personally examines the pregnant woman in person at the |
---|
20 | 20 | | time the person provides the abortion-inducing medication to the |
---|
21 | 21 | | pregnant woman; and |
---|
22 | 22 | | (3) the provision of the abortion-inducing drug |
---|
23 | 23 | | satisfies the protocol authorized by this subchapter. |
---|
24 | 24 | | (e) A physician who provides the abortion-inducing drug, or |
---|
25 | 25 | | the physician's agent, must schedule an in person follow-up visit |
---|
26 | 26 | | for the woman to occur not later than the 14th day after the |
---|
27 | 27 | | earliest date on which the abortion-inducing drug is administered |
---|
28 | 28 | | or used or the abortion is performed or induced. At the follow-up |
---|
29 | 29 | | visit, the physician must: |
---|
30 | 30 | | (1) confirm that the woman's pregnancy is completely |
---|
31 | 31 | | terminated; and |
---|
32 | 32 | | (2) assess any continued blood loss. |
---|
33 | 33 | | SECTION 2. Section 151.056, Occupations Code, is amended by |
---|
34 | 34 | | amending Subsection (b) and adding Subsection (b-1) to read as |
---|
35 | 35 | | follows: |
---|
36 | 36 | | (b) Except as provided by Subsection (b-1), this [This] |
---|
37 | 37 | | section does not apply to the act of: |
---|
38 | 38 | | (1) a medical specialist located in another |
---|
39 | 39 | | jurisdiction who provides only episodic consultation services on |
---|
40 | 40 | | request to a physician licensed in this state who practices in the |
---|
41 | 41 | | same medical specialty; |
---|
42 | 42 | | (2) a physician located in another jurisdiction who is |
---|
43 | 43 | | providing consultation services to a medical school as defined by |
---|
44 | 44 | | Section.61.501, Education Code; |
---|
45 | 45 | | (3) a physician located in another jurisdiction who is |
---|
46 | 46 | | providing consultation services to an institution subject to: |
---|
47 | 47 | | (A) Subchapter C, Chapter 73, Education Code; or |
---|
48 | 48 | | (B) Subchapter K, Chapter 74, Education Code; or |
---|
49 | 49 | | (4) a physician located in another jurisdiction of a |
---|
50 | 50 | | state having borders contiguous with the borders of this state who |
---|
51 | 51 | | is the treating physician of a patient and orders home health or |
---|
52 | 52 | | hospice services for a resident of this state to be delivered by a |
---|
53 | 53 | | home and community support services agency licensed in this state. |
---|
54 | 54 | | (b-1) This section applies to any consultation service |
---|
55 | 55 | | described in Subsection (b) if the service relates to the provision |
---|
56 | 56 | | of an abortion-inducing drug, as defined by Section 171.061, Health |
---|
57 | 57 | | and Safety Code. |
---|
58 | 58 | | SECTION 3. This Act takes effect September 1, 2025. |
