8	8	AN ACT
9	9	relating to the name and governance of the Railroad Commission of
10	10	Texas.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. The heading to Chapter 81, Natural Resources
13	13	Code, is amended to read as follows:
14	14	CHAPTER 81. TEXAS OIL, GAS, AND MINERALS [RAILROAD] COMMISSION [OF
15	15	TEXAS]
16	16	SECTION 2. Section 81.001, Natural Resources Code, is
17	17	amended to read as follows:
18	18	Sec. 81.001. DEFINITIONS. In this chapter:
19	19	(1) "Commission" means the Texas Oil, Gas, and
20	20	Minerals [Railroad] Commission [of Texas].
21	21	(2) "Commissioner" means any member of the Texas Oil,
22	22	Gas, and Minerals [Railroad] Commission [of Texas].
23	23	SECTION 3. Subchapter A, Chapter 81, Natural Resources
24	24	Code, is amended by adding Section 81.003 to read as follows:
25	25	Sec. 81.003. TEXAS OIL, GAS, AND MINERALS COMMISSION. (a)
26	26	The Railroad Commission of Texas is renamed the Texas Oil, Gas, and
27	27	Minerals Commission.
28	28	(b) A reference in law to:
29	29	(1) the Railroad Commission of Texas means the Texas
30	30	Oil, Gas, and Minerals Commission; and
31	31	(2) a railroad commissioner or a member of the
32	32	Railroad Commission of Texas means a member of the Texas Oil, Gas,
33	33	and Minerals Commission.
34	34	SECTION 4. Section 81.01001, Natural Resources Code, is
35	35	amended to read as follows:
36	36	Sec. 81.01001. SUNSET PROVISION. (a) The Texas Oil, Gas,
37	37	and Minerals [Railroad] Commission [of Texas] is subject to Chapter
38	38	325, Government Code (Texas Sunset Act). Unless continued in
39	39	existence as provided by that chapter, the commission is abolished
40	40	September 1, 2029.
41	41	(b) The Texas Oil, Gas, and Minerals [Railroad] Commission
42	42	[of Texas] shall pay the costs incurred by the Sunset Advisory
43	43	Commission in performing a review of the commission under this
44	44	section. The Sunset Advisory Commission shall determine the
45	45	costs, and the commission shall pay the amount of those costs
46	46	promptly on receipt of a statement from the Sunset Advisory
47	47	Commission detailing the costs.
48	48	SECTION 5. Subchapter B, Chapter 81, Natural Resources
49	49	Code, is amended by adding Section 81.010015 to read as follows:
50	50	Sec. 81.010015. ELECTION AND TERMS OF COMMISSIONERS;
51	51	VACANCIES. (a) The commission is composed of three commissioners
52	52	elected at the general election for state and county officers.
53	53	(b) Commissioners serve staggered terms of six years, with
54	54	the term of one commissioner expiring December 31 of each
55	55	even-numbered year.
56	56	(c) The governor shall appoint a person to fill a vacancy on
57	57	the commission until the next general election.
58	58	SECTION 6. Section 81.01005, Natural Resources Code, is
59	59	amended to read as follows:
60	60	Sec. 81.01005. NAME AND SEAL. (a) The commissioners are
61	61	known collectively as the "Texas Oil, Gas, and Minerals [Railroad]
62	62	Commission [of Texas]."
63	63	(b) The seal of the commission contains a star of five
64	64	points with the words "Texas Oil, Gas, and Minerals [Railroad]
65	65	Commission [of Texas]" engraved on it.
66	66	SECTION 7. The heading to Section 81.0521, Natural
67	67	Resources Code, is amended to read as follows:
68	68	Sec. 81.0521. FEE FOR APPLICATION FOR EXCEPTION TO
69	69	[RAILROAD] COMMISSION RULE.
70	70	SECTION 8. Section 52.092(c), Election Code, is amended to
71	71	read as follows:
72	72	(c) Statewide offices of the state government shall be
73	73	listed in the following order:
74	74	(1) governor;
75	75	(2) lieutenant governor;
76	76	(3) attorney general;
77	77	(4) comptroller of public accounts;
78	78	(5) commissioner of the General Land Office;
79	79	(6) commissioner of agriculture;
80	80	(7) oil, gas, and minerals [railroad] commissioner;
81	81	(8) chief justice, supreme court;
82	82	(9) justice, supreme court;
83	83	(10) presiding judge, court of criminal appeals;
84	84	(11) judge, court of criminal appeals.
85	85	SECTION 9. On the effective date of this Act, the name of
86	86	the Railroad Commission of Texas is changed to the Texas Oil, Gas,
87	87	and Minerals Commission. The change of the agency's name does not
88	88	affect:
89	89	(1) the agency's powers, duties, rights, or
90	90	obligations;
91	91	(2) the agency's personnel, equipment, data,
92	92	documents, facilities, contracts, items, other property,
93	93	appropriations, rules, or decisions;
94	94	(3) a proceeding of or involving the agency under the
95	95	name of the Railroad Commission of Texas; or
96	96	(4) the terms of the chairman or other members of the
97	97	governing body of the agency.
98	98	SECTION 10. This Act takes effect September 1, 2025.
