77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision and evaluation of Medicaid reimbursement
1010 for dental services provided to certain Medicaid recipients.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.054, Human Resources Code, is amended
1313 by adding Subsections (g) and (h) to read as follows:
1414 (g) In addition to dental services already covered under the
1515 medical assistance program, the commission shall provide medical
1616 assistance reimbursement for recipients who are 21 years of age or
1717 older, including recipients with a disability, for dental services
1818 needed for pain relief, infections, restoration of teeth, and
1919 maintenance of dental health, including:
2020 (1) preventative services; and
2121 (2) therapeutic services for dental disease that, if
2222 left untreated, may become acute dental problems or may cause
2323 irreversible damage to the teeth or supporting structures.
2424 (h) Notwithstanding Subsection (g), the commission may not
2525 provide medical assistance reimbursement for the provision of
2626 dental services under that subsection if, based on the data
2727 evaluated under Section 32.0545, the Legislative Budget Board finds
2828 that the provision of medical assistance reimbursement for those
2929 services resulted in an increase in overall spending under the
3030 medical assistance program.
3131 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
3232 is amended by adding Section 32.0545 to read as follows:
3333 Sec. 32.0545. EVALUATION OF REIMBURSEMENT FOR CERTAIN
3434 DENTAL SERVICES. (a) The commission shall:
3535 (1) analyze data related to the provision of medical
3636 assistance reimbursement for dental services provided to
3737 recipients under Section 32.054(g); and
3838 (2) provide to the Legislative Budget Board the data
3939 described by Subdivision (1) in the form and manner the board
4040 requires.
4141 (b) The data analyzed by the commission and provided to the
4242 Legislative Budget Board under Subsection (a) must:
4343 (1) relate to three consecutive years, beginning with
4444 the year immediately preceding the year in which medical assistance
4545 reimbursement for the provision of dental services under Section
4646 32.054(g) is initially provided; and
4747 (2) include at least the following:
4848 (A) the number of recipients who received those
4949 dental services; and
5050 (B) the type of dental services for which medical
5151 assistance reimbursement was provided.
5252 (c) The commission shall ensure the analysis under
5353 Subsection (a) includes:
5454 (1) appropriate demographic categories, including
5555 recipient age, disability, and income; and
5656 (2) the average cost per recipient for providing
5757 dental services under the medical assistance program.
5858 (d) Using the data the commission provides under Subsection
5959 (a), the Legislative Budget Board shall evaluate cost and
6060 utilization trends to determine whether providing medical
6161 assistance reimbursement for the provision of dental services to
6262 recipients under Section 32.054(g) resulted in an increase in
6363 overall spending on the provision of dental services under the
6464 medical assistance program.
6565 (e) Not later than February 1, 2029, the Legislative Budget
6666 Board shall:
6767 (1) prepare and publish on the board's Internet
6868 website a written report of its evaluation under Subsection (d);
6969 and
7070 (2) publish a summary of its findings, including a
7171 specific finding regarding whether providing medical assistance
7272 reimbursement for the provision of dental services to recipients
7373 under Section 32.054(g) resulted in an increase in overall spending
7474 on the provision of dental services under the medical assistance
7575 program.
7676 (f) The Legislative Budget Board shall provide to the
7777 commission a draft of the report described by Subsection (e)(1) not
7878 later than the 30th day before the date the board publishes the
7979 report on the board's Internet website.
8080 (g) If the Legislative Budget Board finds that:
8181 (1) providing medical assistance reimbursement for
8282 the provision of dental services under Section 32.054(g) resulted
8383 in an increase in overall spending on the provision of dental
8484 services under the medical assistance program:
8585 (A) the commission shall immediately discontinue
8686 providing reimbursement for those services; and
8787 (B) Sections 32.054(g) and (h) and this section
8888 expire; or
8989 (2) providing medical assistance reimbursement for
9090 the provision of dental services under Section 32.054(g) did not
9191 result in an increase in overall spending on the provision of dental
9292 services under the medical assistance program, Section 32.054(h)
9393 and this section expire.
9494 SECTION 3. If before implementing any provision of this Act
9595 a state agency determines that a waiver or authorization from a
9696 federal agency is necessary for implementation of that provision,
9797 the agency affected by the provision shall request the waiver or
9898 authorization and may delay implementing that provision until the
9999 waiver or authorization is granted.
100100 SECTION 4. This Act takes effect September 1, 2025.
