7	7	AN ACT
8	8	relating to the operation and management of the Panhandle-Plains
9	9	Historical Museum by the Texas Historical Commission.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Chapter 442, Government Code, is amended by adding
12	12	Subchapter B-3 to read as follows:
13	13	SUBCHAPTER B-3. PANHANDLE-PLAINS HISTORICAL MUSEUM
14	14	Sec. 442.067. DEFINITION. In this subchapter, "museum"
15	15	means the Panhandle-Plains Historical Museum in Canyon, Texas.
16	16	Sec. 442.068. PANHANDLE-PLAINS HISTORICAL MUSEUM; FUND.
17	17	(a) The museum currently consists of a facility on the campus of
18	18	West Texas A&M University and a collection owned by the
19	19	Panhandle-Plains Historical Society.
20	20	(b) To the extent authorized by law, the commission may
21	21	enter into a contract with the Panhandle-Plains Historical Society
22	22	for the operation and management of the museum. The commission may
23	23	also enter into a contract with West Texas A&M University or The
24	24	Texas A&M University System, as needed for the construction,
25	25	renovation, expansion, maintenance, or management of museum
26	26	facilities on the campus of West Texas A&M University.
27	27	(c) The contract with the Panhandle-Plains Historical
28	28	Society authorized by this section must include provisions for:
29	29	(1) expanding, renovating, managing,
30	30	maintaining, operating, or providing financial support for the
31	31	museum collection and museum facility and related assets;
32	32	(2) preserving the museum's collection;
33	33	(3) employing a museum director and other
34	34	employees the commission considers necessary to fulfill its duties
35	35	and responsibilities under the contract;
36	36	(4) accepting donations of money, property, and
37	37	historical relics; and
38	38	(5) acquiring property and historical relics
39	39	with funds available for that purpose.
40	40	(d) The Panhandle-Plains Historical Museum fund is created
41	41	as a fund outside the state treasury. The commission shall
42	42	administer the fund but may contract with the Panhandle-Plains
43	43	Historical Society for administration of the fund. The fund
44	44	consists of:
45	45	(1) admissions revenue from the operation of the
46	46	museum;
47	47	(2) sales revenue from the operation of the
48	48	museum gift shop; and
49	49	(3) donations made to the commission for the
50	50	museum.
51	51	(e) Money in the Panhandle-Plains Historical Museum
52	52	fund may be spent without legislative appropriation and only to
53	53	administer, operate, preserve, repair, expand, or otherwise
54	54	maintain the museum.
55	55	(f) Interest and income from the assets of the
56	56	Panhandle-Plains Historical Museum fund shall be credited to and
57	57	deposited in the fund.
58	58	SECTION 2. Section 61.003(6), Education Code, is amended to
59	59	read as follows:
60	60	(6) "Other agency of higher education" means The University
61	61	of Texas System, System Administration; The University of Texas at
62	62	El Paso Museum; Texas Epidemic Public Health Institute at The
63	63	University of Texas Health Science Center at Houston; The Texas A&M
64	64	University System, Administrative and General Offices; Texas A&M
65	65	AgriLife Research; Texas A&M AgriLife Extension Service; Rodent and
66	66	Predatory Animal Control Service (a part of the Texas A&M AgriLife
67	67	Extension Service); Texas A&M Engineering Experiment Station
68	68	(including the Texas A&M Transportation Institute); Texas A&M
69	69	Engineering Extension Service; Texas A&M Forest Service; Texas
70	70	Division of Emergency Management; Texas Tech University Museum;
71	71	Texas State University System, System Administration; Sam Houston
72	72	Memorial Museum;[ Panhandle-Plains Historical Museum;] Cotton
73	73	Research Committee of Texas; Texas Water Resources Institute; Texas
74	74	A&M Veterinary Medical Diagnostic Laboratory; and any other unit,
75	75	division, institution, or agency which shall be so designated by
76	76	statute or which may be established to operate as a component part
77	77	of any public senior college or university, or which may be so
78	78	classified as provided in this chapter.
79	79	SECTION 3. On September 1, 2025, an employee of West Texas
80	80	A&M University assigned exclusively to the museum becomes an
81	81	employee of the commission.
82	82	SECTION 4. Section 102.35, Education Code, is repealed.
83	83	SECTION 5. This Act takes effect immediately if it receives
84	84	a vote of two-thirds of all the members elected to each house, as
85	85	provided by Section 39, Article III, Texas Constitution. If this
86	86	Act does not receive the vote necessary for immediate effect, this
87	87	Act takes effect September 1, 2025.
