| 10 | 10 | | beverages in certain areas of a municipality and the local |

| 11 | 11 | | regulation of premises in those areas. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 251.742, Alcoholic Beverage Code, is |
|---|
| 14 | 14 | | amended by amending Subsection (b) and adding Subsection (i) to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | (b) This section applies only to a municipality that: |
|---|
| 17 | 17 | | (1) has a population of 15,000 or more[;] and |
|---|
| 18 | 18 | | [(2)] is located in two counties one of which: |
|---|
| 19 | 19 | | (A) has a population of 340,000 or more; |
|---|
| 20 | 20 | | (B) contains a municipality in which at least 85 |
|---|
| 21 | 21 | | percent of the county's population resides; and |
|---|
| 22 | 22 | | (C) borders the Gulf of Mexico; or |
|---|
| 23 | 23 | | (2) has a population of 240,000 or more and: |
|---|
| 24 | 24 | | (A) is located in two or more counties; and |
|---|
| 25 | 25 | | (B) borders a man-made lake that has a surface |
|---|
| 26 | 26 | | area of at least 20,000 acres. |
|---|
| 27 | 27 | | (i) Subject to Chapter 211, Local Government Code, the |
|---|
| 28 | 28 | | governing body of the municipality may adopt zoning and land use |
|---|
| 29 | 29 | | regulations applicable to a premises that sells alcoholic beverages |
|---|
| 30 | 30 | | in the boundaries of a zone designated under this section. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2025. |
