77 AN ACT
88 relating to the operation and management of the Panhandle-Plains
99 Historical Museum by the Texas Historical Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 442, Government Code, is amended by adding
1212 Subchapter B-3 to read as follows:
1313 SUBCHAPTER B-3. PANHANDLE-PLAINS HISTORICAL MUSEUM
1414 Sec. 442.067. DEFINITION. In this subchapter, "museum"
1515 means the Panhandle-Plains Historical Museum in Canyon, Texas.
1616 Sec. 442.068. PANHANDLE-PLAINS HISTORICAL MUSEUM; FUND.
1717 (a) The museum currently consists of a facility on the campus of
1818 West Texas A&M University and a collection owned by the
1919 Panhandle-Plains Historical Society.
2020 (b) To the extent authorized by law, the commission may
2121 enter into a contract with the Panhandle-Plains Historical Society
2222 for the operation and management of the museum. The commission may
2323 also enter into a contract with West Texas A&M University or The
2424 Texas A&M University System, as needed for the construction,
2525 renovation, expansion, maintenance, or management of museum
2626 facilities on the campus of West Texas A&M University.
2727 (c) The contract with the Panhandle-Plains Historical
2828 Society authorized by this section must include provisions for:
2929 (1) expanding, renovating, managing,
3030 maintaining, operating, or providing financial support for the
3131 museum collection and museum facility and related assets;
3232 (2) preserving the museum's collection;
3333 (3) employing a museum director and other
3434 employees the commission considers necessary to fulfill its duties
3535 and responsibilities under the contract;
3636 (4) accepting donations of money, property, and
3737 historical relics; and
3838 (5) acquiring property and historical relics
3939 with funds available for that purpose.
4040 (d) The Panhandle-Plains Historical Museum fund is created
4141 as a fund outside the state treasury. The commission shall
4242 administer the fund but may contract with the Panhandle-Plains
4343 Historical Society for administration of the fund. The fund
4444 consists of:
4545 (1) admissions revenue from the operation of the
4646 museum;
4747 (2) sales revenue from the operation of the
4848 museum gift shop; and
4949 (3) donations made to the commission for the
5050 museum.
5151 (e) Money in the Panhandle-Plains Historical Museum
5252 fund may be spent without legislative appropriation and only to
5353 administer, operate, preserve, repair, expand, or otherwise
5454 maintain the museum.
5555 (f) Interest and income from the assets of the
5656 Panhandle-Plains Historical Museum fund shall be credited to and
5757 deposited in the fund.
5858 SECTION 2. Section 61.003(6), Education Code, is amended to
5959 read as follows:
6060 (6) "Other agency of higher education" means The University
6161 of Texas System, System Administration; The University of Texas at
6262 El Paso Museum; Texas Epidemic Public Health Institute at The
6363 University of Texas Health Science Center at Houston; The Texas A&M
6464 University System, Administrative and General Offices; Texas A&M
6565 AgriLife Research; Texas A&M AgriLife Extension Service; Rodent and
6666 Predatory Animal Control Service (a part of the Texas A&M AgriLife
6767 Extension Service); Texas A&M Engineering Experiment Station
6868 (including the Texas A&M Transportation Institute); Texas A&M
6969 Engineering Extension Service; Texas A&M Forest Service; Texas
7070 Division of Emergency Management; Texas Tech University Museum;
7171 Texas State University System, System Administration; Sam Houston
7272 Memorial Museum;[ Panhandle-Plains Historical Museum;] Cotton
7373 Research Committee of Texas; Texas Water Resources Institute; Texas
7474 A&M Veterinary Medical Diagnostic Laboratory; and any other unit,
7575 division, institution, or agency which shall be so designated by
7676 statute or which may be established to operate as a component part
7777 of any public senior college or university, or which may be so
7878 classified as provided in this chapter.
7979 SECTION 3. On September 1, 2025, an employee of West Texas
8080 A&M University assigned exclusively to the museum becomes an
8181 employee of the commission.
8282 SECTION 4. Section 102.35, Education Code, is repealed.
8383 SECTION 5. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2025.
