77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the name and governance of the Railroad Commission of
1010 Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Chapter 81, Natural Resources
1313 Code, is amended to read as follows:
1414 CHAPTER 81. TEXAS OIL, GAS, AND MINERALS [RAILROAD] COMMISSION [OF
1515 TEXAS]
1616 SECTION 2. Section 81.001, Natural Resources Code, is
1717 amended to read as follows:
1818 Sec. 81.001. DEFINITIONS. In this chapter:
1919 (1) "Commission" means the Texas Oil, Gas, and
2020 Minerals [Railroad] Commission [of Texas].
2121 (2) "Commissioner" means any member of the Texas Oil,
2222 Gas, and Minerals [Railroad] Commission [of Texas].
2323 SECTION 3. Subchapter A, Chapter 81, Natural Resources
2424 Code, is amended by adding Section 81.003 to read as follows:
2525 Sec. 81.003. TEXAS OIL, GAS, AND MINERALS COMMISSION. (a)
2626 The Railroad Commission of Texas is renamed the Texas Oil, Gas, and
2727 Minerals Commission.
2828 (b) A reference in law to:
2929 (1) the Railroad Commission of Texas means the Texas
3030 Oil, Gas, and Minerals Commission; and
3131 (2) a railroad commissioner or a member of the
3232 Railroad Commission of Texas means a member of the Texas Oil, Gas,
3333 and Minerals Commission.
3434 SECTION 4. Section 81.01001, Natural Resources Code, is
3535 amended to read as follows:
3636 Sec. 81.01001. SUNSET PROVISION. (a) The Texas Oil, Gas,
3737 and Minerals [Railroad] Commission [of Texas] is subject to Chapter
3838 325, Government Code (Texas Sunset Act). Unless continued in
3939 existence as provided by that chapter, the commission is abolished
4040 September 1, 2029.
4141 (b) The Texas Oil, Gas, and Minerals [Railroad] Commission
4242 [of Texas] shall pay the costs incurred by the Sunset Advisory
4343 Commission in performing a review of the commission under this
4444 section. The Sunset Advisory Commission shall determine the
4545 costs, and the commission shall pay the amount of those costs
4646 promptly on receipt of a statement from the Sunset Advisory
4747 Commission detailing the costs.
4848 SECTION 5. Subchapter B, Chapter 81, Natural Resources
4949 Code, is amended by adding Section 81.010015 to read as follows:
5050 Sec. 81.010015. ELECTION AND TERMS OF COMMISSIONERS;
5151 VACANCIES. (a) The commission is composed of three commissioners
5252 elected at the general election for state and county officers.
5353 (b) Commissioners serve staggered terms of six years, with
5454 the term of one commissioner expiring December 31 of each
5555 even-numbered year.
5656 (c) The governor shall appoint a person to fill a vacancy on
5757 the commission until the next general election.
5858 SECTION 6. Section 81.01005, Natural Resources Code, is
5959 amended to read as follows:
6060 Sec. 81.01005. NAME AND SEAL. (a) The commissioners are
6161 known collectively as the "Texas Oil, Gas, and Minerals [Railroad]
6262 Commission [of Texas]."
6363 (b) The seal of the commission contains a star of five
6464 points with the words "Texas Oil, Gas, and Minerals [Railroad]
6565 Commission [of Texas]" engraved on it.
6666 SECTION 7. The heading to Section 81.0521, Natural
6767 Resources Code, is amended to read as follows:
6868 Sec. 81.0521. FEE FOR APPLICATION FOR EXCEPTION TO
6969 [RAILROAD] COMMISSION RULE.
7070 SECTION 8. Section 52.092(c), Election Code, is amended to
7171 read as follows:
7272 (c) Statewide offices of the state government shall be
7373 listed in the following order:
7474 (1) governor;
7575 (2) lieutenant governor;
7676 (3) attorney general;
7777 (4) comptroller of public accounts;
7878 (5) commissioner of the General Land Office;
7979 (6) commissioner of agriculture;
8080 (7) oil, gas, and minerals [railroad] commissioner;
8181 (8) chief justice, supreme court;
8282 (9) justice, supreme court;
8383 (10) presiding judge, court of criminal appeals;
8484 (11) judge, court of criminal appeals.
8585 SECTION 9. On the effective date of this Act, the name of
8686 the Railroad Commission of Texas is changed to the Texas Oil, Gas,
8787 and Minerals Commission. The change of the agency's name does not
8888 affect:
8989 (1) the agency's powers, duties, rights, or
9090 obligations;
9191 (2) the agency's personnel, equipment, data,
9292 documents, facilities, contracts, items, other property,
9393 appropriations, rules, or decisions;
9494 (3) a proceeding of or involving the agency under the
9595 name of the Railroad Commission of Texas; or
9696 (4) the terms of the chairman or other members of the
9797 governing body of the agency.
9898 SECTION 10. This Act takes effect September 1, 2025.
